ORDINANCENO.2396ANORDINANCECREATINGATOWNTREEBOARDTOIMPLEMENTTHETREECITYPROGRAMWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasreviewedtheTreeCityProgramwhichisdesignedtorecognizecommunitiesthatareeffectivelymanagingtheirpublictreeresourcesandencouragetheimplementationofcommunitytreemanagement;andWHEREAS,theBoardofTrusteeshasdeterminedthatitisinthebestinterestsoftheTowntocreateaTreeBoardtoimplementandadministeraTreeCityProgramintheTown.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.CreationofaTreeBoard.ThereisherebycreatedandestablishedaTreeBoardfortheTown.TheBoardshallconsistofseven(7)memberswhoshallbeappointedbytheMayorwiththeapprovaloftheTownBoard.Thetermofthemembersshallbefour(4)years.Theinitialtermsshallbethree(3)memberswithtwo(2)yeartermsandfour(4)memberswith(4)yearterms.Followingtheinitialtwo(2)yearterms,alltermsshallbefour(4)years.AnyvacancythatshalloccurduringthetermofanymembershallbefilledbyappointmentbytheMayorwiththeapprovaloftheTownBoardfortheunexpiredportionofsaidmember’sterm.MembersoftheBoardshallservewithoutcompensation.Section2.AdministrationoftheTreeBoard.TheTreeBoardshallchooseitsownofficersandmakeitsownrulesandregulationsforthemanagementofitsduties.Section3.DutiesandResponsibilitiesoftheTreeBoard.ItshallbetheresponsibilityoftheTreeBoardtostudy,investigate,developandadministeraplanforthecare,preservation,planting,replantingandremovaloftreesandshrubsinparks,alongpublicstreetsandrightsofway,andinotherpublicareasoftheTown.TheTreeBoard,whenrequestedbytheTownBoard,shallconsider,investigate,makefindings,reportandrecommendonanymatterreferredtoitbytheTownBoard.TheTreeBoardmayforwardtotheTownBoardrecommendationsregardingpublictreeresourcesincluding,butnotlimitedto,thefollowing: (20U URecommendeddistancetreesmaybeplantedfromsidewalksandcurblines;recommendeddistancesforplantingoftreeswithregardtoanystreetcornerorfirehydrant;recommendationsconcerningtheplanting,pruningandmaintainingoftreesandshrubsnecessarytoinsurepublicsafetyand/ortopreserveandenhancethebeautyofpublicgroundsandstreets;recommendationsconcerninganyportionofatreeoverhanginganypublicstreetorrightofwaywithregardtoobstructionofviewandthepublicsafety;recommendationsconcerningtheremovalofalldead,diseasedordangeroustrees,brokenordecayedlimbswhichconstituteasafetyhazardtothepublic.Section2:ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOThIS/oDAYOFta,,4.t.t),1996.ATTESTc.ntJTownClerkIherebycertifythattheaboveOrdinancewasintroducedandreidatameetingoftheBoardofTrusteesonthe/0dayof____________1996,andpublishedinanewspaperofgeneralc4.rculationintheTownofEstesPark,Coloradoonthe/3dayof_____________1996.TownClerkTOWNOFESTESPARKBy:IMayor 00
