00.9.100.030Falsealarmdefined.“Falsealarm”meansanyalarmsignaloriginatingfrauanyalarmdevicetowhichthepoliceorfiredepartmentrespondsandwhichresultsfrom:A.Falseactivation,includingreportingarobberywherenoactualorattemptedrobberyhasoccurred,orreportingaburglaralarmwherethereisnoevidencetosubstantiateanattemptedorforcedentrytothepremises;B.Alarmmalfunction,includingamechanicalorelectricalfailure;C.Alantriggeredbypennittee‘sorsubscriber’snegligence;D.Troubledconditionofthealarmdevice,includingelectricalfailureortelephonecompanymalfunction.9.100.040Mainemergencyterminaldefined.“Mainemergencyterminal”meansthetelephoneterminalutilizedtoreceiveemergencyinformationfortransmittaltothetownpoliceorfiredepartmentsandanyothersuchterminalutilizedforlikepurposes.9.100.050Alarmdeviceterminatingattownfacilities.AllalarmsystemswithinthetownnowservicedbydirectconnectiontothetownpolicedepartmentandfiredepartmentshallcontinueuntilSeptember1,1987.Upontheexpirationofsuchperiod,thetowndepartmentsshallnolongerservicesuchalarmsystemsandthedirectconnectionwiththetowndeparfitentsshallbeterminated,exceptasprovidedinSection9.100.055.9.100.055Instailationofdirectconnections.TheTownshallcontinuetoservicebydirectconnectionanyalarmsystemofanymedicalfacilitywhichhasasarequirementforitsoperationthatsaidfacilitymaintainanalarmsystem.SaidfacilityshallberesponsibleforallcostsincurredbytheTownininstalling,maintaining,and/orremovingitsalarmsystemwiththeTown.AllalarmsystemeguipnentshallbeapprovedbytheTownpriortoinstailation.Byuseofthetown’sfacilitiesfordirectconnectionofitsalarmsystem,eachfacilityagreesftindemnifyandholdharmlesstheTown,anyofitsemployees,officialsandagentsfrauanyandallclathnsandliabilitiesofanythirdpartyarisingoutofthemonitoringofthealarmsystembytheTown.ThisindemnificationshallincludeallattorneysfeesandcostsincurredbytheTown,anyofitsemployees,officialsandagentsasaresultofthemonitoringofanalarmsystem.9.100.060Permitandregistrationrequired.A.AlarmBusinessPermit.Nopersonshallengagein,conduct,operateorcarryonanalarmbusinesswithoutfirstapplyingthrandreceivingabusinesspermitthereforinaccordancewiththeprovisionsofthischapter.B.Nopersonshallplace,alloworcontractfortheinstallation,servicing,maintaining,repairing,replacing,movingor—2— 0 I0removingofanyalarmdeviceunlessregistrationofthedeviceismadepursuanttoandincompliancewiththischapter.ExistingalarmdevicesshallberegisteredonorbeforeJune1,1987.9.100.070Permitapplicationandregistration.A.AlarmBusinessPermit.Applicationforapermittoengagein,conduct,operate,orcarryonanalarmbusinessassetforthinSection9.100.060Ashallbeintheformtobedeterminedbythetown.Uponthefilingofanapplicationforapermitincanpilancewiththischapter,thethiefofpoliceandthefirethiefshallmakesuchinvestigationsastheydeemnecessaryftsatisfytherequirementssetforthinthischapter.Itnuistbedeterminedbythetownthatallapplicantsforpermitstoengagein,manage,conductorcarryonanalarmbusinessareofgoodcharacterandofgoodbusinessrepute;havenotbeenconvictedoftheft,embezzlement,oranyfelonyormisdemeanorinvolvingrobbery,burglary,dishonesty,fraudorthebuyingorreceivingofstolenpropertyanddonotemploypersonswhohavebeensimilarlyconvicted;or,iftheapplicantisacorporation,thatitsofficers,directors,principalstockholdersandemployeesmeetsaidlikerequirements.Toassistthethiefofpoliceandfirechiefand/orthetowninitsinvestigations,theapplicantandhisemployeesshallfurnishthefoiladnginformationandrecords:1.Nameanddescriptionofapplicantandallemployees;2.Addressandtelephonenwter;3.Fingerprintsandphotographoftheapplicantandallemployeestobetakenbyamemberofthepolicedeparimentofthetown;4.Aswornstatementastowhetherornottheapplicantortheapplicant’semployeeshavebeenconvictedofacrime,felonyormisdemeanor,thenatureoftheoffenseandthepunishmentassessedtherefor;5.Adescriptionoftheactivitiesproposedtobeundertakenbytheapplicantandadescriptionofallequipmenttobeusedbytheapplicantinundertakingthoseactivities;6.Astatementsettingforththeexperience,ifany,withrespecttotheactivitiesproposedtobeundertaken;and7.Suchotherinformationasmaybereasonablyrequiredtocarryoutthepurposesofthischapter.B.RegistrationofAlarmDevice.Allalarmdevicesinstalled,serviced,maintained,repaired,replaced,movedorremovedfromanypremiseslocatedwithinthetownshallberegisteredwiththetown.ExistingdevicesshallberegisteredonorbeforeJune1,1987.Everypersonmaintaininganaudibleorsilentalarmdeviceshallfurnishaspartoftherequiredregistration,thetypeofalarmdevicebeingregistered,naxreandtelephonenumberofthealarm0—3— o0rI-.-—— 9.100.110Adninistrationandregulation.Theprovisionsofthischaptershallbeadministeredandenforcedbythechiefofpoliceandfirechief.Theyareauthorizedtonakeinspectionsofthefireorburglaralarmdeviceandofthepremiseswhereonthedeviceislocated,providedsuchinspectionsareconsistentwiththeprovisionsofthiscoderegulatinginspections.Thethiefofpoliceandfirechiefshallhavethepowertomakeandenforcesuchrulesandregulationsasmayintheirdiscretionbenecessarytoimplementtheprovisionsasmaybeprovidedelsewhereinthiscode.SuchrulesandregulationsshallbeeffectiveonthefifteenthdayafteranoticeofsuchrulesandregulationsisplacedintheUnitedStatesmail,withadequatepostagetherecn,addressedtoallholdersofvalidpermits,issuedinaccordancewiththeprovisionsofthischapter,unlessapennitteehasfiledwiththetownclerkawrittenobjectiontosuchrulesandregulationsaddressedtotheboardoftrustees.Theboardoftrusteesshallconsidertheobjectionsatahearingtobeheldatthenextregularmeetingoftheboardoftrusteesfollowingthefilingofsuchobjectionsashereinprovided.Suchrulesandregulationsapprovedbytheboardoftrusteesshallbeeffectiveonthedateoftheirapproval.9.100.120Audiblefireandburglaralarmsnottobesimilartosiren.Itisunlawfultoinstalloruseafireorburglaralarmdevicewhich,uponactivation,emitsasoundsimilartosirensinuseonemergencyvehiclesorforcivildefensepurposes.9.100.130Instructionasftoperationofsystem.Itshallbetheresponsibilityoftheholderofapennitftinstructhissl±sriberandtheoccupantofthepremiseswhereinthefireorburglaralarmdeviceisinstalledintheproperuseandoperationofthedevice,whethersilentoraudThle,includingallnecessaryinstructioninturningoffthealarmandinavoidingfalsealarms.9.100.140Falsealarmchargesandpenalties.A.Thepermitteeofthepremises,owneroroccupantofaresidence,oroperatorofabusiness(allcollectivelyreferredtointhissectionas“permittee”)whereinafireorburglaralarmdeviceisinstalledissubjecttothefollowingchargesandpenaltiesforallfalsealarmsfromthedevicewhichexceedthreeinanycalendaryear:1.Fourthfalsealarm,twenty—fivedollars;2.Fifthfalsealarm,fiftydollars;3.Sixthfalsealarm,onehundreddollars;4.Seventhfalsealarm,onehundredfiftydollars;5.Eighthfalsealarm,twohundreddollars;6.Ninthfalsealarm,ttchundredfiftydollars;7.Tenthfalsealarmandeachsuccessivefalsealarm,threehundreddollars—5— 0 -_____ILo0•B.Allfalsealarmchargesshallbepaidtothetownwithinti.entydaysfromthedateofbillingbythetown.Thetownshallnotifythepermitteeofeachfalsealarmbyawrittennoticethereofaddressedtothepennitteeattheaddressshownonthepermitapplicabletothepremises.ThepermitteeshallhavefifteendaysfromthedatethenoticeisplacedintheUnitedStatesmail,withadequatepostagethereon,withinwhichtofilewiththetownclerkawrittenrequestaddressedtotheboardoftrusteesrequestingthatitdeterminethatthepenidtteeisnotresponsibleforsuchfalsealarmandthatthealanshouldnotbeconsideredafalsealarmundertheprovisionsofthissection.Theboardoftrusteesshallconsidertherequestatthenextregularmeetingoftheboardoftrusteesfollowingthefilingoftherequest.Iftheboardoftrusteesdeterminesthatthepennitteeisnotresponsibleforthefalsealarm,thealarmshallnotbeconsideredafalsealarmundertheprovisionsofthissection.9.100.150Responsibilityforalanservice.Thepersonorpersonsnamedinthepermittobenotifieduponactivationofthedevice,orthepersonorpersonsnotifiedbythedevice,shall,uponpropernotificationmEdiatelynotifythetownpoliceorfiredeparthentofthealarmactivationandthenshallproceedimnediatelytothelocationoftheactivatedalarmandrenderallnecessaryservice;providedthattheoccupantofthepremisesnay,byagreementwiththepeunittee,assumethepermittee’sobligationtorespond.9.100.160Servicerequirement.Nopersonshallinstall,permitthsta)lation,maintain,orcausetobexaintainedanyfireorburglaralarmdeviceforwhichperiodicserviceormaintenanceisnotprovided.9.100.170Compliancerequiredandtuneperiod.AllfireorburglaralarmdevicesinstalledonorpriortotheeffectivedateoftheordinancecodifiedinthischaptershallbebroughtintoconformitywiththerequirelTentsofthischapteronorbeforeJune1,1987.Anypersonowning,managing,conducting,carryingonthebusinessof,orpermittingtheinstalling,servicing,maintaining,reaiing,replacing,movingorremovingoffireorburglaralarmdevices,ontheeffectivedateoftheordinancecodifiedinthischapter,shallbepermittedaperiodnottoexceedninetydaysfromsuchdatetomakeapplicationasrequiredundertheprovisionsofthischapter.UponapplicationtothetownandshowingofhardshipbyanypersonrequiredtocDnplywiththissection,thetownmaypermitanextension,forareasonableperiodoftime,withinwhichtocomplywiththeprovisions.9.100.180Noncorrpliancedeemedunlawfulandapublicnuisance.Anyandallfireorburglaralarmdeviceswhichdonotcatplywiththeprovisionsofthischapterareunlawfulandapublicnuisance,andshallbeabatedassuch.9.100.190Violation.Itisunlawfulforanypersontoviolateorfailtocaiplywithanyprovisionofthischapter.Everypersonconvictedofaviolationofanyprovisionstatedoradoptedherein—6— 0
