03-890&ORDINANCENO.3-89ANORDINANCETOAPPLYANDCONTRACTFORBENEFICIALUSEOFWATERONBEHALFOFTHETOWNOFESTESPARK,AMUNICIPALCORPORATION,ANDPRESCRIBINGTHETERMSFORAPPLICATIONFORANALLOTMENTOFWATERTOSAIDTOWNOFESTESPARKBYNORTHERNCOLORADOWATERCONSERVANCYDISTRICT.WHEREAS,undertheWaterConservancyActofColorado,Title37,Article45,ColoradoRevisedStatutesof1973,itisnecessarythattheBoardofTrusteesoftheTownofEstesPark,aColoradomunicipalcorporation(hereinaftercalled“Applicant”)inordertoobtainanallotmentcontractforthebeneficialuseofwaterfromNorthernColoradoWaterConservancyDistrict,shallbyordinanceauthorizeanddirecttheMayorandtheTownClerktoapplytotheBoardofDirectorsofsaidDistrictforsuchwaterallotmentcontract.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1:ThattheTownofEstesParkelectstoapplyforanallotmentcontractprovidingforthebeneficialuseofFourHundredFourteen(414)acre—feetofwaterfromNorthernColoradoWaterConservancyDistrict.Section2:ThattheMayorandtheTownClerkbeandareherebyauthorizedanddirectedtoapplytotheBoardofDirectorsofsaidNorthernColoradoWaterConservancyDistrictforacontractallottingtotheApplicantthebeneficialuseofwaterupontermsprescribedbysaidBoardinthemannerandformasthissectionprovided,to—wit:APPLICATIONTONORTHERNCOLORADOWATERCONSERVANCYDISTRICTFORWATERALLOTMENTCONTRACTApplicant,TownofEstesPark,aColoradomunicipalcorporation,herebyappliestoNorthernColoradoWaterConservancyDistrict,apoliticalsubdivisionoftheStateofColorado,organizedandexistingbyvirtueofTitle37,Article45,ColoradoRevisedStatues,1973,foranallotmentcontractofbeneficialuseofwaterunderthefollowingtermsandconditions:1.ThequantityofwaterhereinrequestedbyApplicantforannualapplicationtobeneficialuseisFourHundredFourteen(414)acre—feettobeusedsolongastheApplicantfully I0.0 00complieswithalloftheterms,conditions,andobligationshereinaftersetforth.2.ItisunderstoodandagreedbytheApplicantthatanywaterallottedbytheBoardofDirectorsofsaidDistrictshallbefordomestic,irrigation,orindustrialusewithinorthroughfacilitiesoruponlandsownedorservedbysaidApplicant,providedhowever,thatalllands,facilities,andservicedareaswhichreceivebenefitfromtheallotment(whetherwaterserviceisprovidedbydirectdelivery,byexchange,orotherwise)shallbesituatedwithintheboundariesofNorthernColoradoWaterConservancyDistrict.3.Applicantagreesthananacre—footofwaterasreferredtohereinisdefinedasbeingone—three—hundred—ten—thousandth(1/310,000)ofthequantityofwaterannuallydeclaredbytheBoardofDirectorsoftheDistricttobeavailablefordeliveryfromthewatersuppliesoftheDistrict.ApplicantagreesthatsuchwatershallbedeliveredfromtheworksoftheDistrictatsuchexistingDistrictdeliverypointorpointsasmaybespecifiedbytheApplicantandthatthewaterdeliveryobligationoftheDistrictshallterminateuponreleaseofwaterfromsaidworks.Further,theApplicantagreesthatonNovember1ofeachyear,anywaterundeliveredfromtheannualquantitymadeavailabletotheApplicantshallreverttothewatersuppliesoftheDistrict.4.ApplicantagreestopayannuallyfortheamountofwaterhereinallottedbytheBoardofDirectorsofsaidDistrictatapriceperacre-foottobefixedannuallybysaidBoard;and,further,agreesthattheinitialannualpaymentshallbemade,infull,withinfifteen(15)daysafterthedateofnoticefromtheDistrictthattheinitialpaymentisduehereunder.SaidnoticewilladvisetheApplicant,amongotherthings,ofthewaterdeliveryyeartowhichtheinitialpaymentshallapplyandthepriceperacre—footwhichisapplicabletothatyear.AnnualpaymentsforeachyearthereaftershallbemadebytheApplicantonorbeforeeachOctober1attherateperacre—footestablishedbytheBoardformunicipalwaterallotmentsinthatyear.Ifanannualpayment,ashereinprovided,isnotmadebyduedate,writtennoticethereof,bycertifiedmail,willbegivenbysaidDistricttotheApplicantatthefollowingaddress:p.o.Box1200,EstesPark,Colorado,80517.Ifpaymentisnotmadewithinthirty(30)daysafterthedateofsaidwrittennotice,Applicantshallhavenofurtherright,title,orinterestunderthiscontract;andtheallotmentofwater,ashereinmade,shallbedisposedofatthediscretionoftheBoardofDirectorsofsaidDistrict. 005.AssecuritytotheDistrict,theApplicantagreesthattheforegoingcovenantofannualpaymentswillbefullymetbyannualbudgetandappropriationoffundsfromsuchsourcesofrevenuesasmaybelegallyavailabletosaidApplicant.6.Applicantagreesthatthewaterallotmentshallbebeneficiallyusedforthepurposesandinthemannerspecifiedherein,andthatthisagreementismadefortheexclusivebenefitoftheApplicantandshallnotinuretothebenefitofanysuccessorsorassignsofsaidApplicantwithoutpriorspecificapprovaloftheBoardofDirectorsofsaidDistrict.7.ApplicantagreestobeboundbytheprovisionsoftheWaterConservancyActofColorado;bytheRulesandRegulationsoftheBoardofDirectorsofsaidDistrict;andbytheRepaymentContractofJuly5,1938,betweensaidDistrictandtheUnitedStatesandallamendmentsthereofandsupplementsthereto.8.Applicantagrees,asaconditionofthiscontract,toenterintoan“OperatingAgreement”withsaidDistrictifandwhentheBoardofsaidDistrictfindsanddeterminesthatsuchanagreementisrequiredbyreasonofadditionalorspecialservicesrequestedbytheApplicantandprovidedbytheDistrict.Saidagreementmaycontain,butnotbelimitedto,provisionforwaterdeliveryattimesorbymeansnotprovidedwithinthetermsofstandardallotmentcontractsoftheDistrict;additionalannualmonetaryconsiderationforextensionofDistrictdeliveryservicesandforadditionaladministration,operationandmaintenancecosts;orforothercoststotheDistrictwhichmayarisethroughprovisionofservicestotheApplicant.Section3:IntheoptionoftheBoardofTrusteesoftheTownofEstesPark,acquisitionofawaterallotmentcontractfromNorthernColoradoWaterConservancyDistrictandtherighttothebeneficialuseofwaterthereunderbysaidTownofEstesParkisnecessary;thatthecontinuedacquisitionanduseofwatersupplyisessentialforthewell-beingofthecommunityandforpreservationofthepublicpeace,health,andsafety;andthattheadequateprotectionofthehealthoftheinhabitantsofthecommunityrequiresanimmediateincreaseinApplicant’swatersupply.Itis,therefore,declaredthatanemergencyexists;thatthisordinanceshalltakeeffectasanemergencymeasureandthatitshallbepublishedinthemannerandshalltakeeffectasprovidedbythestatutesoftheStateofColorado.
