HomeMy WebLinkAboutORDINANCE 22-860 #22—8 6 AN ORDINANCE AMENDING TITLE 17 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO, THE SAME PERTAINING TO ZONING BE IT ORDAINED BY THE TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO: Section 1.That Title 17 of the Municipal Code of the Town of Estes Park,Colorado,except for Chapter 17.66,shall be amended in its entirety as follows: See Exhibit A,attached hereto and incorporated herein by reference. Section 2.Chapter 17.66 of the Municipal Code of the Town of Estes Park,Colorado,shall remain in full force and effect without any amendments thereto. Section 3.The Board of Trustees of the Town of Estes Park, Colorado,herewith finds,determines and designates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety,in order to preserve the property values,aesthetic consideration and proper administration of the new zoning code of the Town of Estes Park; and,whereas,in the opinion of the Board of Trustees an emergency exists,this Ordinance shall take effect and be in force immediately after its passage,adoption and signature of the Mayor. 0017.04.010—17.08.030CHAPTER17.04PURPOSE17.04.010Designated.ThisTitleisadoptedforthepurposeofpromotingthepublichealth,safety,morals,order,convenience,happiness,prosperity,andgeneralwelfare;ofconservingthevalueofpropertywithintheTown;ofencouragingthemostappropriateuseoflandthroughouttheTown;oflesseningcongestioninthestreets;ofavoidingundueconcentrationofpopulation;ofpreventingtheovercrowdingofland;offacilitatingtheadequateprovisionoftransportation,andofsecuringsafetyfromfire,panicandotherdangers;andbymakingregulationsinaccordancewithacomprehensiveplanfortheuseanddevelopmentofallpropertythroughouttheTown.CHAPTER17.08DEFINITIONS17.08.010Generally.ForthepurposeofthisTitle,certaintermsandwordsaredefinedassetforthinthischapter.17.08.020Generalrneanings.Wordsusedinthepresenttenseincludethefuture;wordsinthesingularincludetheplural,andwordsinthepluralnumberincludethesingular;“building”includes“structure”;“use”includes“arranged,designed,orintendedtobeused”;includes“arranged,designed,orintendedtobeoccupied;”“shall”ismandatoryandnotdirectory.Theword“person”includesacorporation,partnership,orotherentitycapableofowning,leasing,developing,ormanagingproperty.17.08.030DefinitionsAdultBookstore:anestablishmenthavingasasubstantialorsignificantportionofitsstockintradebooks,magazines,andothermatterwhicharedistinguishedorcharacterizedbytheiremphasisdepicting,describing,orrelatingtosexualconductorsexualexcitment.AdultCabaret:abar,restaurant,orsimilarestablishmentwhichregularlyfeaturesexoticdancers,strippers,maleorfemaleimpersonators,orsimilarentertainers.AdultNotionPictureTheater:anenclosedbuildingusedforpresentingmaterialdistinguishedbyanemphasisonmatterdepicting,describing,orrelatingtosexualconductorsexualexcitement.AdultUse:anadultbookstore,adultmotionpicturetheatre,adultcabaret,massageparlor,orsimilarestablishmentorportionofanestablishmentcustomarilynotopentothepublicgenerallybutonlytooneormoreclassesofthepublic,excludingminorsbyreasonofageasaprevailingpractice.Amusements:anestablishmentorenterpriseforthepurposeofamusingorentertainingpersons,includingbywayofexample,butnotinlimitation,museums,bowlingalleys,poolhalls,arcades,dancehalls,puppetshows,theaters,cinemas,concerts,stageshows,rollerandiceskatingrinks,sportfacilities,andrecreationalfacilities,whethersuchestablishmentsbeindoor1 C017.08.030—17.08.040Use:thepurposeforwhichlandorpremisesorabuildingthereonisdesigned,arranged,orintended,orforwhichitisornaybeoccupiedormaintained.Use,accessorytanactivityincidentaltoandlocatedonthesamepremisesasaprincipaluseconductedbythesamepersonorhisagent.Nouseotherthanparkingshallbeconsidered“accessory”unlessfunctionallydependentonandoccupyinglesslandareathantheprincipalusetowhichitisrelatedandoccupyinglessthanonequarterasmuchhabitablefloorareaasthatprincipaluse.17.08.040Effectofdefinitions.ThedefinitionscontainedinSection17.08.030shallreplaceandgovernoveranyotherdefinitionofthesamewordorphraseasthesameisdefinedinanyotherSectioninTitle17oftheCode.9 Ca17.24.030—17.24.0503.Continuity.WalkwaysshallbebuilttoallowcontinuouspedestrianaccessfromanysidewalkswhichmaybeadjacenttothestreetortheStreetright—of—waytobuildingentriesorthecontinuouswalkwaysystemoutlinedabove.4.Separation.Walkwaysshallbeseparatedfromparking,andwheretheycrossinternalcirculationandparkingaccesslanesshallbeclearlymarkedwithpaint,paving,texturalchange,lighting,landscaping,and/orcontinuationofsidewalkpavingacrossthevehicularlane.Handicapped—accessiblecurbcutsshallbeprovided.5.Specifications.Requiredwalkwaysshallbenotlessthanfivefeetinwidth,avoidgradesinexcessof8%whereverpossible,andmaybeconstructedofanymaterialsassuringall—weatherusability.17.24.040DisturbpncesNoactivityshallbepermittedunlessthefollowingaremet:1.Standard.Nosound,noise,vibration,odor,orflashing(exceptforwarningdevices,temporaryconstructionormaintenancework,parades,specialevents,orotherspecialcircumstances)shallbeobservablewithoutinstrumentsmorethan200feetfromtheboundariesoftheoriginatingpremisesatlocationswithinaC—0,C—H,or1—1district,ormorethan40feetfromtheboundariesatlocationswithinanyotherdistrict.However,theBoardofTrusteesmayauthorizeonSpecialReviewanactivitynotmeetingthesestandards,incaseswheretheBoarddeterminesthatnoobjectionableconditionswilltherebybecreatedfortheuseofotherpropertiesbecauseofpeculiaritiesoflocationorcircumstance.2.PerformanceCompliance.Foraproposedfacilitywhosefuturecompliancewiththisrequirementisquestionable,theTownPlannermayrequirethattheapplicantfurnishevidenceofprobablecompliance,whetherbyexampleofsimilarfacilitiesorbyengineeringanalysis.IssuanceofapermitonthebasisofthatevidenceshallcertifytheTownsacceptanceoftheconformityofthebasicstructureandequipment,butfutureequipmentchangesandoperatingproceduresmustbesuchastoalsocomplywiththisstandard.17.24.050DrainageSitegrading,designandlocationofbuildingsandpaving,andprovisionofdrainagefacilitiesshallassurethatstormwatermanagementmeetsthesestandards.1.FloodAreas.ThereshallbecompliancewiththerequirementsofSection17.28withinthefloodwayandfloodfringedistricts.2.Standard.Drainagefacilitiesshallbedesignedbasedoncriteriaestablishedinthe“LarimerCountyStorm—waterManagementManual”.29 0017.24.050—17.24.0503.Detention.Detentiondevicesshallbeemployedwherenecessarytoprotectthatdevelopmentanddownstreamproperties.Thereshallbenoincreaseinthehistoricpeakrateofdischargeofstormwaterfromthesitetostreamsoradjacentproperties,unlesstheTownEngineerdeterminesthatsuchdetentionisunnecessaryforcontrollingflooding,erosion,siltation,orpollution,orwouldcauseenvironmentaldamageforotherreasons.24/EPTRIAL230 oo17.28.060—17.28.07017.28.060FFFloodFringeDistrict—Conditions.ThepermittedusessetforthinSection17.28.050aresubjecttothefollowingconditions.1.Allstructuresshallbeplacedonfillsothatthelowestfloorofeachstructureisatorabovetheregulatoryfloodprotectionelevation.NonresidentialstructuresmaybepermittedwithoutbeingplacedonfillprovidedsuchstructurescomplywiththefloodproofingrequirementsofthisChapter.2.Nofillnordepositofmaterialsshallbepermittedifsuchisfoundtoreducethestorageorflowcapacityofadrainway.3.Nouseshallbecommencednorstructuresbuiltwhichmaylimitorrestricttheflowcapacityofthechannelofadrainway,orwhichmayretarddrainageoffloodwatersfromsuchchannel.4.Fillordepositofmaterialsshallbepermittedonlytotheextentrequiredforplacementofstructuresandtheiraccessoryuses,exceptsuchstockpilingandstorageasmaybepermittedbyspecialreview.5.Allnewandreplacementwatersupplysystemsshallbedesignedtominimizeoreliminateinfiltrationoffloodwatersintothesystem.6.Allnewandreplacementsanitarysewersystemsshallbedesignedtominimizeoreliminateinfiltrationoffloodwatersintothesystems,anddischargefromthesystemsintofloodwaters;andon—sitewastedisposalsystemsshallbelocatedsoastoavoidimpairmenttothemorcontaminationfromthenduringflooding.7.InanyareadesignatedA0zoneontheofficialfloodplainmap,theprovisionsofparagraph12belowshallapply.8.Thestorageorprocessingofmaterialsthatare,intimeofflooding,buoyant,flammable,poisonous,exposiveorcouldbeinjurioustohuman,plant,oranimallifeshallbeprohibited.17.28.070SpecialReviewApplications.AllapplicationsforusespermittedbyspecialreviewEWfloodwayandFTfloodfringedistrictsshallbesubmittedinaccordancewiththerequirementsofSection17.36.030andinaddition,shallcontainthefollowinginformation,unlessitisdeterminedbytheTownPlannerthatsufficientinformationisavailabletotheTown:1.Plansdrawntoscaleandpreparedbyaprofessionalengineerorlicensedsurveyorshowingthenature,location,dimensionsandelevationofthelot,parcel,ortractofland;2.Locationanddimensionsofallproposedstructures;3.Theamountoffilltobeused,ifany;4.Adescriptionandspecificationsofallfloodproofingmeasures;33 CC17.28.070—17.28.0905.Therelationshipoftheuseorstructurestothelocationofthechannel,floodwayandfloodprotectiondevices;6.Thefloodprotectionelevation;7.Atypicalvalleycross—sectionshowingthechannelofstreams1elevationoflandareasadjoiningeachsideofthechannel,cross—sectionalareastobeoccupiedbytheproposeddevelopment,andhighwaterinformation;8.Surfaceviewplansshowingelevationsorcontoursoftheground,pertinentstructures,fill,orstorageelevations;9.Locationandelevationsofstreets,watersupplyandsanitaryfacilities;10.Aprofileshowingtheslopeofthebottomofthechannelorflowlineofthestream;11.Specificationsforbuildingconstructionandmaterials,flood—proofing,filling,dredging,grading,channelimprovements,storageofmaterials,watersupplyandsanitaryfacilities.17.28.080SpecialReviewConsiderations.ThefollowingconsiderationsaretobemadebythePlanningCommissionandBoardofTrusteeswhenreviewingspecialreviewapplicationsforareaslocatedintheFWfloodwayandFFfloodfringedistricts:1.Thedangertolifeandtopropertyupstreamanddownstreamwithinthefloodplainduetotheincreasedfloodheightsorvelocitiescausedbytheproposeduse;2.Thedangertolifeandpropertyduetomaterialsbeingsweptawayontootherlandsordownstreamintheeventofaflood;3.Whethertheproposedwatersupplyandsanitationsystemsaresufficienttopreventdisease,contaminationandunsanitaryconditionsintheeventofaflood;4.Thesafetyofaccesstothepropertyintimesofflood;5.Theexpectedheights,velocity,duration,rateoftherise,andsedimenttransportoffloodwatersattheproposedpropertyandtheireffectontheproposeduse;6.TherecommendationsoftheTownEngineerandtheAdministrator.17.28.090FloodplainfleyelopmentPermit.Afloodplaindevelopmentpermitshallbeobtainedbeforeconstructionorimprovementbeginswithinanyareaofspecialfloodhazard.Applicationsforspecialfloodplaindevelopmentpermitsshallbeaccompaniedbysurveys,plotplans,drawings,andplansindicatingfloodproofingmeasuresassetforthinthisChapter.34 0017.28.100—17.28.11017.28.100flesi%nStandards—FWFloodwayDistrict.Allusespermittedinthefloodwaydistrictshallcomplywiththefollowingdesignstandard:1.FillshallnotbepermittedintheFWdistrictexceptwhensuchfill,actingaloneorincombinationwithexistingorfuturefloodplainuses,shallbeshowntonotincreasefloodheightsduringthebaseflooddischarge;andsuchfillshallbeprotectedagainsterosionwhereerosionvelocitiesmayoccurbytheuseofriprap,bulkheading,orvegetativecover.2.Wherestructuresareallowed,thefollowingrestrictionsshallapply:a.Structuresshallnotbedesignedforhumanresidentialoccupancy;b.Structuresshallbeconstructedsothatthelongitudinalaxisofthestructureisparalleltothedirectionofthefloodflow;c.Wheneverpossible,placementofstructuresshallbeuponthesameflood—flowlinesasthoseofadjoiningstructures;d.Allutilityservicesinconnectionwithstructuresshall,wheneverpossible,beplacedabovethefloodprotectionelevationorwherenotpracticableshallmeetthefloodproofingrequirementofthisChapter.3.Nouseshallincreasefloodheightsduringthebaseflooddischarge.4.Nonewmobilehome,mobilehomepark,nornewmobilehomesubdivisionshallbeplacedinthedesignatedfloodway.17.28.110DesignStandards—FFFloodFringe.AllusespermittedintheFFfloodfringedistrictshallcomplywiththefollowingdesignstandard:1.TheuseoffillshallbetheminimumnecessarytocomplywiththeprovisionsofthisSection.WhenrequiredbytheprovisionsofthisChapter,fillshallbetoapointnolowerthantheregulatoryfloodprotectionelevationfortheareainquestion.Suchfillshallfurtherextendatsuchelevation15feetbeyondtheouterperimeterofanystructureerectedonsuchfill.Nofillshallbeusedinsuchamannerastorestricttheflowcapacityofanydrainway.2.Thelowestfloorofanystructureshallbenolowerthantheregulatoryfloodprotectionelevation.NonresidentialstructuresmaybepermittedwithoutbeingplacedonfillprovidingthefloodproofingrequirementsofthisChapteraremet.3.Allutilityservices,furnaces,waterheatersandelectricalwiringinconnectionwithstructuresshallbeplacedabovetheregulatoryfloodprotectionlevelorshouldmeetthefloodproofingrequirementsofthisChapter.35 CC)17.28.110—17.28.1204.Thefollowingregulationsshallapplytoallnewmobilehomeparksandmobilehomesubdivisions;andtoexpansionsofexistingmobilehomeparksandexpansionsofexistingmobilehomesubdivisions;andtoexistingmobilehomesubdivisionswheretherepair,construction,orimprovementofthestreets,utilities,andpadsequalsorexceeds50%ofthevalueofthestreets,utilitiesandpadsbeforetherepair,reconstruction,orimprovementhascommenced:a.Standsorlotsshallbeelevatedoncompactedfilloronpilingssothatthelowestfloorisatorabovetheregulatoryfloodprotectionelevation.b.Adequatesurfacedrainageandaccessforremovalofallmobilehomesshallbeprovided.c.Wherestandsorlotsareelevatedonpilings,thelotsorstandsshallbelargeenoughtopermitsteps;pilingfoundationsshallbeplacedinstablesoilnomorethantenfeetapart,andreinforcementshallbeprovidedforpilingsmorethansixfeetabovegroundlevel.d.Allmobilehomessituatedwithinsuchparksorsubdivisions,andmobilehomesplacedinexistingmobilehomeparksandexistingmobilehomesubdivisionsshallbeanchoredtoresistflotation,collapseandlateralmovementbyprovidingover—the—toptiesandframetie5togroundanchors.Allcomponentsoftheanchoringsystemshallbecapableofcarryingaforceof4,800poundspersquareinch.Alladditionstoanymobilehomeshallalsobeanchored.Thefollowingistheminimumanchoringsystemrequired:1)Thereshallbeprovidedover—the—toptiesateachofthefourcornersofthemobilehome,withtwoadditionaltiesoneachlongsideatintermediatelocations,exceptthatmobilehomeslessthan50feetlongshallbeprovidedwithonesuchadditionaltie.2)Thereshallbeprovidedframetiesateachofthefourcornersofthemobilehome,withfiveadditionaltiesperlongsideatintermediatepoints,exceptthatmobilehomeslessthan50feetlongshallhavefouradditionaltiesperlongside.17.28.120DesignStandardszAreaofShallowFlooding.Allnewconstructionandsubstantialimprovementsintheareaofshallowfloodingshallcomplywiththefollowingdesignstandard:1.Allnewconstructionandsubstantialimprovementsofresidentialstructureslocatedintheareaofshallowflooding,A0zone,asdelineatedontheofficialfloodplainzoningmapshallhavethelowestfloor)includingbasement,elevatedabovethecrownoftheneareststreettoorabovethedepthnumberspecifiedontheFloodInsuranceRateNapoftheTown.2.AllnewconstructionandsubstantialimprovementsofnonresidentialstructureslocatedintheareaofshallowfloodingADzone,asdelineatedontheofficialfloodplainmap,shalleitherhavethelowestfloorincludingbasementelevatedabovethecrownoftheneareststreettoorabovethedepth36 CC17.28.120—17.28.130numberspecifiedontheFloodInsuranceRateMapoftheTown;or,togetherwithallutilityandsanitaryfacilitiesconnectedtherewith,becompletelyfloodproofedtoorabovesuchlevelsothatspacebelowsuchleveliswatertightwithwallssubstantiallyimpermeabletothepassageofwater,andwithstructuralcomponentshavingthecapabilityofresistinghydrostaticandhydrodynamicloadsandeffectsofbuoyancy.17.28.130Floodproofinp.Floodproofingmeasurestakenfornonresidentialstructurespursuantheretoshallbedesignedconsistentwiththeregulatoryfloodprotectionelevationforthelocationthereof,floodvelocities,durations,rateofrise,hydrostaticandhydrodynamicforces,andotherfactorsassociatedwtihtheareaofspecialfloodhazard.Theapplicantshallsubmitaplanordocumentcertifiedbyaregisteredprofessionalengineerorlicensedarchitectthatthefloodproofingmeasuresareconsistentwiththeregulatoryfloodprotectionelevationandassociatedfloodfactorsforthelocationthereof.Thefollowingfloodproofingmeasuresshallbeused,whereapplicable,inthemannersetforthinthefloodproofingregulationspublishedbytheU.S.ArmyCorpsofEngineers:1.Anchoragetoresistflotationandlateralmovementofstructures;2.Installationofwatertightdoors,bulkheadsandshutters,orreinforcementofwallstoresistwaterpressures;3.Useofpaints,membranes,ormortarstoreduceseepageofwaterthroughwalls;4.Additionofmassorweighttostructurestoresistflotation;5.Constructionofwatersupplyandwastetreatmentsystemssoastopreventtheentranceoffloodwaters;6.Installationofpumpingfacilitiesorcomparablepracticesforsubsurfacedrainagesystemsforbuildingstorelieveexternalfoundationwallandbasementhydrostaticandhydrodynamicpressures;7.Constructiontoresistruptureorcollapsecausedbywaterpressureorfloatingdebris;8.Installationofvalvesorcontrolsonsanitaryandstormdrainswhichwillpermitthedraintobeclosedtopreventback—upsewageandstormwatersintothebuildingorstructures;9.Locationofallelectricalequipment,lines,circuitsandinstalledelectricalappliancesinamannerwhichwillassuretheyarenotsubjecttoflooding;10.Constructionofwater,sewer,andnaturalgaslinestoresistruptureorcollapsecausedbywaterpressure;37 0017.28.130—17.28.16011.Locationofanystructuralstoragefacilitiesforchemicalexplosives,buoyantmaterials,flammableliquids,orothertoxicmaterialswhichcouldbehazardoustopublichealth,safetyandwelfareinamannerwhichwillassurethatthefacilitiesaresituatedatelevationabovetheheightsassociatedwiththeregulatoryfloodprotectionelevationorareadequatelyflood—proofedtopreventflotationofstoragecontainerswhichcouldresultintheescapeoftoxicmaterialsintofloodwaters.17.28.140NonconformjgBuildings.NosubstantialimprovementmaybemadetoanystructurewhichdoesnotconformtotherequirementsofthsChapter.17.28.150Administration.ThisChaptershallbeadministeredbytheBuildingInspector.ItshallbethedutyoftheBuildingInspectortoobtainandmaintainrecordsoflowestfloorelevationsandfloodproofinglevelsforallneworsubstantiallyimprovedstructures,andwhetherornotsuchstructurescontainbasements.ItshallalsobethedutyoftheBuildingInspectortonotifyadjacentcommunitiesandtheappropriatestateofficespriortothealterationorrelocationofariverorwatercourse.CopiesofallsuchnotificationsshallbesubmittedtotheFederalFloodInsuranceAdministration.TheBuildingInspectorshalluseallavailablefloodplaininformationanddataservicestoaidintheadministrationofthisChapter.17.28.160Appeals.AppealstotheBoardofAdjustmentmaybetakenbyanypersonaggrievedbyhisinabilitytoobtainabuildingpermitintheFWfloodwayorFFfloodfringezonesorbyanyofficer,department,board,orbureauoftheTown.Uponreview,theBoardofAdjustmentshallhavejurisdictiononlyoverthefollowingmatters;1.ToreviewtheexactzoningdistrictboundaryoftheFWfloodwayorFFfloodfringedistrictasitrelatestoanyspecificpieceofproperty;2.Todeterminethesuitabilityandadvisabilityofalternatemethodsofconstruction.Suchdeterminationshallnotreducethecapacityofthestructureinvolvedtowithstandflooddamage,norshallanyalternatemethodsrestricttheflowcapacityofthemainchanneloranydrainagerelativethereto;3.Inappropriatecases,theBoardofAdjustmentmayissueavariancefromprovisionsofthisregulationonlyaftermakingaspecificfindingthatthevariancewillnotendangerhealth,welfareandsafetyoftheapplicant,oranyupstreamordownstreamowneroroccupierorland.Variancesshallonlybeissueduponadeterminationthatthevarianceistheminimumnecessary,consideringthefloodhazard,toeffectrelief.Variancesshallnotbeissuedwithinanydesignatedfloodwayifanyincreaseinfloodlevelsduringthebaseflooddischargewouldresult.Anyapplicanttowhomavarianceisgrantedshallbegivenwrittennoticethatthestructurewillbepermittedtobebuiltwithalowestfloorelevationbelowtheregulatoryfloodprotectionelevation,andthatthecostoffloodinsurancewillbecommensuratewiththeincreasedriskresultingfromthereducedlowestfloorelevation.38 0017.28.170—17.28.17017.28.170NonliabilityoftheTown.1.ThedegreeoffloodprotectionprovidedbythetermsofthisChapteris,afterconsideringnumerousrelevantfactors,consideredreasonableforregulatorypurposes.Floodsofgreatermagnitudemayoccurandfloodheightsmaybeincreasedasaresultofnaturalormanmadecauses.Further,provisionsofthisChapterdonotimplythatareasoutsidetheboundariesofareasofspecialfloodhazard,orthatlandusespermittedwithintheareaofspecialfloodhazardarefreefromfloodingorflooddamage.2.ThegrantofapprovalbytheTownundertheregulationsascontainedinthisChaptershallnotconstitutearepresentation,guarantee,orwarrantyofanykindornaturebytheTown,orbyanyofficer,boardmember)oremployeethereof,ofthepracticabilityorsafetyofanystructures,building,orotherproposeduse;andshallcreatenoliabilityuponorcauseofactionagainstsuchpublicbody,officer,boardmember,oremployeeoftheTownforanydamages,fromfloodorotherwise,thatmayresultfromsuchuse.39 0017.32.010—17.32.020CHAPTER17.32MOBILEHOMEANDRECREATIONALVEHICLECRY)PARKREQUIREMENTS17.32.010GeneralDesignRequirements.1.SiteCharacteristicsRequirements.Conditionofthesoil,groundwaterlevel,drainageandtopographyshallnotcreatehazardstothepropertyorthehealthorsafetyfortheoccupants.Thesiteshallnotbeexposedtoobjectionablesmoke,noise,odorsorotheradverseinfluences,andnoportionsubjecttounpredictableand/orsuddenflooding,subsidenceorerosionshallbeusedforanypurposewhichwouldexposepersonsorpropertytohazards.2.SoilandGroundcoverRequirements.Exposedgroundsurfacesinallpartsofeverymobilehomeparkshallbepaved,orcoveredwithstonescreeningsorothersolidmaterial,orprotectedwithavegetativegrowththatiscapableofpreventingsoilerosionandofeliminatingobjectionabledust.3.SiteDrainageRequirements.RequirementsofSection17.24.050shallbeobserved.4.NonresidentUses.Nopartofanyparkshallbeusedfornonresidentialpurposes,exceptsuchusesthatarerequiredforthedirectservicingandwell—beingofparkresidentsandforthemanagementandmaintenanceofthepark.however,nothingcontainedinthissectionshallbedeemedasprohibitingthesaleofamobilehomelocatedonamobilehomestandandconnectedtothepertinentutilities.5.RequiredRecreationAreas.Thereshallbeoneormorerecreationareaswhichshallbeeasilyaccessibletoallparkresidents,totallingaminimumof10%ofthemobilehome/RVparkarea,countingonlyoutdoorrecreationareascontainingatleast2,500squarefeeteach.17.32.020CirculationSystem.1.GeneralRequirements.Allmobilehome/RNparksshallbeprovidedwithsafeandconvenientvehicularaccessfromabuttingpublicstreetsorroadstoeachmobilehomelotviaprivatestreets.Alignmentandgradientshallbeproperlyadaptedtotopographyandshallprovidegooddrainage.2.Access.Accesstomobilehome/RVparksshallbedesignedtominimizecongestionandhazardsattheentranceorexitandallowfreemovementoftrafficonadjacentstreets.Theentranceroadconnectingtheparkstreetswithapublicstreetorroadshallhaveaminimumroadpavementwidthof34feetwhereparkingispermittedonbothsides,oraminimumroadpavementwidthof27feetwhereparkingislimitedtooneside.3.InternalStreets.Surfacedroadwaysshallbeofadequatewidthtoaccommodateanticipatedtraffic,andinanycaseshallmeetthefollowingminimumrequirements:a)Allstreets,exceptminorstreets,34feet;40 017.32.020—17.32.030b)Allminorstreets,wherenoparkingisallowedonbothsidesofthestreet,20feet;wherenoparkingisallowedononesideofthestreet,27feet.(Acceptableonlyiflessthan500feetlongandservingfewerthan25mobilehomes,orofanylengthifone—wayandprovidingaccesstoabuttingmobilehomelotsononesideonly);c)Dead—endstreetsshallbelimitedinlengthto500feetandshallbeprovidedattheclosedendwithaturn—aroundhavinganoutsidepavedroadwaydiameterofatleast90feet.4.RequiredIlluminationofParkStreetSystems.Allparksshallbefurnishedwithlightingunitssospacedandequippedwithluminariesplacedatsuchmountingheightsaswillprovideilluminationforthesafemovementofpedestriansandvehicles.5.StreetConstructionandDesignStandards.a)Pavement.Allstreetsshallbeprovidedwithasmooth,hardanddensesurface(asphalticconcreteorportlandcementconcrete)whichshallbedurableandwelldrainedundernormaluseandweatherconditions.Pavementedgesshallbeprotectedtopreventravelingofthewearingsurfaceandshiftingofthepavementbase.Streetsurfacesshallbemaintainedfreeofcracks,holesandotherhazards.b)DesignStandards.DesignstandardsforallstreetsshallmeettherequirementsofChapter16.16.6.Walks.Allmobilehomeparksshallbeprovidedwithsafe,convenient,all—seasonpedestrianaccessesofadequatewidthforintendeduse,durableandconvenienttomaintain,betweenindividualmobilehomes,theparkstreetsandallcommunityfacilitiesprovidedforparkresidents.17.32.030MobileHomeStandsandSet—backs.Theareaofthemobilehomestandshallbeimprovedtoprovideanadequatefoundationfortheplacementandtie—downofthemobilehome,therebysecuringthesuperstructureagainstuplift,sliding,rotationandoverturning.1.Themobilehomestandshallnotheave,shiftorsettleunevenlyundertheweightofthemobilehomeduetofrostaction,inadequatedrainage,vibrationorotherforcesactingonthesuperstructure.2.Themobilehomestandshallbeprovidedwithanchorsandtie—downssuchascast—in—placeconcreteTideadmen”eyeletsimbeddedinconcretefoundationsorrunways,screwaugers,arrowheadanchorsorotherdevicessecuringthestabilityofthemobilehome.41 C017.32.030—17.32.0503.Anchorsandtie—downsshallbeplacedatleastateachcornerofthemobilehomestand,andeachshallbeabletosustainaminimumtensilestrengthof2,800pounds.4.Allmobilehomeparksormobilehomeslocatedintheareaofspecialfloodhazardshallmeettherequirementsofthefloodplainregulationsasdescribedelsewhereinthiscode.5.Allmobilehome/RVstandsshallbevisiblynumbered.17.32.060DimensionalRegulations.1.MaximumDensity.ThemaximumnumberofmobilehomelotsshallequalthenumberofdwellingunitsallowedundertherequirementsofSection17.20.020fortheRMDistrict,andthemaximumnumberof1Wsitesshallequal1.5timesthatnumber.Parkareashallbenotlessthantenacres,orsuchlargersizeasdictatedbythenumberofmobilehomelotsandRVsitesor,iflarger,theareanecessarytoaccommodateindividualsites,openspace,circulation,andotherneeds.2.MinimumSiteSize.Eachindividualmobilehomeshallhaveanassignedsiteofatleast4,500squarefeetandeach1Wsiteshallcontain1,350squarefeet,notincludingstreetareas,andeachshallhaveaminimumofa25footstreetfrontage.3.Setbacks.SetbacksattheboundariesoftheMobileilomeParkshallbe25feetminimum,andthesetbacksforan1WParkshallbe75feetminimumforRVsites,RVsstoredwithinthePark,andstoragestructures.Eachmobilehome/RVshallbesetbackfromeachinternalmobilehome/RVsitelineasfollows:a)Frontyardminimum10feet;b)Sideyardminimum5feet;c)Rearyardminimum20feet;17.32.050OtherDevelopmentRequirements.1.UtilityLines.Allutilitylinesshallbeunderground.UtilityeasementsshallbeprovidedforasrequiredbytheTown.2.Screening.Allmobilehome/RVparksshallbescreenedfromadjacentpropertywithtrees,shrubs,otherplantingarrangements,and/orwallsdesignedtoprovidenoiseandsightbuffers.Suchscreeningshallbeatleastsixfeetinheighth;providedsuchscreeningshallbelessthanthreeandone—halffeetinheightwhenlocatedwithin100feetofthecenterlineintersectionoftwostreetsorroads;andprovidedthattreesandshrubsusedmaybeofatypecapableofattainingtheminiumumheightrequirementwithinfiveyears.42 0017.36.020—17.36.020provisionsoftheUrbanRenewalPlan.The14dayperiodmaybeextendedforanadditional21daysattherequestoftheapplicantorofatleasthalfoftheownersoflandabuttingsideandrearpropertylinescombined.Iftheauthorityapprovestheapplication,thepropertyshallbedevelopedinaccordancewiththeapplicationsubjecttoanyapplicablerestrictions,zoningand/orregulationsoftheMunicipalCodeoftheTownofEstesPark.b)IftheauthoritydeterminesthatthedevelopmentisnotincompliancewiththeUrbanRenewalPlan,theauthorityshall,withinthreedays,informtheapplicantinwritingofthespecificsectionsoFtheUrbanRenewalPlanwithwhichthedevelopmentdoesnotcomply.TheapplicantmaythenamendtheapplicationorseekpermissionunderspecialreviewbytheBoardofTrustees,asprovidedatChapter17.36.030SpecialReviewProcedures.c)Iftheauthoritydoesnotapproveordisapprovetheapplicationwithintheperiodsetforthinparagraphaabove,includingextensions,theapplicationshallbedeemedapprovedassubmitted.7.BoardofTrusteesReview.InactingonapplicationsforspecialreviewunderthisChapter,theBoardofTrusteesshalldeterminewhetherornottheproposeddevelopmentconformstotheapplicableprovisionsoftheUrbanRenewalPlan.TheBoardmaydenytheapplication,approvetheapplication,orapprovetheapplicationwithconditionsitdeemsappropriatetohavethedevelopmentconformtotheapplicableprovisionsoftheUrbanRenewalPlan.Inacting,theBoardshallconsiderthedecisionoftheauthorityastowhytheproposeddevelopmentdoesnotconformtotheUrbanRenewalPlan.8.Amendment.Uponapprovalofanapplication,thepropertyshallbeimprovedordevelopedinaccordancewiththeapprovedplan.MinordeparturesfromtheconceptplanmaybemadeifauthorizedinwritingbytheExecutiveDirectoroftheauthority.Amongotherthings,anyincreaseinthenumberofdwellingsorguestunits,anychangeoflo%ormoreinfloorarea,buildingfootprint,numberofparkingspaces,setbackdimension,buildingheight,orbuildingseparation,andanychangeofsixfeetormoreinhorizontallocationofdrivesoraccesspointsshallnotbeconsideredminordepartures.Anyotherthanminordeparturesshallbeallowedonlybyamendmenttotheapplicationapprovedbytheauthority,andmustreceivethesamereviewasaninitialreviewunderthetermsandconditionsofthischapter,unlesstheauthority,withtheconcurrenceoftheTownAdministratorandTownPlanner,determinesthattheamendmentdoesnotentailsubstantialchangefromtheapprovedconceptplan,andthatproceduraldelaywouldjeopardizetheviabilityoftheproposal.9.ActualConstruction.Ifactualconstructiononanapprovedprojectisnotstartedwithinoneyearfromthedateoffinalapproval,whethersaidapprovalisbytheUrbanRenewalAuthorityortheBoardofTrusteesoftheTownofEstesPark,theapplicationshallbedeemedtobenullandvoidandanewapprovalisrequiredunderthetermsandconditionsofthischapter.50 C17.36.030—17.36.03017.36.030SpecialReviewProcedures1.ApprovalRequired.UsespermittedbyspecialreviewmaybeallowedinthedesignateddistrictsuponapprovalbytheBoardofTrusteesfollowingrecommendationfromtheTownPlanningCommissionandhearingbytheBoardofTrustees.2.Submittal.AllapplicationsforausepermittedbyspecialreviewshallbesubmittedinwritingtotheTownPlanneronanapplicationfurnishedbyhim.TheapplicationwillbereviewedbythePlanningCommissionatitsnextmeetingifsubmitted21ormoredayspriortothen,andifsubmittalsaredeterminedbytheTownPlannertobecompletepriortothatmeeting.3.ApplicationRequirements.Theapplicationshallbefiledinduplicate,andshallbesignedbythepropertyownersandlienholdersorbytheirdulyauthorizedrepresentatives.Amylarand21printsofaConceptPlanconformingtoSection17.36.040shallbefiledwiththeapplication.4.PlanningCommissionReview.ThePlanningCommissionshallreviewtheapplication,andshallreporttotheBoardofTrusteesregardingeachoftheconsiderationscitedinparagraph6below,athroughf,notlaterthan35daysfollowingthemeetingatwhichtheapplicationisfirstreviewed.5.BoardofTrusteesMeeting.BeforeactinguponanyapplicationunderSpecialReview,theBoardofTrusteesshallholdapublichearinguponit.Noticeofsuchhearingshallbepostedonthepropertytowhichtheapplicationpertains,publishedatleast15daysbeforethehearinginthemannerasisrequiredforamendmentstoordinances,andsentpostageprepaidtoallabuttorstothepremises.Thenoticeshalldescribetheproposeduse,thenameoftheapplicant,thedate,time,andplaceofthepublichearing,andtheplacewhereadditionalinformationmaybeobtained.6.BoardofTrusteesAction.TheBoardofTrusteesshalltakeactionontheapplicationfollowingitshearing,consideringthereportofthePlanningCommissionandthetestimonyreceivedatthehearing.TheBoardshallapprove,approvewithconditions,ordisapprovetheapplicationwithin60daysfollowingtransmittalofthePlanningCommissionsreport.ApplicationsshallbeapprovedonlyupontheBoardofTrusteeswrittendeterminationthattheproposaVsbenefitstotheTownwilloutweighanyadverseeffectsfortheTownorthevicinity,afterconsiderationofthefollowing,amongotherthings.a.Suitabilityoftheproposedlocationforthisproposal,takingintoconsiderationthefollowingwherevergermane:1)Nearbylanduses,andwhethertheywouldbesupportedbyordamagedbyhavingtheproposedusenearby;2)Usesofthesiteandnearbyareaswhichwouldbedisplacedbyorpreemptedbythisuse;51
