Trustee Robert E.Wagner moved the following bills be allowed and paid and the Clerk be authorized to draw warrants for the same. Trustee Rollen Sutter,Chairman of the Water Committee,read theminutesofameetingheldMay16,1977 and moved the minutes beapproved.Trustee Dannels seconded the motion and upon roll call the motion unanimously carried. Trustee H.Bernerd Dannels introduced and the Clerk read in fullthefollowingentitledordinance,and Trustee Dannels moved that in section 7 amending 13.20.080 the interest charge for delinquent water and connection charges be changed to 2/3 of one percent per month,also that an emergency exists and,therefore,the ordinancebepassedandadoptedonfirstandfinalreading: AN ORDINANCE AMENDING CHAPTERS 13.24,13.28, AND 13.32 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING TO METERED WATER SERVICE. Trustee Robert E.Wagner introduced and the Clerk read the fol lowing entitled ordinance and Trustee Wagner moved the ordinance be passed and adopted on second and final reading: AN ORDINANCE AMENDING SECTION 2.48.090 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,RELATING TO PAYMENT FROM THE GENERAL FUND OF THE TOWN INTO THE POLICEMEN’S PENSION FUND. Trustee Dannels seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Minutes of a meeting of the Board of Trustees of the Town of Esles Pork,Larimer County,Colorado Meeting held in the Town Hall in said Town of Estes Park on the day of A.0.19....at regular meeting hour. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: Mayor Harry B.Tregent proceeded to conduct a public hearing re garding the application for a 3.2%Beer License submitted by Denver Pizza,Inc.dba Pizza Hut to be located at 430 Prospect Village Drive,Estes Park,Colorado.Mr.John Baird,District Manager of real estate for Denver Pizza,Inc.,appeared speaking in favor of the liquor license.There were no persons present speaking in opposition and no correspondence was received re garding the liquor license.Mayor Harry B.Tregent declared the hearing closed. Trustee Rollen Sutter moved the Board of Trustees finds that the reasonable requirements of the neighborhood are such that a 3.2% fleer License should be granted and that the license is granted. Trustee Dannels seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Bernerd Dannels,N.T.Petrocine,Margaret Houston,Rollen Sutter, Robert E.Wagner.Those voting “No”none. Gene Dykes,member of the Estes Park Jaycees,appeared before the Board requesting Town support of the July 4th fireworks which are sponsored by the Estes Park Jaycees.He stated that last year’s contributions did not cover the $2,500 fireworks expenses and $400 mailing costs of donation requests.This year’s costs will be approximately $1,800 for fireworks and $400 for mailing of con tribution requests.Mr.Dykes requested that the Town provide a financial guarantee should the contributions received not cover the entire cost of the July 4,1977 fireworks.Trustee N.T. Petrocine moved the Town support the July 4,1977 fireworks and provide funding if needed in an amount not to exceed $500.Trustee Houston seconded the motion.Upon roll call the motion unanimously carried. The Board of Appeals considered a variance request submitted by Michael McEneny regarding railing height.Mr.McEneny requested permission to construct a 14”railing on his residence on Lot 9, Black Canyon Hills,which would serve only as a design feature and would have no access.Trustee H.Bernerd Dannels moved the variance be granted.Trustee Wagner seconded the motion and upon roll call the motion unanimously carried. The Town Clerk presented an application for a change in ownership and classification of the Hotel/Restaurant Liquor License owned by Gypsy Baron Inc.dba The Elkhorn Lodge to a Tavern License to be owned by Elkhorn Lodge,Inc.dba The Elkhorn Lodge.Trustee Robert E.Wagner moved the change of ownership and classification be granted.Trustee Sutter seconded the motion.Upon roll call the motion unanimously carried. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: of the Black Canyon Drive and Steamer Drive intersection.Trustee H.Bernerd Dannels moved the curb cut be granted.Trustee Wagner seconded the motion and upon roll call the motion unanimously carried. No bids were received for the installation of curb,gutter,and sidewalk at the intersection of Moraine Avenue and Crags Drive which is a flood damage project to be funded by the Federal Disaster Administration.With permission from the Federal Disaster Administrator,the Town Administrator will be authorized to nego tiate a contract for the project. Nancy Neuswanger,Attorney,submitted an application on behalf of Verl and Vivian Baker to divide Tract 20,Fall River Addition into parcels “A”and “B +C”according to the submitted plat. Tract “A”would consist of approximately 1/2 acre and Tract “B +C” one acre.Ms.Neuswanger stated that the exception to the Sub division regulations was being sought for economic reasons. Trustee Robert E.Wagner moved the exception be granted subject to (1)the applicants submitting to the Town a revised plat showing only the two resulting lots and (2)a 10’utility easement being provided adjacent to and parallel to the north boundary lines. Trustee Sutter seconded the motion and upon roll call the motion unanimously carried. A petition was submitted by numerous residents living on Willow Lane in Country Club Estates requesting their street name to remain Willow Lane and that the Willow Lane in Carriage Hills be changed to Willow Drive or Willow Court.Trustee Robert E. Wagner moved Willow Drive in Country Club Estatesbe changed to Willow Lane and that Larimer County be notified of the change.Trustee Rollen Sutter seconded the motion and upon roll call the motion unanimously carried. Mr.Rollen Sutter requested permission to install a diesel fuel pump at the Conoco Station located on Lot 44,Little Prospect Mountain Addition.Trustee H.Bernerd Dannels moved a permit be issued subject to the following conditions as outlined in the Building Inspector’s letter of May 13,1977: (1)The pump be approved by Underwriter’s Laboratory or comparable testing laboratory; (2)Concrete or steel 30”high barriers be placed so as to protect the unit;and (3)Installation meets all of the requirements of the Oil Inspection Section of the Division of Labor of the State of Colorado before the unit is placed in operation.
