AN ORDINANCE AMENDING CHAPTER 13.08 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,RELATING TO NEW LIGHT AND POWER
RULES AND REGULATIONS AUTHORIZING A CHARGE
FOR CUSTOMER CHECKS RETURNED TO THE LIGHT
AND POWER DEPARTMENT OF THE TOWN OF ESTES
PARK,COLORADO AS NOT PAYABLE.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO:
Section 1.Chapter 13.08 of the Municipal Code
of the Town of Estes Park,Colorado is amended by adding
Section 13.08.090 to read as follows:
13.08.090 Charge for Returned Customer Checks.
A.The department shall impose a charge upon any
customer whose check for payment to the department is returned
by a bank as not payable.
H.The amount of the charge for a check from a
customer that is returned to the department as not payable
shall be revised periodically,if necessary.
C.The applicable charge shall be:
$10.00 per returned check
Section 2.Except as herein specifically amended,
Title 13 and all ordinances or parts of ordinances of the
Municipal Code of the Town of Estes Park relative to the
Light and Power Department shall be and hereby are designated
to remain in full force and effect and are hereby ratified,
confirmed and approved.

Section 3.The Board of Trustees hereby authorizes
the Town Administrator and other officials of the Town to
file with the Public Utilities Commission of the State of
Colorado such documents and to take such action as may be
necessary to obtain the approval of said Public Utilities
Commission as may be required under applicable law for
changes in rates for electric service,but subject only to
such jurisdiction as may exist in the Commission relative
to electric service provided outside the municipal boundaries
of the Town.
Section 4.The Board of Trustees of the Town of
Estes Park,Colorado,herewith finds,determines and desig
nates that this Ordinance is necessary for the immediate
preservation of the public peace,health and safety,because
reliable electric service affects the public peace,health
and safety;and the change in electric rates authorized
herein is necessary to maintain reliable electric service
and preserve the financial and operating integrity of the
municipal electric system;and whereas,in the opinion of
the Board of Trustees,an emergency exists,this Ordinance
shall take effect and be in force as of April 8,1982,
or as of the first day commencing after the final approval
of the rate set forth in this Ordinance relative to the
service provided outside the municipal boundaries of the

Town is obtained from the Public Utilities Commission of the
State of Colorado,whichever date is the later to occur,and
after its final passage,adoption and the signature of the
Mayor.
