Minutes of a regular meeting held on May 27,1974,were read and approved as
read.
The Model Traffic Code for Colorado Municipalities,revised 1973,was read in
full to the B oard of Trustees as follows:
Chief Robert W.Ault —The first 10 sections
Corporal Walt Kappely —The second 10 sections
Officier Terry Matuszak —The last 6 sections
Trustee H.Bernerd Dannels introduced and the Town Clerk read in full the
following entitled ordinance and moved it be passed on first reading:
AN ORDINANCE FOR TUE REGULATION OF TRAFFIC
BY THE TOWN OF ESTESPARK,COLORADO FOR ThE
PURPOSE OF PROVIDING A SYSTEM OF TRAFFIC
REGULATIONS CONSISTENT WITH STATE LAW AND
GENERALLY CONFORMING TO SIMILAR REGULATIONS
THROUGHOUT THE STATE AND THE NATION;ADOPTING
BY REFERENCE THE 1973 EDITION OF THE “MODEL
TRAFFIC CODE FOR COLORADO MUNICIPALITIES”;
REPEALING ALL ORDINANCES IN CONFLICT THERE
WITh;AND PROVIDING PENALTIES FOR VIOLATION
THEREOF;AND AMENDING SECTION 10.04.010 OF

Trustee Glenn Prosser seconded the motion.Upon roll call the motion passed
by the following votes.Those voting “Yes”Trustees Robert E.Burgess,H.Bernerd
Dannels,N.T.Petrocine,Glenn Prosser,Rollen Sutter,Robert E.Wagner.Those
voting “No”none.
The Uniform Mechanical Code,1973 Edition,was read in full to the Board of
Trustees by Julie Birch.
Trustee Glenn Prosser introduced and the Town Clerk read in full the following
entitled ordinance and moved it be passed on first reading:

The Colorado Department of Health Technical Plumbing Code,amended 1972,was
read in full to the Board of Trustees by V.I.McCracken.
Trustee Rollen Sutter introduced and the Town Clerk read in full the following
entitled ordinance and moved it be passed on first reading:
AN ORDINANCE REGULATING PLUMBING AND
THE INSTALLATION THEREOF;ADOPTING BY
REFERENCE THE TECHNICAL PLUMBING CODE
OF THE STATE OF COLORADO,1972 EDITION;
AMENDING CHAPTER 14.24 OF THE MUNICIPAL
CODE OF THE TOWN OF ESTES PARK,COLORADO;
AND PROVIDING PENALTIES FOR VIOLATION
THEREOF.
Trustee Robert E.Wagner seconded the motion.Upon roll call the motion passed
by the following votes.Those voting “Yes”Trustees Rollen Sutter,Robert E.
Wagner,Robert E.Burgess,H.Bernerd flannels,N.T.Petrocine,Glenn Prosser.
Mr.John Easley,Attorney representing Mr.Lloyd Hess,appeared and presented
to the Board the final plat of the Hess Subdivision.After a short discussion,
Trustee Robert E.Wagner moved the final plat be approved.Trustee Glenn Prosser
seconded the motion.Upon roll call the motion passed by the following votes.
Those voting “Yes”Trustees Robert E.Wagner,H.Bernerd flannels,N.T.Petrocine,
Glenn Prosser,Rollen Sutter..Those voting “No”Trustee Robert E.Burgess.
Mr.Joe Jenkins,Attorney,appeared before the Board representing Mr.Frank E.
Williams and presented a petition for the Board of Trustees to provide Municipal
services to Tract 80,including,but not limited to,maintenance of a certain
road designated as “James—McIntyre Road”Fall River Addition.Mr.Jenkins went
on to state that Mr.Williams is owner of 46.7 acres of land of which the James—
McIntyre Road is the only access to the property.Mr.Dave Webb of The Water
Wheel owns property on both sides of the road and has elected to put up a fence
across the road,thus leaving Mr.Williams without access to his property.
Mr.Jenkins contends this road has been open to public use since it was
abandoned by the State Highway Department in 1949.
The Clerk submitted a letter from the Town’s Assistant Attorney,Colton,W.
Babcock,Jr.,advising the Board the matter was under investigation with the
State Highway Department as to the preciãe status of the road and that the
Board should delay any decision until completion of the investigation.
Trustee H.Bernerd flannels moved the matter be tabled for further findings
of the Larimer County Commissioners and the Town’s Assistant Attorney.Trustee
N.T.Petrocine seconded the motion.Upon roll call the motion unanimously carried.
Trustee N.T.Petrocine introduced the following resolution and moved it be passed
and adopted.

RESOLUTION
WHEREAS,the Town of Estes Park,Colorado,has been named a defendant
in a lawsuit to quiet the title to a parcel of land contained within the
boundaries of West Riverside Drive,and
WHEREAS,the parcel of land has been occupied for mare than 50 years
by a building and has never been opened or actually used as a street,and
WHEREAS,the Assistant Town Attorney has advised the Board of Trustees
that the plaintiffs in said lawsuit are probably entitled to the relief sought
in the amended complaint,and
WHEREAS,The Board of Trustees deems it to be in the best interests
of the Town of Estes Park,Colorado,
NOW,ThEREFORE,BE IT RESOLVED BY THE BOARD OF TRUSTEES OF ThE
TOWN OF ESTES PARK,COLORADO:
That the Town Attorney is hereby authorized and directed to file an
answer in the matter of Walker,et al,Plaintiffs,v Bond,et al,Defendants,
Civil Action No.25332,in the District Court in and for the County of Larimer
and State of Colorado,admitting the allegations of the amended complaint and re
questing said Court to grant the relief sought in said amended complaint.
Trustee H.Bernerd Dannels seconded the motion.Upon roll call the motion passed
by the following votes.Those voting “Yes”Trustees Robert E.Burgess,H.Bernerd
Dannels,N.T.Petrocine,Glenn Prosser,Rollen Sutter,Robert E.Wagner.Those

Trustee Robert E.Wagner introduced and the Town Clerk read in full the following
entitled ordinance and Trustee Wagner moved the ordinance be passed on first
and final reading:
AN ORDINANCE AMENDING TITLE 3 OF THE
MUNICIPAL CODE OF ThE TOWN OF ESTES
PARK,COLORADO,BY ADDING THERETO A
NEW CHAPTER,PROVIDING FOR A REFUND
OF A PORTION OF THE TOWN’S PORTION OF
PROPERTY TAXES PAID BY ELDERLY PERSONS.—,
Trustee Rollen Sutter seconded the motion.Upon roll call the motion passed
by the following votes.Those voting “Yes”Trustees H.Bernerd Dannels,
N.T.Petrocine,Glenn Presser,Rollen Sutter,Robert E.Wagner,Robert E.Burgess.
Those voting “No”none.Whereupon Mayor Harry B.Tregent declared said ordinance
duly passed and published according to law and ordered it’numbered 13—74.
Trustee Glenn Prosser,Chairman of the Estes Park Planning Commission,read the
minutes of the meeting held on June 18,1974.The Clatworthy Lot Split was
tabled because of the absence of Mr.Michael Marden,Agent for the Clatworthy’s.

Trustee Glenn Prosser introduced the following resolution and moved it be
passed and adopted:
RESOLUTION
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COLORADO:
That the Mayor and Clerk are hereby authorized and directed to sign
the agreement dated June 14,1974,by and between the Town of Estes Park
and the Pony of the America’s Club,Inc.,for performances to be held
July 23,24,25,26,27,1975.
Trustee Rollen Sutter seconded the motion.Upon roll call the motion
passed by the following votes.Those voting “Yes”Trustees N.T.Petrocine,
Glenn Prosser,Rollen Sutter,Robert E.Wagner,Robert F.Burgess,H.Bernerd
Dannels.Those voting “No”none.
The Clerk submitted a Liquor License Transfer on the Edel Baus from H.L.and
H.A.Schroeder to Norman W.and Shirlee Drake.Trustee Glenn Prosser moved the
liquor license transfer be approved subject to the Drake’s presenting for approval
a valid and legal lease.Trustee Rollen Sutter seconded the motion.Upon roll
call the motion unanimously carried.
Mr.Carl Holmgren appeared before the Board and requested a pest control officer
be appointed in relation to infested beetle trees.Mayor Barry B.Tregent
advised Mr.Holmgren to inform the Town Officials of any persons who were
not incompliance with the work being done until such time as a pest control officer
could be appointed.
There being no further business,it was regularly moved,seconded and carried
the meeting be adjourned.
