ORDINANCE NO.2 -82
AN ORDINANCE APPROVING THE ANNEXATION
OF CERTAIN TERRITORY TO THE TOWN OF ESTES
PARK,COLORADO,TO BE KNOWN AND DESIGNATED
AS “PROSPECT ESTATES ADDITION”TO THE TOWN
OF ESTES PARK,COLORADO.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF ESTES PARK,
COLORADO:
Section 1:That a Petition for Annexation,together with
four (4)copies of the plat of said area as required by law,was
filed with the Board of Trustees on the 30th day of September
1981,by the landowners of more than fifty percent (50%)of the
area,excluding public streets and alleys,of the area
hereinafter described.The Board,by Resolution at its regular
meeting on the 8th day of December,1981,accepted said Petition
and found and determined that the provisions of Section 31—12—107
Cl)(g),C.R.S.1973,as amended,were met;and the Board further
determined that a public hearing should be held on January 12,
1982 at 7:30 P.M.in the Municipal Building for the purpose of
determining that the proposed annexation complies with the
applicable provisions of Sections 31—12—104 and 31—12—105,C.B.S.
1973,as amended,and is considered eligible for annexation.
Section 2:That the Notice of said hearing was aiven and
published as provided in Section 31—12—108 (2),C.B.S.1973,as
amended.
Section 3:That the hearing was held pursuant to the
provisions of Section 31—12—109,C.B.S.1973,as amended,on this
12th day of January,1982.
Section 4:That followinc said hearing,the Board of
Trustees adopted a Resolution determining that the proposed
annexation met the requirements o the applicable parts of
Sections 31—12—104 and 31—12—105,C.B.S.1973,as amended;that
an election was not required under Section 31—12—107 (2),C.B.S.
1973,as amended;and that no additional terms or conditions are
to be imposed upon said annexation.

Section 5:That the annexation of the following described
area to the Town of Estes Park,Colorado,designated as “PROSPECT
ESTATES ADDITION”to the Town of Estes Park,is hereby approved:
A portion of the SE 1/4 of Section 36,T5N,P73W of the 6th
P.M.and the SW 1/4 of Section 31,TSN,P72W of the 6th
P.M.,being more particularly described as follows:
Beginning at the F 1/4 corner of said Section 36 as
monumented by a U.S.G.L.O.brass capped pipe;thence S
0i00ll37 W 1271.48 feet;thence S 8902215311 E 1066.34 feet;
thence S 41°16’07”W 27.71 feet;thence S 89°22 15311 F 278.01
feet;thence 5 0001510011 F 30.00 feet to the SW 1/16 corner
of said Section 31 as monumented by a brass bolt in
concrete;thence N 89°22’53”W 383.30 feet;thence N
41°16’07”F 1.32 feet;thence N 89°22’53”W 944.66 feet;
thence S 01°0l’37”W 557.01 feet;thence S 80°24’OR P1 326.47
feet;thence along a curve concave to the north having a
radius of 507.5 feet and a central angle of 37°38’for a
distance of 333.34 feet;thence N 610577520 W 91.5 feet;
thence S 0i001T40 W 554.43 feet;thence N 88°52’P7 273.6
feet;thence S 01°Ol’P7 738.82 feet to the township line
common to T5N and T4N;thence along the township line N
88°52’W 1655.33 feet to the 5 1/4 corner of Section 36 as
monumented by a U.S.G.L.O.brass capped pipe;thence N
01°05’38”E 971.73 feet;thence along a non tangent curve
concave to the south with a radius of 746.3 feet and a
central angle of 07°49’42”for a distance of 101.97 feet,
resultant chord being N 8559’47”F 101.89 feet;thence due
north 78.64 feet;thence due west 100.00 feet;thence N01°05’38”F 1559.61 feet;thence S 890287160 F 2652.37 feet
to the Point of Beginning.
All bearings herein are relative to the South line of said
SE 1/4 being N 88°52’W.
Section 6:The Board of Trustees of the Town of Estes Park,
Colorado,herewith finds,determines and designates that this
Ordinance is necessary for the imniediate preservation of the
public peace,health and safety,in order to provide for
immediate availability of municipal services to the annexed area;
and,whereas,in the opinion of the Board of Trustees,an
emergency exists,this Ordinance shall take effect and be in
force immediately after its passage,adoption and signature of
the Mayor.

day of January,1982,and published in a newspaper of general
circulation in the Town of Estes Park,Colorado,on
