RESOLUTION 29-20
RESOLUTION29-20RATIFYINGAFIRSTAMENDMENTTOTHESERVICESCONTRACTBETWEENTHETOWN,THEESTESPARKECONOMICDEVELOPMENTCORPORATION,ANDTHEESTESCHAMBEROFCOMMERCEFORCOMMUNITYBUSINESSASSISTANCEWHEREAS,theTownpreviouslyawarded$150,000totheEstesParkEconomicDevelopmentCorporationandtheEstesChamberofCommercefordistributionoflocalbusinessassistanceinresponsetotheeconomicimpactsofCOVID-19;andWHEREAS,theTownBoardofTrusteeshasappropriatedandallocatedanother$150,000forthispurpose;andWHEREAS,theTownAdministratorhasexecutedEmergencyOrder07-20,authorizinganamendmenttotheservicescontractwiththeseorganizationstoincorporatetheseadditionalawardfunds;andWHEREAS,theTownAdministratorhasenteredtheTownintosuchaservicescontractamendment;andWHEREAS,undersection2.28.030(b)(16)oftheEstesParkMunicipalCode,thecontractamendmentissubjecttoratificationbytheBoardofTrustees.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:Thecontractamendmentreferencedinthetitleofthisresolutionisherebyratified.Section2:TheBoardfindsthattheuseofthefundsdisbursedunderthiscontractamendmentwillassistlocalbusinesses,includingbyhelpingretainemployees.TheBoardfindsthatthisisforthepublicpurposeofprotectingtheeconomicandsocialvitalityoftheTownby(1)supportingemploymentforresidentsoftheTown,allowingemployeestocontinuetolivelocally,andultimatelytocontinuetocontributetotheTown’staxbase;and(2)supportingbusinessesintheTownthathavebeendisadvantagedbytheCOVIDpandemic,andsupportinglocalbusinesses’abilitytostayinbusinessandcontributetothediversityofcommerceintheTownandtotheTown’staxbase.TheBoardfindsthatthecontractamendment’spublicpurposesarebothsignificantandsubstantial,andjustifytheexpenditureofthepublicfunds.TheBoardfindsthatthesupportofbusinessesbothinsideandintheimmediatevicinityoftheTowncontributestothepublicpurposesdescribedabove,thattheeconomyoftheentireEstesValleyisinextricablyinterconnected,andthatsupportingtheeconomyoftheEstesValleyisintegraltosupportingtheeconomicandsocialvitalityoftheTown.TheBoardalsofindsthattheTownwillreceiveadequateconsiderationforitsfinancialcontributionunderthecontractamendmentintheformofthesignificantandsubstantialpublicbenefitsdescribedabove.
