00ORDINANCENO.9-88ANORDINANCEFORTHEPURCHASEOFCERTAINREALPROPERTYWITHINTHETOWNOFESTESPARK.WHEREAS,theTownofEstesParkenteredintoacontractinFebruaryof1988forthepurchaseofcertainrealpropertywithintheTownofEstesPark;andWHEREAS,theBoardofTrusteesdesirestoconfirmthepurchaseoftherealpropertyandauthorizetheappropriateofficialsoftheTownofEstesParktoclosethetransaction.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.TheBoardofTrusteesoftheTownofEstesPark,herebyauthorizethepurchaseofthefollowingdescribedrealproperty:AparceloflandlocatedinthenortheastquarterofSection25,T5N,R73Wofthe6thP.M.,TownofEstesPark,countyofLarimer,StateofColorado,moreparticularlydescribedas:Beginningatapointwhichbears56°l1.S’Wadistanceof206.2feetfromthesouthwestcornerofLot23,RiversideSubdivision,TownofEstesPark;thenceS73°58’Wadistanceof60feetmoreorlesstothecerterlineoftheBigThompsonRiver;thencesoutherlyalongsaidcerterlinetoitsintersectionwiththesouthlineofsaidnortheastquarter;thenceeasterlyalongsaidsouthlinetothewestright—ofwaylineofEastRiversideDrive;thencenortherlyalongsaidwestright—of—waylinetothepointofbeginning;andcontainingapproximately0.06acres,moreorless.2.Therealpropertyshallbepurchasedforthesumoftwentythreethousandthreehundredseventyfivedollars($23,375.00),payableincashorcertifiedfundsatthetimeofclosing. 00 003.TheTownshallalsoberesponsibleforthepaymentofthetitleinsurancepremiumandallcustomaryclosingcosts.TheclosingofthetransactionshalloccuronorbeforeJune1,1988.4.TheMayorandTownClerkareherebyauthorizedtoexecuteallnecessarydocumentstoaccomplishthepurchaseoftheaforementionedrealpropertyinaccordancewiththetermsandconditionsofthecontractbetweentheTownofEstesParkandJuliaS.Spencer.5.TheBoardofTrusteesoftheTownofEstesPark,Colorado,herewithfinds,determinesanddesignatesthatthisOrdinanceisnecessaryfortheimmediatepreservationofthepublicpeace,healthandsafetyinordertoallowthepurchaseoftheabovedescribedrealpropertyonorbeforeJune1,1988;andwhereas,intheopinionoftheBoardofTrustees,anemergencyexists,thisOrdinanceshalltakeeffectandbeinforceimmediatelyafteritspassage,adoptionandsignatureoftheMayor.TOWNOFESTESPARKBy:_____MayorATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe/cdayofMay,1988,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthe/‘dayofMay,1988.it4,1-&-)TownClerk—2— 00
