Meeting coiled to order by Moyer rqgt3t Present:Mayor Harry B.Tregent Trustees:Robert E.Burgess,Rollen Sutter,H.Bernerd Dannels, Margaret Houston,Robert E.Wagner,N.T.Petrocine Also Present:Dale 6.Hill Town Administrator and Clerk John 6.Phipps,Town Attorney Absent,None Minutes of the regular meeting held May 25,1976 were read and approved as read. Trustee Robert E.Wagner moved the following bills be allowed and paid and the Clerk be authorized to draw warrants for same. (A Certified copy of the bills read and allowed are on file in the office of the Town Clerk under this date and made a part of the record of these proceedings by reference thereto.)Trustee Dannels seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees Robert E. Burgess,H.Bernerd Dannels,Margaret Houston,Robert E.Wagner, Rollen Sutter,N.T.Petrocine.Those voting “No”none. Mayor Harry B.Tregent proceeded to conduct a Public Hearing regarding the application for a Beer,Wine and Liquor License (Hotel,Restaurant)submitted by Dudley L.Koch dba The Fall River Chuck Wagon at 1000 Fall River Road,Estes Park,Colorado. Attorney Joseph P.Jenkins appeared representing the applicant. Dudley L.Koch,Mrs.Doyle Reeder,and Doyle Reeder spoke in favor of the proposed license.There were no persons present speaking in opposition and there was no correspondence received either in favor of or in opposition to the granting of the license.Mayor Harry B.Tregent declared the hearing closed. Trustee Rollen Sutter moved the Board of Trustees finds that the reasonable requirements of the neighborhood are such that a Beer, Wine and Liquor License should be granted and that the license is granted.Trustee Wagner seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes” Trustees Robert E.Burgess,H.Bernerd Dannels,Margaret Houston, N.T.Petrocine,Rollen Sutter,Robert E.Wagner.Those voting “No”none. Trustee N.T.Petrocine,Chairman of the Light &Power Committee, read the minutes of a meeting held June 3,1976 and moved the minutes be approved.Trustee Burgess seconded the motion.Upon roll call the motion unanimously carried. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: 3.Umbrella Coverage —$3,000,000 not quoted,due to lack of quote time,as needs to be submitted to Home Office for approval,and quote.Could be added later subject to Home Office approval. 4.False Arrest (Optional Quote)—Not quoted at this time as recommend town keep current coverage with American Home Assurance Co.until expiration 12/1/76 and then USF&G would help place. (Cost would be doubled if rewritten now). Home In order to quote the umbrella,*ncreases from the bid figures Indemnity have been made on the primary coverages as follows:Comprehensive Company General Liability Limits to $500,000.Bodily Injury.Motor Vehicle Liability Bodily Injury —$250,000 each person,$500,000 each occurrence. **Umbrella Quote Excludes Electrical Utility and Water Utility *Town does have $500,000 BI Primary. Mayor Harry B.Tregent directed the Town Attorney to renew the bids and make a recommendation to the Board of Trustees as to which bid the Town should accept.The Board of Trustees will make the official award at the June 21st meeting. Trustee H.Bernerd Dannels introduced the following resolution and moved it be passed and adopted: RESOLUTION BE IT RESOLVED BY TIlE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: That the Mayor and Clerk are authorized and hereby directed to sign an easement grant to the Upper Thompson Sanitation District for a pipeline right—of—way across an easterly portion of Tallant Park;provided,however,that two commercial taps be allowed the Town at no charge in exchange for the grant of easement. Meeting coiled to order by Moyor Present:Mayor Trustees: Also Present: Absent: A verbal request was received from Mrs.Hatlestad asking the Board to consider controlling flight patterns of helicopters,particularly those landing at the hospital which is near her residence.Town Attorney Phipps advised the Board that this matter comes under the jurisdiction of the Federal Aviation Administration.The Board of Trustees expressed the opinion that the helicopters,which are used for medical emergencies,are very necessary for the public health. Trustee Robert E.Burgess introduced and the Clerk read in full the following entitled ordinance,and Trustee Burgess moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE MAKING THE USE OF SKATEBOARDS UPON PUBLIC SIDEWALKS OR STREETS WITHIN ThE TOWN OF ESTES PARK,COLORADO,UNLAWFUL AND DECLARING AN EMERGENCY. Trustee Houston seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees N.T. Petrocine,H.Bernerd Dannels,Robert E.Burgess,Robert E.Wagner, Rollen Sutter,Margaret Houston.Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered 17—76 and published according to law. Trustee H.Bernerd Dannels introduced and the Clerk read in full the following entitled ordinance,and Trustee Dannels moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTIONS 13.32.100 AND 13.32.120 OF THE MUNICIPAL CODE OF THE TOWN OF ESThS PARK,COLORADO, RELATING TO WATER RATES AND CHARGES FOR TIE SUPPLYING OF WATER BY THE WATER DEPARTMENT OF THE TOWN OF ESTES PARK,COLORADO,TO CERTAIN RESIDENTIAL CONSUMERS AND DECLARING AN EMERGENCY. Trustee Sutter seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Bernerd Dannels,Robert E.Burgess,Margaret Houston,Robert E. Trustee N.T.Petrocine introduced and the Clerk read in full the following entitled ordinance,and Trustee Petrocine moved the ordinance be passed and adopted on first and final reading: AN ORDINANCE AMENDING SECTION 16.40.010 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,RELATING TO PETITIONS FOR EXCEPTIONS TO CERTAIN SUBDIVISION REGULATIONS. Trustee Wagner seconded the motion.Upon roll call the motion passed by the following votes:Those voting “Yes”Trustees H. Bernerd Dannels,Robert E.Burgess,Margaret Houston,Robert E. Wagner,Rollen Sutter,N.T.Petrocine.Those voting “No”none. Whereupon Mayor Harry B.Tregent declared said ordinance duly passed and adopted and ordered it numbered 21—76 and published according to law. Steve Komito requested to appear before the Board of Trustees to discuss the carillon located at 237 West Elkhorn Avenue.Mr. Komito did not appear at the meeting and,therefore,the matter was not discussed. Meeting called to order by Mayor Present:Mayor Trustees: Also Present: Absent: The Estes Park Women’s Club requested to use Bond Park on July 23, 1976 for the annual Library benefit bake sale.Trustee Robert E. Wagner moved the request be granted.Trustee Burgess seconded the motion.Upon roll call the motion unanimously carried. A rezoning request was submitted to the Town of Estes Park for consideration and recommendation by the Larimer County Planning Department.The rezoning petition,submitted by Otis and Opal Whiteside,requests that 1i/4 acres located at 621 Big Thompson Avenue be rezoned from E—Estate to Commercial.Trustee Robert E. Wagner moved that a recommendation for denial be submitted to the Larimer County Planning Commission because of the Town’s desire to annex the property.Trustee Dannels seconded the motion. Upon roll call the motion unanimously carried. Corky Rogers appeared requesting the Chamber of Commerce be allowed to modify the basement of the Visitor Center in order to use it for showing films this summer and eventually also for a meeting room.This would be financed entirely by the Chamber of Commerce.Trustee N.T.Petrocine moved the request be granted. Trustee Sutter seconded the motion.Upon roll call the motion unanimously carried. The Town Clerkread aloud a letter received from Frank Christensen, Coordinator of Community Human Resource Center,requesting to use the old Public Works Garage for a youth center.Trustee Dannels explained that the Public Works garage is part of the Tallant Park Project which is federally funded and,therefore,the original plans and schedules must be adhered to. There being no further business,it was regularly moved,seconded, and carried the meeting adjourn.- aTownAdministrator and Clerk
