Home My WebLink AboutORDINANCE 12-88•00•ORDINANCENO.12-88ANORDINANCEAUTHORIZINGANDDIRECTINGTHEMAYORANDTOWNCLERKOFTHETOWNOFESTESPARKTOEXECUTEANDFILE,ONBEHALFOFTHETOWNOFESTESPARK,COLORADO,SUCHDOCUMENTSASARENECESSARYTOTRANSFER1UNITOFWATEROFTHEMUNICIPALSUBDISTRICT,NORTHERNCOLORADOWATERCONSERVANCYDISTRICTBEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.ThattheMayorandTownClerkoftheTownofEstesPark,Colorado,beandherebyareauthorizedanddirectedtoexecuteandfile,onbehalfoftheTown,anapplicationfortransferofwaterallotmentcontractwiththeMunicipalSubdistrict,NorthernColoradoWaterConservancyDistrictforthetransferofone(1)unitofSubdistrictwaterfromsaidSubdistrictintheformattachedasAppendixA;andtodoeachandeverythingnecessaryandpropertoaccomplish,fortheTownofEstesPark,theapprovalofthetransferrequestedtherein.Section2.ThattheMayorandTownClerkoftheTownofEstesPark,Colorado,beandherebyareauthorizedanddirectedtoenterintoanagreementtransferringtoLeftHandWaterSupplyCompanyone(1)unitofSubdistrictwateracquiredpursuanttotheWaterAllotmentContractapprovedbytheBoardofDirectorsoftheSubdistrictonJuly11,1975.Section3.ThattheMayorandTownClerkoftheTownofEstesPark,Colorado,beandherebyareauthorizedanddirectedtoexecutethePetitionforWaterAllotmentContractoftheLeft.HandWaterSupplyCompanyintheformattachedheretoasAppendixB.Section4.ThattheTownofEstesParkherebyrecognizesandagreesthatitsobligationtorepayitsportionofthebondedindebtednessoftheSubdistrictrelatingtotheWindyGapprojectdoesnowandwillinthefuturecontinuetoexist;andthatsaidobligationswillnotbedischargeduntiltherepaymentofallbondedindebtednessincurredbytheSubdistrictasofthedatehereof;andthattheSubdistrictnaylevyaspecialassessmentpursuanttoC.R.S.37—45-123onlandswithintheTownpursuanttothetermsoftheWaterAllotmentContractoftheTownofEstesParkdatedJuly11,1975,intheeventthatSubdistrictdoesnot,foranyreason,including,butnotlimitedto,theinsolvencyorbankruptcyofLeftHandWaterSupplyCompany,receivetheannualpaymentsrequiredbytheWaterAllotmentContractoftheLeftHandWaterSupplyCompany,orintheeventthattheWaterAllotmentContractoftheLeftHandWaterSupplyCompanyisterminatedbytheSubdistrictaccordingtoitsterms. 00 00Section5.Theadoptionofthisordinance,andtheexecutionofthedocumentsauthorizedherein,shallnotrevokeorrepealOrdinanceNo.10—75oftheTownofEstesPark,asadoptedonMay13,1975.Section6.ThattheBoardofTrusteesoftheTownofEstesPark,Colorado,herewithfinds,determinesanddesignatesthatthisordinanceisnecessaryfortheimmediatepreservationofthepublicpeace,health,andsafety,forobtainingwateraffectsthepublicpeace,health,andsafety,andwhereas,intheopinionoftheBoardofTrustees,anemergencyexists,thisordinanceshalltakeeffectuponadoption.PASSEDANDADOPTEDBYTHEBOARDOFTUSTEESOFTHETOWNOFESTESPARK,COLORADO,thisdayoffl’dLtt,19,P?TOWNOFESTESPARKBy:_____SayorIherebycertifythattheaboveOrdinancewasintroducedandreadaregularmeetingoftheBoardofTrusteesonthea2/dayof_______________,198J;andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Colorado,onthedayof_______________,19allasrequiredbythestatutesoftheStateofColorado.TowClerkProternATTEST 00
