CCORDNANCENO.96ANORDINANCEAPPROVINGTHECOSTOFTHEPUBLICIMPROVEMENTSTOBEMADEINPARKENTRANCEESTATESSPECIALIMPROVEMENTDISTRICTNO.95-I,NTHETOWNOFESThSPARK,COLORADO;APPROVINGANDCONFIRMINGTHEAPPORTIONMENTOFSAIDCOSTTOEACHLOTINTHEDISTRiCT;ASSESSINGASHAREOFSAIDCOSTAGAINSTEACHLOTNTHEDISTRICT;ANDPRESCRIBINGTHEMANNERFORTHECOLLECTIONANDPAYMENTOFSAIDASSESSMENTS.WHEREAS,byOrdinanceNo.12-95,finallypassedandadoptedonAugust8,1995,theBoardofTrustees(the“Board”)oftheTownofEstesPark,Colorado(the“City”),createdParkEntranceEstatesSpecialImprovementDistrictNo.95-1(the“District”),forthepurpoeofpayingforpublicimprovementstobeconstructedintheDistrict;andWHEREAS,thetotalcostofsuchpublicimprovementshasbeendefinitelyascertained,andastatementoftheproposedapportionmentofcostsontherealpropertybenefitedhasbeenpreparedandfiledintheofficeoftheTownManager;andWHEREAS,duenoticewasgiventhattheBoardwouldmeettohearandconsiderwrittenremonstsancestosuchapportionmentonthisdate,andthatanysuchwrittenremonstrancesfiledwiththeTownonorpriortothedateofthehearingwouldbeheardanddeterminedbytheBoardbeforethepassageofanyordinanceassessingthecostofsaidimprovements;andWHEREAS,writtenremonstrancestotheproposedapportionmentwerereceivedtimelybytheTown;andWHEREAS,allwrittenremonstranceshavebeenheardandconsideredbytheBoardatthehearingheldforthepurpose;andWHEREAS,fromthestatementfiledwiththeTownManageritappearsthatthetotalcostoftheimprovementsis$460,000,that$20,000thereofistobepaidbytheTown,andthattheportionthereofwhichshouldbeassessedagainsttherealpropertyspeciallybenefitedandincludedwithintheDistrictis$440,000;and#166652.v22 00WHEREAS,theBoardhasapportionedashareofthecosttoeachlotintheDistrict,inaccordancewiththebenefitstobederivedbysaidpropertyandhaspreparedtheattachedassessmentrole(ExhibitAhereto);andWHEREAS,theBoardhasdeterminedtoassessthecostoftheimprovementsagainstsuchlotsintheamountssetforthintheassessmentrollandtodirecttheTownTreasurer/FinanceDirectortocollectamountspayableinaccordancetherewith;THETOWNOFESTESPARK,COLORADOORDAiNS:Section1.ConfirmatiorofAssessmentRoll.Thewholecostoftheimprovementsandtheapportioim-ientofthesame,assetforthintheassessmentroll,isherebyapprovedandconfirmedasofApril9,1996.SaidapportionmentisherebydeclaredtobeinaccordancewiththespecialbenefitswhichthepropertyintheDistrictwillreceivebyreasonoftheconstructionofsaidimprovements.AshareofsaidcostisherebyassessedtoanduponeachlotwithintheDistrictintheproportionsandamountssetforthintheassessmentroll,whichassessmentrollisattachedheretoasExhibitAandincorporatedhereinbythisreference.Section2.PaymentofAssessments.TheBoardherebydirectstheTownTreasurer/FinanceDirectortocollectanyamountpayableasanassessmentunderthisOrdinancepursuanttoSection31-25-526(1),ColoradoRevisedStatutes.TheassessmentsshallbedueandpayableattheofficeoftheTownTreasurer/FinanceDirectorwithinthirty(30)daysafterthefinalpublicationofthisOrdinance,withoutdemand.However,attheelectionofthepropertyowner,allsuchassessmentsmaybepaidininstallments,withinterestashereinaftersetforth.AnyownerofpropertywithintheDistrictwhopaystheassessmentonsuchpropertyinifillwithinsuchthirty-dayperiodshallbealloweda6.85%discountfromtheassessmentamountshownontheassessmentrollforsuchproperty.AnyownerofpropertywithintheDistrictwhopaysone-fourth,one-half,orthree-fourthsoftheassessmentonsuchpropertywithinsuchthirty-dayperiodshallbealloweda6.85%discountfromsuchfractionoftheassessmentamountassuchownerhaselectedtopay.Failuretopaythewholeassessment(discountedassetforthabove)withinsaidperiodofthirty(30)daysshallconclusivelybeconsideredtobeanelectiononthepartofallpersonsinterested,whetherunderdisabilityorotherwise,topayininstallments.Allpersonssoelectingtopayininstallmentsshallconclusivelybeconsideredtohaveconsentedtosaidimprovements.Such#166652.v23 C0electionshallconclusivelybeconsideredtobeawaiverofanyrighttoquestionthepowerorjurisdictionoftheTowntoconstructtheimprovements,thequalityofthework,theregularityorsufficiencyoftheproceedings,thevalidityorthecorrectnessoftheassessments,orthevalidityofthelienthereof.Intheeventofsuchelectiontopayininstallments,theassessments,togetherwithinterestthereon,shallbepayableinten(10)equalannualinstallments,thefirstofwhichshallbedueandpayableonApril15,1997,attheofficeoftheTownTreasurer/FinanceDirector.TheremainderofsaidinstallmentsshaDbedueandpayablesuccessivelyonorbeforeApril15ofeachyearthereafteruntilpaidinfUll,withinterestontheunpaidprincipalamountcalculatedattherateof6.750%perannum,accruingfromtheeffectivedateofthisOrdinance.Thetenth(10th)andlastinstallmentwillbedueandpayableonApril15,2006.Theownerofanypropertynotindefaultastopaymentofanyinstallmentorportionthereofmayatanytimepaythewholeoftheunpaidprincipalwiththeinterestaccruingtothematurityofthenextinstallment.Section3.PenaltyforDefaultorNon-Payment.Failuretopaythewholeamountofanyinstallmentwhenduealsoshallcausethewholeoftheunpaidprincipalofandinterestontheassessmentamounttobecomedueandcollectibleimmediately.Thewholeamountofanysuchunpaidprincipalandtheaccruedinterestthereonshall,aftersuchpropertysaleorsuchfailuretopayaninstallment,thawinterestattherateestablishedpursuanttoSection5-12-106(2)and(3),ColoradoRevisedStatutes,untilthedateofforeclosuresaleortaxsale.Inthecaseoffailuretopayanyinstallmentorportionthereof,atanytimepriortothedateofforeclosuresaleortaxsaletheownermaypaytheamountofallunpaidinstallmentswithinterestatsaidpenaltyratepermonthorfractionofamonthandallotherpenaltiesandcostsofcollectionaccrued,andshallberestoredtotherightthereaftertopayininstallmentsinthesamemannerasifthedefaulthadnotbeensuffered.Section4.AssessmentLien.AllassessmentsleviedagainsttherealpropertyintheDistrict,togetherwithallinterestthereonandpenaltiesfordefaultinpaymentthereofandallcostsincollectingthesame,shallconstitute,fromthedateofthefinalpublicationofthisOrdinance,aperpetuallienintheseveralamountsassessedagainsteachlotortractofland.Suchlienshallhavepriorityoverallotherliensexceptgeneraltaxliens,andshallbeenforcedinaccordancewiththelawsoftheStateofColorado.#166652.v24 00Section5.AssessmentsAgainstDividedandSubdividedTracts.Astoanyfurthersubdivisionofanylandassessedhereunder,theassessmentshallineachcasebealienuponallthesubdivisionsinproportiontotheirrespectiveareas.Intheeventofsuchsubdivision,theTownTreasurer/FinanceDirectorisherebyauthorizedanddirectedtodividetheassessmentagainstsuchlandinthesameproportionthatthelanditselfissubdivided,andtocertifytherevisedassessmentstotheTown.Section6.NoticeofPaymentAssessments.TheTownTreasurer/FinanceDirectorshallcauseanotice&‘assessmentsduetobemailedtotheownersofthepropertyintheDistrict,onoraboutthesamedayasthefinalpublicationofthisOrdinance.Suchnoticeshallsetforththeplaceofpayment,thediscountedamountofthewholeassessment(andofone-fourth,one-half,andthree-fourthsoftheassessment),ifpaidwithinthethirty-daypaymentperiod,andthetimeforsuchthirty-dayperiodtoclose.Section7.Severabiliw.IfanyoneormoresectionsorpartsofthisOrdinanceshallbeadjudgedunenforceableorinvalid,suchjudgmentshallnotaffect,impair,orinvalidatetheremainingprovisionsofthisOrdinance,itbeingtheintentionthatthevariousprovisionshereofareseverable.Section8.Repealer.Allacts,orders,resolutions,ordinances,orpartsthereof,inconflictwiththisOrdinance,areherebyrepealed.Section9.RecordingandAuthentication.ThisOrdinance,immediatelyonitspassage,shallberecordedintheTownBookofOrdinanceskeptforthatpurpose,shallbeauthenticatedbythesignaturesoftheMayorandTownClerk,andshallbepublishedinaccordancewithlaw.Section10.EffectiveDate.ThisOrdinanceshallbeeffective,inaccordancewithstatelaw,thirtydaysfollowingitsfinaladoptionbytheBoard.#166652v25
