0C)VORDINANCENO7-96ANORDINANCEADOPTINGTHENATIONALELECTRICCODE,1996EDITIONBYREFERENCEWHEREAS,theBoardofTrusteesoftheTownofEstesPark,ColoradohasdeterminedthatitisinthebestinterestoftheTowntoadopttheNationalElectricCode,1996Edition.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.Section14.20oftheMunicipalCodeisherebyadoptedasfollows:14.20.010NationalElectricalCode,1996,Adopted.TheNationalElectricalCode,1996Edition,issuedbytheNationalFireProtectionAssociation,Inc.,BatterymarchPark,Quincy,MA02269,isenactedandadoptedbyreferenceasaprimarycodeandincorporatedinthischapter.14.20.015NationalElectricalCode,1996--Violation.A.ItisunlawfulforanypersontoviolateanyoftheprovisionsstatedoradoptedintheNationalElectricalCode,1996Edition.B.EverypersonconvictedofaviolationofanyprovisionstatedoradoptedintheNationalElectricalCode,1996Edition,shallbepunishedassetforthinSection1.20.020oftheMunicipalCode.14.20.017Damages.NeithertheTown’sBuildingInspector,TownEngineer,LightandPowerDirector,noranyotheremployeeoragentoftheTownofEstesPark,noranyvolunteeractingonbehalfoftheTown,shallbeliableforanydamagesforanyactand/oromissionbysuchperson,pursuanttothedutiesandenforcementoftheprovisionsoftheNationalElectricalCode,1996Edition.14.20.020License--Required.Itisunlawfulforanypersontoengageinthebusinessofinstallation,alteringorrepairingelectricalwiringintheTownwithoutfirsthavingprocuredalicensethereforfromtheState.Therequirementforalicenseshallnotapplytotheownerofanypropertydoingworkinorabouthisownresidence,providedthathefirstobtainsthenecessarypermittherefor.TherequirementforalicenseshallnotapplytoajourneymanelectricianorhelperwhoisworkingunderthecontrolandsupervisionofanelectricianlicensedbytheState. CC) 0014.20.040Permit--Application--Issuance.ApplicationforpermitshallbemadetotheColoradoStateElectricalBoard.Suchpermitshallbepostedonthesiteoftheworkandkeptthereuntiltheworkiscompleted.14.20.060Certificateofapprovalrecfuired.ItisunlawfulforanypersontomakeanyelectricalconnectiontoanybuildinguntiltheStateElectricalInspectorhasissuedacertificateapprovingtheelectricalwiring.14.20.070Permit--Temporary.Where,fromgoodandsufficientcause,itisnecessarytohaveelectricityonanyinstallationbeforethefinalcertificatecanbeissued,theStateElectricalInspectormayissueatemporarypermit;provided,thatallpartstowhichcurrentisappliedareinasafeandsatisfactorycondition.14.20.080Electricalconstructionreqtirements.Allnewstructuresandexistingstructuresthatarealtered,addedtoorrepairedinexcessoffiftypercent,andwhichcontain,inwholeorinpart,commercialuses,shallbeentirelywiredinrigidorsteeltubeconduitsorapprovedmetalraceways.UnlessitisotherwiserequiredbyapplicableprovisionsoftheNationalElectricalCode,1996Edition,thereauirementsofthissectiondonotapplytoafreestandingcommercialstructureservedbyoneelectricmeterlocatedintheTown’scommercialoutlying(CO)zone.Section2.TheadoptionofthisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS94-DAYOF_________,1996.C,TOWNOFESTESPAREBY:________________________________MayorATTEST:iJ:LTownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe94dayof______1996,andpublishedinanewspaperofgeneralcirculationikitheTownofEstesPark,Coloradoonthefdayofd&tcL.1996.4Jf::;ELTownClerk CC)
