Trustee Robert E.Wagner moved the following bills be allowed and paid and the Clerk be authorized to draw warrants for the same.(A certified copy of the bills read and allowed are on file in the office of the Town Clerk under this date and made a part of the record of these proceedings by reference thereto). Trustee Dannels seconded the motion.The motion passed by the following votes:Those voting “Yes”Trustees Robert E.Burgess, James H.Swickard,H.Bernerd Dannels,Jack T.Rumley,Margaret Houston,Robert E.Wagner.Those voting “No’none. Trustee Margaret Houston,Chairperson of the Advertising and Public Relations Committee,read the minutes of a meeting held May 3,1979 and moved the minutes be approved.Trustee Rumley seconded the motion and it passed unanimously. The Board of Trustees considered an application for a change in ownership of the Beer and Wine license for Parlour Restaurant and Deli from Peter and Opal Calabrese to Robertal.Willey. Trustee James H.Swickard moved the change of ownership be approved.Trustee Wagner seconded the motion and it unanimously carried. Trustee Robert E.Wagner introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Clerk are hereby authorized and directed to sign the agreement dated April 10,1979 by and between the Town of Estes Park,Colorado,and the Colorado Division of Parks and Outdoor Recreation regarding $15,000.00 federal funding for the West Riverside Park project. Trustee Houston seconded the motion.The motion passed by the following votes:Those voting “Yes”Trustees James H.Swickard, Margaret Houston,Robert E.Wagner,Jack T.Rumley,H.Bernerd Dannels,Robert E.Burgess.Those voting “No”none. A letter dated May 3,1979 was received from Melvin Brand of Faith Chapel requesting to use the meeting rooms of the Municipal Building for Sunday school and church services from May through August.Trustee James H.Swickard moved that Faith Chapel be allowed use of the meeting rooms on Sundays for a thirty day period and that it be responsible for monitoring those entering the building during the meeting times.Trustee Wagner seconded the motion and it passed unanimously. iii stn 4ark,Larimer County,Colorado .197P. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: A letter dated May 3,1979 was received from the Silver StateBaptistSchoolrequestingtouseBondParkforfootballpracticeAugust27ththrough29th.Trustee H.Bernerd Dannels moved therequestbedenied.Trustee Wagner seconded the motion and itpassedunanimously. Trustee Robert E.Wagner introduced and the Town AdministratorreadinfullthefollowingentitledordinanceandTrusteeWagnermoveditbepassedandadoptedonfirstandfinalreading: AN ORDINANCE AMENDING CHAPTER 12.08 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME RELATING TO OBSTRUCTION OF STREETS,ALLEYS ANDSIDEWALKS. Trustee Houston seconded the motion.The motion passed by thefollowingvotes:Those voting “Yes”Trustees Robert E.Wagner,Margaret Houston,Robert E.Burgess,Jack T.Rumley,H.BernerdDannels,James II.Swickard.Those voting ‘No”none.WhereuponMayorHarryB.Tregent declared said ordinance duly passed andadoptedandordereditnumbered#14—79 and published accordingtotaw. The Board of Trustees discussed at length the procedure and conductofthe“Mayfest”sidewalk sale scheduled for May 19th.TheBoardagreedthatallloadingzonesmustremainopenandthattheconductofthesaleshouldbemonitoredbytheTowntoensureadherencetoTownordinances.Trustee Robert E.Wagner introducedthefollowingresolutionandmoveditbepassedandadopted: RESOLUTION WHEREAS,The Board of Trustees has the power,pursuant to Section 12.08.040 of the Municipal Code of the Town of Estes Park, Colorado,to pennit the use of streets,alleys and sidewalks for the display and sell of merchandise and services,at such times and upon such conditions as the board may provide,and; WHEREAS,the Estes Park Area Chamber of Commerce and the Estes Park Merchant’s Association have organized an areawide celebration known as “Mayfest”for the period from May 19,1979, to May 25,1979,and: WHEREAS,as a part of said celebration the Board of Trustees has been requested to allow a “sidewalk sale”and the Board of Trustees is of the Opinion that such “sidewalk sale”will be a benefit to the entire community and will create no undue traffic nor pedestrian congestion because of the time of year scheduled for such “sidewalk sale”. øf (Estes jnrh Larirner County,Colorado .My.S .1 9Z79. Meeting coiled to order by Mayor Present;Mayor Trustees: Also Present: Absent: NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: 1.That both sides of Elkhorn Avenue,in the normal parking lanes,from Bond Park to Fall River,shall be closed to parking and the 10 feet of Street adjacent to the curb line shall be divided into 20 foot long segments which shall be used for sale and display of merchandise and services,and no other purpose,between the hours of 9 o’clock A.M.and 5 o’clock P.M. on May 19,1979.No space shall be so used where it reduces the available traffic lanes to two lanes in each direction along Elkhorn Avenue. 2.Said booths shall be available to any person,firm, or corporation,on the basis of one space for each person,firm, or corporation desiring the same,on a first,served basis.The Town Clerk shall make available,during normal business hours, beginning May 10,1979,and continuing through May 18,1979,a diagram of the available spaces.Spaces shall be reserved only by contacting the Town Clerk and signing up for the same period. 3.Actual sales of merchandise and services shall take place only between the hours of llo’clock A.M.and 5 o’clock P.M.on the designated date.The time from 9 o’clock A.M.to 11 o’clock A.M.and from 5 o’clock P.M.to 6 o’clock P.M.,shall be used for setting up and taking down of booths,merchandise, and display racks,etc. 4.Each person,firm,or corporation desiring a space shall execute a waiver and indemnification agreement waiving any and all claims for damage,injury or otherwise against the Town arising out of the use of the spaces designated,and agreeing to indemnify and hold the Town harmless from any and all claims brought against the Town on account of any acts or omissions of such person,firm or corporation arising out of the conduct of the “sidewalk sale”. Trustee Rumley seconded the motion.The motion passed by the follwoing votes:Those voting “Yes”Trustees Margaret Houston, H.Bernerd flannels,James H.Swickard,Robert E.Burgess,Jack T.Rumley,Robert E.Wagner.Those voting “No”none. Craig Meusel of the Horse Show and Rodeo Committee appeared re questing permission to erect a freestanding sign in Stanley Park along Highway 36 to advertise and announce the different horse shows.Trustee Robert E.Wagner moved permission be granted to QLinzzn zf sies jnrh,Lorimer County,Colorado Minutes of a meeting of the Board of Trustees of the Town of Estes Park,Larimer County,Colorado.Meeting held in the Town Hall in said Town of Estes Park on the day of A.D.19 at regular meeting hour.
