HomeMy WebLinkAboutORDINANCE 23-820 0 ORDINANCE NO.23-82 AN ORDINANCE AMENDING CHAPTER 16 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME PERTAINING TO SUBDIVISION REGULATIONS BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Section 16.16.060 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 16.16.060 Street Dead—end.Dead—end streets shall ordinarily be not more than five hundred feet in length.The closed end shall have a turn around with a property line radius of at least 50 feet and a paved outside radius of at least 45 feet.In residentially zoned areas,an unpaved center island with a maximum radius of 21 feet may be left, if approved by the Town Board. Section 2.That Section 16.24.050 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 16.24.050 Proposals.Proposals shall be as follows: 1.Location and principal dimensions for all proposed streets,alleys,easements,lot lines and areas to be reserved for public use; 2.Street names in accordance with town system; 3.Radii of all curves; 4.Drainage plan showing all proposed drainage facilities, prepared according to the criteria established in the latest revision of the ‘Larimer County Storm Water Management Manual”. 5.Sidewalk location and width when required; 6.Provisions for water,sewer and electricity; 7.Preliminary drawings for water,sewage and drainage systems. Section 3.That Section 16.28 of the Municipal Code of the Town of Estes Park,Colorado,by the amendment of Section 16.28.020,16.28.040,16.28.110,16.28.210, 16.28.220,16.28.240 and 16.28.280,to read as follows: 16.28.020 Legibility,size and border.The final annexa tion map or subdivision plat,including all drawings and signatures,shall be clearly and legibly drawn in black water proof ink on tracing cloth or acetate material of a good quality,or on mylar.Each sheet shall be twenty-four inches by thirty—six inches in size with a marginal line one inch from each edge.The title,all drawings,affidavits, certificates,acknowledgements,endorsements,acceptances of dedication,and notarial seals shall be within the marginal lines.The original,two mylar reproducible copies,and eight copies shall be filed in the office of the town clerk. 0 0 16.28.040 Key diagram and vicinity map.If more than one sheet is used,a key diagram showing the area covered by each sheet shall appear on the title sheet.A vicinity map shall be included showing the area adjacent to the proposed subdivision or annexation.Said vicinity map shall have a maximum scale of 1 inch =1,200 feet. 16.28.110 Dimensions.Accurate dimensions for all lines, angles,and curves used to describe boundaries,streets,alleys, easements,areas to be reserved for public use and other important features shall be provided.Sufficient data shall be shown to determine readily the bearing and length of every lot line and boundary line.No ditto marks shall be used.Lots shall show net acreage to the nearest hundredth.Length,radius and total delta and chord bearings of each curve and the bearing of radial lines to each lot corner on a curve shall be shown.The map or plat shall show all easements to which the lots are subject in such a manner that the easements may be retraced in the field. Easements for storm drains,sewers,building lines and other purposes shall be denoted by fine dashed lines.The centerline of all streams and natural drainage channels which are not offered for dedication to public use on the map or plat shall be shown by dashed lines. 16.28.150 Filing required.Within one year after a prelim inary map or plat has been approved by the planning commission, and after the intermediate steps described in Section 16.24.070 have been completed,an original,two mylar reproducible copies, and eight additional copies of a final map or plat must be filed with the town clerk for final approval.If a final map or plat is not so filed,a new preliminary map or plat must be filed. 16.28.210 Improvements generally.No final map or plat shall be approved,unless the improvements required by Sections 16.28.180,16.28.220 through 16.28.270 of this code have been installed,or the installation of the same have been guaranteed in accordance with the provisions of chapter 16.36. 16.28.220 Water mains and fire hydrants.The subdivider shall install water mains in such diameter as the town may require. The subdividers shall install fire hydrants to such specification as shall be determined by the town.All water mains,water lines, and fire hydrants shall be installed in accordance with the Water Main Extension Requirements of June 14,1979.All service lines shall be installed to the property line prior to the paving of the street. 16.28.240 sanitary sewer systems.Where the public sanitary sewer system,in the opinion of the town,The Estes Park Sanitation District,The Upper Thompson Sanitation District,and the Larimer County health department,is reasonably accessible,the property owner shall construct a complete sanitary sewer system,in accord ance with the specifications of the state of colorado,The Estes Park Sanitation District,The Upper Thompson Sanitation District, Larimer County health department and the town,including a con nection for each lot.Where lots cannot be served by the extension of an existing public sanitary sewer,the property owner shall obtain approval of lot sizes from the town and the Larimer County health department for individual septic tanks and disposal fields, or approval of a neighborhood disposal system.The provisions of this paragraph shall not waive the requirements of nor compliance with any provisions of the Estes Park Municipal code,or the requirements of the Larimer County health department,relating to sewers,septic tank and disposal fields. 16.28.280 Required data.All maps and plats shall be —2— o accompanied by the following data and material which shall be provided by the subdivider or his agent unless waived by the town: 1.Street Profile:The profile of the centerline of each street with grades; 2.Street Cross—section:The cross—section of all streets showing the shoulder and surface width taken for each block at the point of greatest slope and showing the width of sidewalks and the location and size of utility mains; 3.Utility Plan and Profile:A plan and profile of proposed sanitary and/or storm water sewers with grades and pipe sizes indicated and a plan of the proposed water dis tribution system showing pipe sizes and location of valves and fire hydrants; 4.Water Way and Curb Elevations:High water marks and approximate grade of all ditches,canals,or other water ways to be crossed,and the lines and elevations of existing curbs. 5.Preparation of Plans:All profiles and plans, including each sheet,shall be 24 inches by 36 inches,and prepared,stamped and signed by a registered professional engineer in the State of Colorado,with an approval block for the town engineer. 6.Names and Addresses:The names and addresses of all owners of land immediately adjoining the platted land as their names appear in the records in the office of the clerk and recorder,Larimer County,Colorado,and their addresses as they appear on the tax records of Larimer County. 7.Attorney:A certificate by an attorney duly licensed to practice law in the state of Colorado that all persons or corporations having any record interest in the land to be annexed or subdivided have signed the dedication certificate must be dated as of the date that the board of trustees is to consider the final map or plat on the final reading of the annexation ordinance,or resolution of approval. Section 4.That Section 16.16 of the Municipal Code of the Town of Estes Park,Colorado,is amended thereto by adding a new Subsection 16.16.050 to read as follows: 16.16.050 Street -width and thickness.Minimum street widths shall be as follows: Classification Right—of—Surfaced way width width Major traffic street 100 feet 50 feet Major business street 80 feet 50 feet Secondary street 80 feet 34 feet Local streets 60 feet 24 feet Limited local,loop or cul—de—sac streets 50 feet 24 feet Minimum street asphalt thickness shall be two inches.When warranted by existing soil conditions or proposed traffic loadings,the town may require thickness of the streets to be designed based on a report prepared by a registered professional engineer. Section 5.That Section 16.28 of the Municipal Code of the Town of Estes Park,Colorado,is amended thereto by —3— 0 0 addition a new Subsection 16.28.095 to read as follows: 16.28.095 Town engineer’s certificate of approval.There shall appear on all final maps and plats,a certificate of approval of the town engineer as follows:“Approved by the Town Engineer of Estes Park,Colorado,on the ____ day of __________ 19 Town Engineer” Section 6.The Board of Trustees of the Town of Estes Park,Colorado,herewith finds,determines and designates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety,in order to provide for uniform subdivision regulations;and whereas,in the opinion of the Board of Trustees,an emergency exists,this ordinance shall take effect and be in force immediately after its passage, adoption and signature of the Mayor. or I hereby certify that the above ordinance was introduced and read at a regular meeting of the Board of Trustees on the _________________ days of ______________, 1982,and published in a newspaper of general c rculation in the Town of Estes Park, Colorado,on the-I6 day of ___________, 1982,all as required by the Statutes of the State of Colorado.
