Trustee Robert E.Wagner moved the following bills be allowed andpaidandtheClerkbeauthorizedtodrawwarrantsforthesame. (A certified copy of the bills read and allowed are on file in theofficeoftheTownClerkunderthisdate,and made a part of therecordoftheseproceedingsbyreferencethereto.)Trustee Burgesssecondedthemotionanditpassedbythefollowingvotes:Thosevoting“Yes”Trustees H.Bernerd Dannels,Robert E.Wagner,James H.Swickard,Robert E.Burgess.Those voting “No”none. Trustee Robert E.Wagner,Chairman of the Estes Park Board ofAdjustment,read the minutes of a meeting held December 3,1979. Mel Brand of Faith Covenant Fellowship appeared requesting use of Rooms 203 and 100 of the Municipal Building for religious servicesonSundaysfrom9:00 A.M.to Noon and from 7:00 P.M.to 9:00 P.M.until they can obtain meeting facilities elsewhere.Trustee James H.Swickard moved permission be granted for Faith Covenant FellowshiptouseRooms100and203onSundaysfrom9:00 A.M.to Noonforaperiodofonemonth.Trustee Burgess seconded the motion and it passed by the following votes:Those voting “Yes”TrusteesJamesH.Swickard,Robert E.Burgess,Robert E.Wagner.Those voting“No”Trustee H.Bernerd Dannels. Rick Zuba appeared on behalf of the Estes Alpine Runners and theRecreationDistrictrequestinguseofMacGregorAvenueforafiveandtenkilometerraceonJanuary27,1980.He explained that theraceswouldbeconductedbetween11:00 A.M.and 1:30 P.M.and thatarrangementshavebeenmadewiththePoliceChiefregardingtraffic control.Trustee H.Bernerd Dannels moved permission be granted.Trustee Wagner seconded the motion and it passed unanimously. Mayor Harry B.Tregent conducted a public hearing on the adoption of the proposed 1979 Uniform Building Code.No persons appeared speaking in favor of or in opposition to the proposed 1979 UniformBuildingCode.Mayor Harry B.Tregent declared the hearing closed. Trustee Robert E.Wagner introduced and the Town Administrator readthefollowingentitledordinanceandTrusteeWagnermovedtheordinancebepassedandadoptedonsecondandfinalreading: AN ORDINANCE REGULATING THE ERECTION,CONSTRUCTION, ENLARGEMENT,ALTERATION,REPAIR,MOVING,REMOVAL, DEMOLITION,CONVERSION,OCCUPANCY,EQUIPMENT,USE,HEIGHT,AREA AND MAINTENANCE OF ALL BUILDINGS AND STRUCTURES WITHIN THE TOWN OF ESTES PARK,COLORADO; ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE ANDUNIFORMBUILDINGCODEAPPENDIX,1979 EDITION; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING PENALTIES FOR VIOLATION THEREOF;AMENDINGSECTIONS14.12.010,14.12.020,14.12.030,14.12.040 AND 14.20.080 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO;AND REPEALING CHAPTER 14.40 Board of Trustees —December 11,1979 —Page 2 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO. Trustee Dannels seconded the motion and it passed by the following votes:Those voting “Yes’Trustees Robert E.Burgess,H.Bernerd Dannels,Robert E.Wagner,James H.Swickard.Those voting “No” none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered #29—79 and published according to law. Mayor Harry B.Tregent conducted a public hearing on the adoption of the proposed 1979 Uniform Mechanical Code.No persons appeared speaking in favor of or in opposition to the proposed 1979 Uniform Mechanical Code.Mayor Harry B.Tregent declared the hearing closed. Trustee Robert E.Burgess introduced and the Town Administrator read the following entitled ordinance and Trustee Burgess moved the ordinance be passed and adopted on second and final reading: AN ORDINANCE TO PROVIDE COMPLETE REQUIREMENTS FOR THE INSTALLATION AND MAINTENANCE OF HEATING, VENTILATING,COOLING AND REFRIGERATION SYSTEMS WITHIN THE TOWN OF ESTES PARK,COLORADO;ADOPTING BY REFERENCE THE UNIFORM MECHANICAL CODE;1979 EDITION;REPEALING ALL ORDINANCES IN CONFLICT THEREWITH;AND AMENDING SECTION 14.16.010 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO. Trustee Swickard seconded the motion and it passed by the following votes:Those voting “Yes”Trustees James H.Swickard,Robert E. Burgess,H.Bernerd Dannels,Robert E.Wagner.Those voting “No” none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered #30—79 and published according to law. Mayor Harry B.Tregent conducted a public hearing on the adoption of the proposed 1979 ICBO Plumbing Code.No persons appeared speaking in favor of or in opposition to the proposed 1979 ICBO Plumbing Code.Mayor Harry B.Tregent declared the hearing closed. Trustee James H.Swickard introduced and the Town Administrator read the following entitled ordinance and Trustee Swickard moved it be passed and adopted on second and final reading: AN ORDINANCE REGULATING THE INSTALLATION, ALTERATION AND REPAIR OF PLUMBING WITHIN THE TOWN OF ESTES PARK,COLORADO;ADOPTING BY REFERENCE THE ICBO PLUMBING CODE AND ICBO PLUMBING CODE APPENDIX,1979 EDITION;REPEALING ALL ORDINANCES IN CONFLICT THEREWITH;PROVIDING PENALTIES FOR VIOLATION THEREOF;AND AMENDING SECTIONS 14.24.010 AND14.24.O15 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO. Trustee Wagner seconded the motion and it passed by the following votes:Those voting “Yes”Trustees Robert E.Wagner,Robert E. Burgess,James H.Swickard,H.Bernerd Dannels.Those voting “No” none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered #31—79 and published according to law. Bill Van Horn,representing owners Mr.and Mrs.Frederick Brink, presented the amended plat of Lots 2 and 3,James—McIntyre Sub division which proposes changing the boundaries of those lots without creating additional lots.He explained that the boundary lines are being ajdusted as proposed to better correspond with existing improvements.Trustee James H.Swickard introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Board of Trustees —December 11,1979 —Page 3 That the petition and plat of the “Amended Plat of Lots 2 and 3,James—McIntyre Subdivision”are hereby approved and that the Mayor and Town Clerk are authorized and directed to sign the plat. Trustee Burgess seconded the motion and it passed by the following votes:Those voting “Yes”Trustees James H.Swickard,H.Bernerd Dannels,Robert E.Wagner,Robert E.Burgess.Those voting “No”none. Bill Van Horn appeared on behalf of the Connellys requesting the annexation of the Connelly Addition be tabled.Trustee Robert E. Burgess moved the annexation of the Connelly Addition be tabled. Trustee Wagner seconded the motion and it passed unanimously. Paul Kochevar of Estes Park Surveyors presented the annexation map of the Earlee Addition whereupon Robert E.Burgess introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: The Board of Trustees of the Town of Estes Park,Colorado,finds that the petition for annexation filed by petitioners on the 5th day of December,1979,with the Town Clerk of the Town of Estes Park, Colorado,for the annexation of certain land described in said peti tion,is eligible to be annexed because there is at least one—sixth (1/6)contiquity between the municipality and the area seeking annexa tion and at least two (2)of the following conditions have been met: (a).More than fifty percent (50%)of the adult residents of the area proposed to be annexed use some of the recreation,civic, social,religious,industrial or commercial facilities of the muni cipality and more than twenty—five (25%)percent of its adult resi dents are employed in the annexing municipality; (b).Less than one—half (1/2)of the land proposed to be annexed is agricultural,or,if it is agricultural,less than one— half (1/2)of the landowners of the total area have expressed an intention under oath to devote the land to such agricultural use for at least five (5)years; (c).It is practical to extend urban services which the muni cipality normally provides. The Town Board further determines the applicable parts of Sections 31—12—104 and 31—12—105,C.R.S.1973,as amended,have been met,and further determines that an election is not required under Section 31—12—112,C.R.S.1973,as amended,and there are no other terms or conditions to be imposed upon said annexation except that a petition for annexation of the property included within the addition be filed with the Municipal Subdistrict of the Northern Colorado Water Conservancy District before final annexation of the addition; The Board of Trustees hereby finds and determines that no known commercial mineral deposits are contained within the territory to be annexed;and Having found that “EARLEE ADDITION”is eligible to become annexed, the Board of Trustees of the Town of Estes Park,Colorado,will under take further annexation proceedings. Trustee Dannels seconded the motion and it passed by the following votes:Those voting “Yes”Trustees H.Bernerd Dannels,Robert E.
