Home My WebLink AboutORDINANCE 21-880CORDINANCENO.21-88ANORDINANCEAMENDINGCHAPTER8.04OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADO,THESAMEPERTAININGTOOPENBURNINGANDBURNINGOFGARBAGE,WASTEANDTRASH.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:SECTION1.ThatChapter8.04oftheMunicipalCodeoftheTownofEstesPark,Colorado,shallbeamendedbytheadditionofthefollowingSection.8.040.075OpenBurningProhibited.ExceptasprovidedinthisSection,itshallbeunlawfulforanypersontoburnorallowtheburningofanygarbage,trash,wastepaper,wood,leaves,wasteoranyotherflammablematerialonanyopenpremiseswithintheTownofEstesParkunlessanopenburningpermitisfirstobtainedfromtheAirQualityControlDivisionoftheColoradoDepartmentofHealth,oranyagencyauthorizedbysaidDepartmenttograntopenburningpermits.Thefollowingsourcesofopenburningareexemptedfromobtaininganopenburningpermit:(a)Openfiresusedforthenoncommercialcookingoffoodforhumanbeings.Anopenfireshallnotbebuiltinanyareawhichconstitutesafirehazardsuchasneartrees,brush,oranyflammablestructure.Saidfireshallbecontainedinoneofthefollowing:i.Self—containedcookinggrillcommonlyknownasabarbecuegrill.ii.Abuilt—inbarbecuepit.iii.Acookingfirecontainedinafireringofnotmorethan6feetindiametermadeofstoneorothernon—combustiblematerial.(b)Flarestoindicatesomedangertothepublic.SECTION2.TheBoardofTrusteesoftheTownofEstesPark,Colorado,herewithfinds,determinesanddesignatesthatthisOrdinanceisnecessaryinordertoimmediatelystopopenburningoffiresintheareaoftheMunicipality;andwhereas,inthe 00 00opinionoftheBoardofTrustees,anemergencyexists,thisOrdinanceshalltakeeffectandbeinforceimmediatelyafteritspassage,adoptionandsignatureoftheMayor.TOWNOFESTESPARKBy:_____MayorATTEST:rTownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthedayof1988,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Colorado,onthe9dayofAugust,1988.ThAZTownCLerk—2— 00
