Absent:None Meusel Minutes of the regular meeting held April 8,1980 were read and approved as read. Trustee Robert E.Wagner,Chairman of the Water Committee,read the minutes of a meeting held April 10,1980 and moved the minutes be approved.Trustee Dannels seconded the motion and it passed unanimously. Trustee H.Bernerd Dannels introduced and the Town Administrator read in full the following entitled ordinance and Trustee Dannels moved it be passed and adopted on first and final reading: AN ORDINANCE TO APPLY AND CONTRACT FOR BENEFICIAL USE OF WATER ON BEHALF OF THE TOWN OF ESTES PARK,COLORADO,A MUNICIPAL CORPORATION,AND PRESCRIBING THE TERMS FOR APPLICATION FOR AN ALLOTMENT OF WATER TO SAID TOWN OF ESTES PARK BY NORTHERN COLORADO WATER CONSERVANCY DISTRICT. Trustee Wagner seconded the motion and it passed by the following votes:Those voting “Yes”Trustees James H.Swickard,Margaret Houston,Craig W.Meusel,Robert E.Burgess,H.Bernerd Dannels, Robert E.Wagner.Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered #10—80 and published according to law. Trustee H.Bernerd Dannels,Chairman of the Public Works Com mittee,read the minutes of a meeting held April 16,1980 and moved the minutes be approved.Trustee Houston seconded the motion.A discussion concerning Bond Park regulations ensued and Melvin Brand and Trustee Swickard offered comments.Ted Hanes reported that the Fine Arts Guild netted $1,500 from last year’s craft fair and the new memberships obtained at the crafts fair.He also explained the importance of this event as a fund raiser for the Fine Arts Guild.The motion to approve the minutes was then voted on and passed unanimously. The Board reviewed a sumary of the bids received for street paving and gilsonite coating along with a memo dated April 22, 1980 from the Director of Public Works.Apparently,the low bid for the gilsonite coating was a conditional bid and does not meet federal specifications requested in the bid documents. The Board discussed accepting the next lowest bid for the gil— sonite coating because it meets the federal specifications where upon Trustee H.Bernerd Dannels introduced the following reso lution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: uztn itt (&stn zzr1c,Lorimer County,Co’orado .pri1....22 .19..aQ. Minutes of a meeting of the Board of Trustees of the Town of Estes Park,Lorimer County,Colorado.Meeting held in the Town Hall in sold Town of Estes Pork on the day of ,A.LX 19 at regular meeting hour. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: That the Mayor and Clerk are hereby authorized and directed to sign the contract by and between the Town of Estes Park and Coulson Excavating Company,Inc.for the 1980 Street Improvement Program for a total contract amount of $85,913.75;and to sign the contract by and between the Town of Estes Park and Best—Way Paving for Gilsonite Seal Coat for a total contract amount of $16,472.16. Trustee Wagner seconded the motion and it passed by the following votes:Those voting ‘Yes”Trustees Robert E.Burgess,H.Bernerd Dannels,Margaret Houston,James H.Swickard,Robert E.Wagner, Craig W.Meusel.Those voting “No”none. The minutes of the Estes Park Planning Commission meeting held April 15,1980 were read. At the request of the petitioner,the Board of Trustees tabled consideration of the Cyteworth Resubdivision. The proposed ordinance regarding animal cruelty,vaccination, confinement and disposition was resubmitted with the word “licensed”removed from Section 7.06.040 to avoid a possible conflict with Section 7.12.100 (d).Trustee Robert E.Wagner introduced and the Town Administrator read the following entitled ordinance and Trustee Wagner moved it be passed and adopted on second and final reading: AN ORDINANCE AMENDING TITLE 7 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME PERTAINING TO ANIMAL CRUELTY,VACCINATION,CON FINEMENT AND DISPOSITION OF ANIMALS. Trustee Houston seconded the motion and it passed by the following votes:Those voting “Yes”Trustees Craig W.Meusel,H.Bernerd Dannels,Margaret Houston,James H.Swickard,Robert E.Burgess, Robert E.Wagner.Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered #11—80 and published according to law. The Board of Trustees briefly reviewed “A Transit Development Program for the Town of Estes Park,Colorado”which is a planning document analyzing public transportation in Estes Park.Adoption of such a plan is required in order to obtain federal funding for public transportation.Public Works Director Widmer reported that if the Town would adopt the plan and select one of the alter natives proposed in the plan,the consultant would study the alternative in further detail without any cost to the Town. Should the Board not select an alternative,then the consultant’s participation would terminate at this point.Trustee Swickard moved the plan be adopted and Alternative #3 be selected.The motion was declared “dead”for lack of a second.Trustee Wagner then moved the matter be tabled to enable the Board to further Board of Trustees —April 22,1980 —Page 3 study the proposed alternatives.Trustee Houston seconded the motion and it passed unanimously. Kyle Twaddle of the Estes Park Jaycees requested that the Town contribute up to $500 for the 1980 fireworks display depending on the need.Mr.Twaddle reported that enough donations were received for last year’s firework,and,therefore,no funds were obtained from the Town.Member James H.Swickard moved that the Town contribute up to $500 for the 1980 fireworks. Trustee Burgess seconded the motion and it passed unanimously Mr.Twaddle also requested use of Bond Park on May 17,1980 for a food concession stand to be operated by the Jaycees. Mayor Harry B.Tregent referred this request to the Public Works Committee. Mary Pagel and Greg Carner appeared requesting permission to use the west side of MacGregor Avenue on May 17,1980 for a tricycle race to raise funds for the Red Zinger races.Trustee Robert E.Wagner moved permission be granted and that the organizers of the event work closely with Police Chief Ault in arranging the event.Trustee Houston seconded the motion and it passed unanimously. Mary Pagel also requested permission to use a small portion of the perimeter of Bond Park for the start and finish of the Walk—a—Thon to be held May 24,1980.Trustee H.Bernerd Dannels moved permission be granted.Trustee Swickard seconded the motion and it passed unanimously. Trustee Robert E.Wagner moved that the liquor license renewal for Surrey Restaurants,Inc.dba La Casa Del Estorito be approved. Trustee Dannels seconded the motion and it passed unanimously. Trustee Craig W.Meusel,Chairman of the Code and Sanitation Committee,reported that the week of May 12th through 18th has been set as the 1980 Clean Up Week and that May 19th through 25th has been set as the alternate week.
