CORDINANCENO.q—-.ANORDINANCEAUTHORIZINGANDDIRECTINGTHEMAYORANDTOWNCLERKOFTHETOWNOFESTESPARK,COLORADO,TOEXECUTEANDFILE,ONBEHALFOFTHETOWN,ANAPPLICATIONFORTRANSFEROFAPORTIONOFTHEALLOTMENTCONTRACTWITHTHEBOARDOFDIRECTORSOFTHEMUNICIPALSUBDISTRICTOFTHENORTHERNCOLORADOWATERCONSERVANCYDISTRICT,FORTHETRANSFEROFONE(1)UNITOFWATERFROMSAIDDISTRICT,INAFORMIDENTICALTOTHATATTACHEDHERETOASAPPENDIXA;ANDAUTHORIZINGTHEMAYORANDTOWNCLERKTOASSIGNSAIDONE(1)UNITTOTHECENTRALWELDCOUNTYWATERDISTRICT.BEITORDAINEDBYTHEBOARDOFDIRECTORSOFTHETOWNOFESTESPARK,COLORADO:Section1.ThattheMayorandTownClerkoftheTownofEstesPark,Colorado,beandtheyareherebyauthorizedanddirectedtoexecuteandfile,onbehalfoftheTown,anApplicationforTransferofAllotmentContractwiththeBoardofDirectorsoftheMunicipalSubdistrictoftheNorthernColoradoWaterConservancyuistrictrorthetransrerorone(1)unitorwaterrromsaidSubdistrictinaformidenticaltothatattachedheretoasAppendixA;andtodoeachandeveryotherthingnecessaryandpropertoaccomplish,fortheTownofEstesPark,Colorado,theapprovalofthetransferthereinappliedfor.Section2.ThattheagreementbetweentheTownofEstesPark,ColoradoandtheCentralWeldCountyWaterDistrictdatedJuly23,1986isherebyratified;andtheMayorandTownClerkareherebyauthorizedanddirectedtoexecuteanynecessaryassionmentoragreementtocompletetheassignmentofone(1)unitofSubdistrictwateruntotheCentralWeldCountyWaterDistrict,providedthatsaidassignmentand/oragreementshallstatethatCentralWeldCountyWaterDistrictshallassumealloftheTown’sobligationsrelativetosaidunitandagreetosavetheTownharmlesstherefore.Section3.ThattheTownofEstesParkherebyrecoGnizesandacreesthatitsobligationtorepayaportionofthebondedindebtednessoftheSubdistrictrelatingtotheWindyGapProjectdoesnowandwillinthefuturecontinuetoexist,anothatsaidobligationswillnotbedischargeduntiltherepaymentorallbondedindebtednessincurredbySubdistrictasofthedatehereof.Section4.ThattheBoardofTrusteesoftheTownofEstesPark,Colorado,herewithfinds,determinesanddesignatesthatthisOrdinanceisnecessaryfortheimmediatepreservationofthepublicpeace,healthandsafety,forobtainingwateraffectsthepublicpeace,healthandsafety.ThisOrdinanceshalltakeeffectandbeforce30daysfromfinalpassage,adoptionandsignatureoftheMayor. 00 00PASSEDBYTHEBOARDOFTRUSTEESANDSIGNEDTHIS/DAYOF1987.1Myor,TOWNOFESTESPARK,COLORADO(SEAL)ATTEST:TownClerkU.I,iC/(c’—7c—pc&1beingthedulyappointedandactingTownClerkoftheTownofEstesPark,Colorado,doherebycertifytheabovetobeatrueandcorrectcopyofanOrdinancepassedandadoptedbytheBoardofTrusteesoftheTownofEstesPark,Coloradoataregularmeetinoheldonthe/‘dayofIaCcç,1987,suchOrdinancebecomingeffectiveonthe,4/-dayof_______________,1987.TOWNOFESTESPARK,COLORADOTownClerk 00
