Absent:Trustee Rollen Sutter
Minutes of the regular meeting held January 13,1976 were read and
approved as read.
Trustee N.T.Petrocine,Chairman of the Light and Power Committee,
read the minutes of a meeting held January 14,1976 and moved the
minutes be approved.Trustee Wagner seconded the motion.Upon roll
call the motion unanimously carried.
Robert L.Dekker,Director of Light and Power,reported on changes
in the P.R.P.A.Board of Directors,current status of local trans
mission line construction,and possible alternatives for obtaining
additional power for 1983.He also distributed copies of the P.R.P.A.
financial statement,bond sale schedule,and electric sales statistics.
Trustee H.Bernerd flannels,Chairman of the Public Works Committee,
read the minutes of a meeting held January 15,1976 and moved the
minutes be approved.Trustee Prosser seconded the motion.Upon roll
call the motion unanimously carried.
As per the Public Works Committee minutes,Lou Canaiy requested a
curb cut to be located approximately 150’west of the present Lake
Estes Motor Inn entrance.A letter dated January 22,1976 was re
ceived from Mr.Canaiy requesting that final consideration of his
curb cut request be postponed until March 9th.Trustee H.Bernerd
flannels moved that consideration not be postponed and that the request
for a curb cut be denied.Trustee Prosser seconded the motion.Upon
roll call the motion unanimously carried.
Trustee Robert E.Burgess,Chairman of the Public Safety Committee,
read the minutes of a meeting held January 22,1976 and moved the
minutes be approved.Trustee Petrocine seconded the motion.Upon
roll call the motion unanimously carried.
Trustee Glenn Prosser,Chairman of the Planning Commission,read the
minutes of a meeting held January 20,1976.
Mayor Harry B.Tregent proceeded to conduct a public hearing on the
proposed amendment to section 17.56 of the Municipal Code of the
Town of Estes Park which would require an attorney’s letter of certi
fication on all special review applications.There were no persons
present speaking in favor of or in opposition to the proposed amend
ment.Mayor Harry B.Tregent declared the hearing closed.
Trustee Robert E.Wagner introduced and the Town Clerk read in full
the following entitled ordinance,and Trustee Wagner moved the ordi
nance be passed and adopted on first and final reading:

AN ORDINANCE AMENDING CHAPTER 17.56 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,RELATING TO PROCEDURES FOR SPECIAL
REVIEW APPLICATIONS.
Trustee Prosser seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees Robert E.
Burgess,H.Bernerd Dannels,Glenn Prosser,N.T.Petrocine,Robert
E.Wagner.Those voting “No”none.Whereupon Mayor Harry B.Tregent
declared said ordinance duly passed and adopted and ordered it num
bered 1 —76 and published according to law.
Mayor Harry B.Tregent proceeded to conduct a public hearing on the
proposed amendment to chapters 17.16,17.20,17.24,17.28,17.32,
17.36,17.40,17.44 and 17.48 of the Municipal Code which would allow
nursing homes,carillons and electronic instruments imitating car—
illons by special review in all zoning districts except DR—Developing
Resource District.There were no persons present speaking in favor of
or in opposition to the proposed amendment.Mayor Harry B.Tregent
declared the hearing closed.
Trustee H.Bernerd Dannels introduced and the Town Clerk read in full
the following entitled ordinance,and Trustee Dannels moved the ordi
nance be passed and adopted on first and final reading:
AN ORDINANCE AMENDING CHAPTERS 17.16,17.20,
17.24,17.28,17.32,17.36,17.40,17.44 AND
17.48 OF THE MUNICIPAL CODE OF THE TOWN OF
ESTES PARK,COLORADO,RELATING TO THE PERMIS
SION OF NURSING HOMES,CARILLONS AND ELECTRONIC
INSTRUMENTS IMITATING A CARILLON,BY SPECIAL
REVIEW IN ALL ZONING DISTRICTS EXCEPT DR DEVEL
OPING RESOURCE DISTRICT.
Trustee Wagner seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees Robert
E.Burgess,H.Bernerd Dannels,Glenn Prosser,N.T.Petrocine,
Robert E.Wagner.Those voting ‘No”none.Whereupon Mayor Harry
B.Tregent declared said ordinance duly passed and adopted and
ordered it numbered 2—76 and published according to law.
Neil Rosener appeared on behalf of Mrs.Willene Gardner requesting
a division of Lot 5,Grand Estates,into two approximately l acre
lots.Town Administrator Hill read into the record the petition
and the following letters:

Trustee H.Bernerd Dannels moved the request for a lot split be
denied.Trustee Prosser seconded the motion.Upon roll call the
motion unanimously carried.
Several petitions containing numerous signatures were submitted
protesting the location of the public rest room in the American
Legion Parking Lot and recommending that it be moved to the south
west corner of the parking lot.The following persons spoke in
opposition to the present location:

A letter dated January 22,1976 was received from Robert Dillon
also opposing the location of the facility.Ken Zigler stated
that any location within the parking lot would be readily accessible
to people walking.Trustee Dannels explained that the planning for
the rest room was initiated over a year ago and the present location
was selected because of its accessibility,visibility in regards to
easy identification and discovery and consequent reduction in van
dalism,and economy.Trustee Dannels moved the location of the
public rest room remain as is in the American Legion Parking Lot.
Trustee Burgess seconded the motion.Upon roll call the motion
passed by the following votes:Those voting “Yes”Trustees H.
Bernerd Dannels,Robert E.Burgess,N.T.Petrocine,Glenn Prosser.
Those voting “No”Trustee Robert E.Wagner.
Dorothea E.Mutchier dba Rock Acres Dining Room submitted an appli
cation for permission to expand the premises licensed.Trustee
Robert E.Burgess moved the application be approved.Trustee H.
Bernerd Dannels seconded the motion.Upon roll call the motion
unanimously carried.
Trustee Robert E.Wagner introduced and the Town Clerk read in full
the following entitled ordinance,and Trustee Wagner moved the ordi
nance be passed and adopted on first and final reading:

WALKS AND CURBS.

Trustee N.T.Petrocine moved that the application for a renewal
of a 3.2%beer license submitted by Louis C.Pettyjohn dba Estes
Park Golf Course be approved.Trustee Wagner seconded the motion.
Upon roll call the motion unanimously carried.
Trustee Glenn Prosser introduced the following resolution and moved
it be passed and adopted:

The Board of Trustees of the Town of Estes Park,
Colorado,in accordance with section 31—12—106(2),C.R.S.1973,
as amended,hereby states its intention to annex the following
described area which is an unincorporated area having had more than
two—thirds boundary contiguity with the Town of Estes Park,Colorado,
