HomeMy WebLinkAboutORDINANCE 01-8900ORDINANCENO.1-89ANORDINANCEVACATINGAPORTIONOFAPUBLICROADWAYLOCATEDINUNIVERSITYHEIGHTSADDITION,ESTESPARK,COLORADOWHEREAS,Section43—2—303,C.R.S.,1973,providesthattheBoardofTrusteesoftheTownofEstesPark,Colorado,mayvacateanyroadwayorpartthereoflocatedwithinthecorporatelimitsoftheTown;andWHEREAS,theBoardofTrusteesoftheTownofEstesPark,Colorado,hasdeterminedthatitisinthebestinterestoftheTowntovacateaportionofaroadwaylocatedinUniversityHeightsAdditiontotheTownofEstesPark;andWHEREAS,thevacationofsaidportionoftheroadwaywillnotleaveanylandadjoiningsaidroadwaywithoutanestablishedpublicroadconnectingsaidlandwithanotherestablishedpublicroad.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARE,COLORADO:1.TheBoardofTrusteesoftheTownofEstesPark,Coloradoherebyvacates,pursuanttotheapplicableprovisionsofPart3ofArticle2ofTitle43,ColoradoRevisedStatutes,1973,thefollowingdescribedroadway:AportionoftheAlleybetweenLots5,6,7,8,9,and10ofUniversityHeightsAdditiontotheTownofEstesPark,Colorado,saidAdditionbeingintheSoutheastone—quarteroftheSouthwest 00 00one—quarterofSection30,Township5North,Range72Westofthe6thP.M.,beingmoreparticularlydescribedasfollows:AllthatportionofthealleylyingNorthoftheNorthlineextendedwesterlyofsaidLot5,lyingEastoftheWestlinesofsaidLots9and10,andlyingSouthofUniversityDrive.SaidalleyhavingbeendedicatedonthePlatofUniversityHeightsAdditiontotheTownofEstesPark,recordedonOctober28,1960inPlatBook7atPage115oftherecordsofLarimerCounty,Colorado.Thisordinanceshalltakeeffectandbeinforcethirty(30)daysafteritsadoptionandsubsequentpublication.TOWNOFESTESPARKBy:________MayorATTEST:CTownClerkIherebycertifythattheaboveordinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe______dayofLzLtjL.1989,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Colorado,onthec27dayOf),1989.TownClerk—2— 00
