Minutes of the regular meeting held December 14,1976 were read
and approved as read.
Mrs.Carolyn Gavell,Mr.and Mrs.Al Sager,and Mr.and Mrs.Phil
Goettsch presented a beautiful painting of the Town on behalf of
the Indian children of the Loneman Day School in South Dakota.
Trustee H.Bernerd Dannels moved the following bills be allowed
and paid and the Clerk be authorized to draw warrants for same.
(A certified copy of the bills read and allowed are on file in
the office of the Town Clerk under this date and made a part of
the record of these proceedings by reference thereto.)Trustee
Wagner seconded the motion.Upon roll call the motion passed by
the following votes:Those voting ‘Yes”Trustees Margaret Houston,
Rollen Sutter,H.Bernerd Dannels,N.T.Petrocine,Robert E.Wagner.
Those voting “No”none.
Trustee H.Bernerd Dannels,Chairman of the Public Works Committee,
read the minutes of a meeting held December 16,1976 and moved the
minutes be approved.Trustee Sutter seconded the motion and upon
roll call the motion unanimously carried.
A request for two 12’curb cuts onto Woodstock Drive from Lot 8,
DeVille Subdivision was submitted by Richard Statham.Trustee
Robert E.Wagner moved the two curb cuts be approved.Trustee
Dannels seconded the motion.Upon roll call the motion unanimously
carried.
Trustee N.T.Petrocine,Chairman of the Estes Park Planning Com
mission,read the minutes of a meeting held December 21,1976.
Mayor Harry B.Tregent proceeded to conduct a public hearing on
the proposed zoning and annexation of the Kidwell Addition.Paul
Van Horn appeared speaking in favor of the zoning and annexation.
There were no persons present speaking in opposition and no cor
respondence was received.Mayor Harry B.Tregent declared the
hearing closed.
Trustee Robert E.Wagner introduced the following resolution and
moved it be passed and adopted:

tion is eligible to become annexed,the Board of Trustees of the
Town of Estes Park,Colorado will undertake further annexation
proceedings.

CERTAIN TERRITORY TO THE TOWN OF ESTES
PARK,COLORADO,TO BE KNOWN AND DESIGNATED
AS “KIDWELL ADDITION”TO T}IE TOWN OF ESTES
PARK,COLORADO.
Trustee Wagner seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees H,

AN ORDINANCE AMENDING SECTION 17.16.010 OF
THE MUNICIPAL CODE OF THE TOWN OF ESTES
PARK,COLORADO,RELATING TO THE ZONING OF
KIDWELL ADDITION.
Trustee Sutter seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees H.
Bernerd Dannels,Margaret Houston,Robert E.Wagner,Rollen Sutter,
N.T.Petrocine.Those voting “No”none.
Mayor Harry B.Tregent conducted a public hearing on the proposed
amendment to Section 17.36.020 of the Municipal Code which would
allow outdoor and indoor amusements under special review procedure
in a C—2 Restricted Commercial zoning district.There were no
persons present speaking in favor of or in opposition to the pro
posed amendment and no correspondence was received regarding the
same.Mayor Harry B.Tregent declared the hearing closed.

Trustee N.T.Petrocine introduced and the Clerk read in full the
following entitled ordinance and Trustee Petrocine moved it be
passed and adopted on first and final reading:
AN ORDINANCE AMENDING SECTION 17.36.020 OF TIlE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,RELATING TO USES PERMITTED BY SPECIAL
REVIEW IN RESTRICTED COMMERCIAL ZONING.
Trustee Dannels seconded the motion.Upon roll call the motion
passed by the following votes:Those voting ‘Yes”Trustees N.T.
Petrocine,Rollen Sutter,Robert E.Wagner,Margaret Houston,H.
Bernerd Dannels.Those voting “No”none.Whereupon Mayor Harry
B.Tregent declared said ordinance duly passed and adopted and
ordered it numbered 2—77 and published according to law.
Mayor Harry B.Tregent conducted a public hearing on the proposed
rezoning of Lot 2,DeVille Subdivision from C—2 to C—i.A letter
dated January 3,1977 from Ray Mac Neil,Attorney representing
the petitioners of the rezoning request,was read requesting the
withdrawal of the rezoning petition.Mayor Harry B.Tregent
declared the hearing closed and the rezoning request withdrawn.
Special Review Request No.9 was submitted by Jeannette 1]enny
and Merl Morehead to allow a residence in lower level #3 of
Morehead’s Shopping Center which is zoned C—i Commercial.Trustee
Robert E.Wagner moved that Special Review Request No.9 be approved.
Trustee Houston seconded the motion and upon roll call the motion
unanimously carried.
Special Review Request No.iO to allow two self storage warehouses
on the westerly portion of Lot 13,DeVille Subdivision was sub
mitted by John Ericson.Trustee Robert E.Wagner moved that Special
Review Request No.10 be approved.Trustee Dannels seconded the
motion and upon roll call the motion unanimously carried.
Paul Van horn appeared on behalf of Leonora Hartmann requesting
the division of the southwesterly portion of Lot 13,Mocassin
Addition.Trustee Robert E.Wagner moved the lot split be granted.
Trustee Sutter seconded the motion.Upon roll call the motion
unanimously carried.
Trustee H.Bernerd Dannels moved that a public hearing on the
Stanley hills P.U.D.formal application be set for the February
8,1977 Board of Trustees meeting.Trustee Wagner seconded the
motion and upon roll call the motion unanimously carried.
A letter was received from Gene E.Fischer,Attorney,requesting
the Town’s opinion concerning the advisability of the extension
of Black Canyon Drive as it pertains to the general street plan

senting the Black Canyon Hills investors and Mr.Madsen repre
senting the Stanley Heights property owners commented briefly
on the road controversy.Trustee Robert E.Wagner moved that
Mr.Fischer’s letter be acknowledged and that it be stated that
the Town does not wish to express an opinion at this time.
Trustee Dannels seconded the motion and upon roll call the motion
unanimously carried.
Trustee Rollen Sutter,Chairman of the Board of Adjustment,read
the minutes of a meeting held December 28,1976.
Trustee N.T.Petrocine,Chairman of the Light &Power Committee,
read the minutes of a special meeting held January 4,1977 and
moved the minutes be approved.Trustee Wagner seconded the
motion and upon roll call the motion unanimously carried.
The minutes of a special meeting of the Board of Trustees held
January 4,1977 were read and approved as read.
Trustee Petrocine also read the minutes of two special Light and
Power Committee meetings held January 6,1977 and January 11,
1977 and moved the minutes of both meetings be approved.Trus
tee Wagner seconded the motion and upon roll call the motion unani
mously carried.
Bids for the $550,000 Light &Power Revenue bonds were submitted
by Boettcher &Company and Bosworth Sullivan &Company,Inc.as
follows:

the following bids for the Marys Lake Substation transformer and
switchgear as recommended by the Light &Power Committee on
January 11,1977:
Transformer:RTE @ $109,000 (includes $1,000 to establish
firm price)
Switchgear:System Control @ $63,989 (McGraw—Edison
equipment)
Trustee Houston seconded the motion and upon roll call the motion
unanimously carried.
Mayor harry B.Tregent received and gratefully accepted on behalf
of the Town a letter and $100 donation from Alvin J.Kruchten for
assistance received from the citizens of Estes Park during the
July 31,1976 flood.
Trustee H.Bernerd Dannels moved the following elected Fire Depart
ment officers be approved:
Fire Chief Bob Cheney
Assistant Fire Chief Jack Rumley
Secretary/Treasurer Bob Dike
Trustee Sutter seconded the motion and upon roll call the motion
unanimously carried.
Gordon Rudel submitted a curb cut application for a 30’curb cut
onto Graves Avenue from Lot 11,Deville Subdivision.The curb
cut would be located 30 feet from the west property line.Trustee
Rollen Sutter moved the curb cut be granted.Trustee Wagner
seconded the motion.Upon roll call the motion unanimously carried.
There being no further business,the meeting adjourned.
