AN ORDINANCE AMENDING CHAPTER 5
OF THE MUNICIPAL CODE OF THE TOWN
OF ESTES PARK,COLORADO,THE SAME
PERTAINING TO BUSINESS REGULATIONS
AND LICENSES
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARE,COLORADO:
Section 1.That Section 5.04.050 of the Municipal
Code of the Town of Estes Park,Colorado,is amended to
read as follows:
5.04.050 Prorating fees.The stated license fee shall
be for the calendar year in which the license is issued,un
less provided otherwise,and there shall be no reduction or
proration of fees where the license is applied for after the
first of the calendar year.The stated license fee shall be
prorated for all licenses issued because of annexation of
the business premises to the Town of Estes Park.Said pro
ration shall be based upon the number of full months remaining
in the calendar year following the date of annexation.
Section 2.That Section 5.28.050 of the Municipal
Code of the Town of Estes Park,Colorado,is amended to
read as follows:
5.28.050 Payment of tax.The tax levied in Section
5.28.040 shall be due and payable to the town treasurer on
the date the license to sell the beer and liquors set forth
in the section is issued,and on the same day each year
thereafter,as long as the license is valid.In the event
the premises are annexed to the Town of Estes Park,the tax
levied in Section 5.28.040 shall be prorated from the date
of annexation to the date of issuance of the license.The
tax shall be delinquent one month from the date the tax is
due.
Section 3.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates
that this Ordinance is necessary for their immediate preserva
tion of the public peace,health and safety,in order to
provide for uniform business regulations and licenses;and
whereas,in the opinion of the Board of Trustees,an emergency
exists,this Ordinance shall take effect and be in force

immediately after is passage,adoption and signature of
the Mayor.
