Bernerd Dannels,Margaret Also Present:Town Administrator Houston,Craig W.Meusel, Dale G.Hill James H.Swickard,Robert Absent:E.Wagner None Minutes of the regular meeting held March 25,1980 were read and approved as read. Municipal Judge James M.Littlejohn administered the oath of office to newly elected Mayor Harry B.Tregent and Trustees H. Bernerd Dannels,Margaret Houston,Craig W.Meusel,Robert E. Wagner. Trustee Margaret Houston moved the following bills be allowed and paid and the Clerk be authorized to draw warrants for the same.(A certified copy of the bills read and allowed are on file in the office of the Town Clerk under this date,and made a part of the record of these proceedings by reference thereto). Trustee Meusel seconded the motion and it passed by the following votes:Those voting “Yes”Trustees Robert E.Burgess,H.Beynerd Dannels,Margaret Houston,Craig W.Meusel,James H.Swickard, Robert E.Wagner.Those voting “No”none. Trustee James H.Swickard,Chairman of the Public Safety Committee, read the minutes of a meeting held March 27,1980 and moved the minutes be approved.Trustee Wagner seconded the motion and it passed unanimously. Trustee H.Bernerd Dannels introduced and the Town Administrator read in full the following entitled ordinance and Trustee Dannels moved it be passed on first reading: AN ORDINANCE AMENDING TITLE 7 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME PERTAINING TO ANIMAL CRUELTY,VACCINATION, CONFINEMENT AND DISPOSITION OF ANIMALS. Trustee Burgess seconded the motion.Mr.Jerry Swainston appeared requesting more animal control and patrol especially of the dogs in his neighborhood.He pointed out a possible conflict between Sections 7.06.040 and 7.12.100 Cd)of the proposed ordinance and also commented on the effectiveness of auditory control as addressed in the current animal control ordinance.The motion was then voted upon and passed by the following votes:Those voting “Yes” Trustees H.Bernerd Dannels,Margaret Houston,Craig W.Meusel, James H.Swickard,Robert E.Wagner,Robert E.Burgess.Those voting “No”none.The second and final reading of this ordinance will be on April 22,1980. Trustee Robert E.Burgess introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OP ESTES PARK,COLORADO: That the filing date of the application for a new Hotel and Restaurant License filed by Yoshihiki and Kiyoe Miyauchi dba Fuji—Sun of Tokyo in Estes Park located at 160 South Saint Vram Avenue,Estes Park,Colorado,is April 8,1980 and it is hereby ordered that a public hearing on said application shall be held in the Board Room of the Municipal Building,170 MacGregor Avenue, on May 13,1980 at 7:30 p.m.,and that the neighborhood boundaries for the purpose of said application and hearing shall be the area included within a radius of 2.95 miles as measured from the center of the applicant’s property. Trustee Swickard seconded the motion and it passed by the following votes:Those voting “Yes”Trustees Margaret Houston,Craig W. Meusel,James H.Swickard,Robert E.Wagner,Robert E.Burgess, H.Bernerd Dannels.Those voting “No”none. A request was received from Michael and Diane Rambeau dba Rocky Mountain Drive In Liquor to expand their premises at 338 West Riverside Drive by adding a 20’x 30’storage area.Trustee H. Bernerd Dannels moved the request be approved.Trustee Wagner seconded the motion and it passed by the following votes:Those voting “Yes”Trustees Craig W.Meusel,Robert E.Wagner,Robert E.Burgess,H.Bernerd Dannels,Margaret Houston.Those voting “No’none.Trustee Swickard abstained with permission from the Board due to a conflict of interest. Trustee Robert E.Burgess moved the following liquor license renewals be approved: Ben Medus dba Longhorn Liquor Mart Denver Pizza Inc.dba Pizza Hut Collins et al dba Gatsby’s of Estes Park Gazebo Inc.dba The Courtyard Tavern Trustee Houston seconded the motion and it passed unanimously. The Board of Trustees considered an application for a change of ownership of the Hotel and Restaurant liquor license of Lazy T Motor Lodge from Ehekircher to Mark and Kathleen Gregg.Trustee James H.Swickard moved the change of ownership be approved. Trustee Wagner seconded the motion and it passed unanimously. Trustee H.Bernerd Dannels introduced the following resolution and moved it be passed and adopted: Board of Trustees —April 8,1980 —Page Four (4) RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Clerk are hereby authorized and directed to sign the agreements by and between the Town of Estes Park and the following: Walter Alsbaugh Rodeo for performances to be held July 16th —19th,1980. Colorado Ponies of America for performances to be held June 14th and 15th,1980. Colorado State High School Rodeo Association for performances to be held June 19th —22nd,1980. Mountain and Plains Appaloosa Horse Club,Inc.for performances to be held July 25th —27th,1980. Rocky Mountain Paint Horse Association for performances to be held August 16th &17th,1980. Rocky Mountain Peruvian Paso Club for performances to be held August 23rd and 24th,1980. Colorado Arabian Horse Club for performances to be held June 29th —July 1st,July 3rd —5th,and August 30th &31st, 1980. Trustee Meusel seconded the motion and it passed by the following votes:Those voting “Yes”Trustees James H.Swickard,Robert E. The Board of Trustees reviewed an application submitted by the Salvation Army to use Elkhorn Avenue for a parade to be held on May 3,1980.Trustee Robert E.Wagner introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the application to close a state highway dated March 17, 1980 submitted by the Salvation Army for a parade to be held on May 3,1980 is hereby approved. Trustee Houston seconded the motion and it passed by the following votes:Those voting “Yes”Trustees Burgess,Dannels,Houston, Wagner,Meusel,and Swickard.Those voting “No”none. A letter of resignation dated April 3,1980 was received from former Town Attorney Colton W.Babcock,Jr. There being no further business,the meeting adjourned. layor Town Clerk
