Home My WebLink AboutORDINANCE 04-90o0ORDINANCENO.4-90ANORDINANCEAMENDINGTITLE17OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADO,BYPROVIDINGFORAMORATORIUMONCERTAINUSESOFLANDWITHINTHECDANDCOZONINGDISTRICTS,PENDINGCONSIDERATIONOFAMENDMENTSTOTITLE17WHEREAS,certainprovisionsofTitle17oftheMunicipalCodeoftheTownofEstesPark,Colorado,allowstheuseoflandswithintheCDDowntownCommercialDistrict,andtheCOOutlyingCommercialDistrictforcommercialamusementssubjecttothespecialreviewprocess;andWHEREAS,theTownBoardhasdeterminedthatitisnecessarytoreviewthepresentzoningcodewithregardtothelocationofcommercialamusementswithintheaforementioneddistricts;andWHEREAS,theTownBoardintendstorequestthePlanningCommissiontoprepare,includingbutnotlimitedto,alocationpolicyandstandardwithregardtocommercialamusementswithintheaforementionedzoningdistricts;andWHEREAS,itisnecessarytotemporarilyhaltfurtherapplicationforcommercialamusementswithintheCDandCODistrictsinordertoallowtheTowntoreviewthelocationofcommercialamusementswithintheaforementioneddistricts;andWHEREAS,theTownBoardhasdeterminedthatamoratoriumonreviewofcommercialamusementsintheaforementionedzoningdistrictsisnecessarytopromotethepublichealth,safetyandgeneralwelfare.—1— 00 CClNOW,THEREFOREBEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPAFUC,COLORADO:Section1.AmoratoriumonanynewapplicationsforcommercialamusementsintheCDDowntownCommercialDistrictandtheCOOutlyingCommercialDistrictisherebyimposeduntilJune27,1990.Section2.Thismoratoriummaybeextendedforadditionalninety(90)dayperiodsoftimebyactionoftheTownBoard,iftheTownBoardfindsthatsuchextensionisnecessaryfortheTownBoardtogivedueconsiderationtoanyproposedchangeofTitle17oftheMunicipalCode,thesamerelatingtocommercialamusements.Section3.ApplicationsforcommercialamusementusesshallnotbeacceptedorconsideredbytheTownduringthismoratorium.Section4.TheTownBoardshallhavethepowertograntaspecialexceptiontothismoratoriumwherethefollowingconditionsaremet:A.Awrittenapplicationforthespecialexceptionmustbesubmitted,indicatingthecommercialamusementusetobeprocessedandstatingwithparticularitythehardshipwhichtheapplicationwillsufferifthespecialexemptionisnotgranted.B.Withintwenty(20)daystheTownBoardshallholdaPublicHearingontheapplication.C.Noticeshallhavebeengivenatleastten(10)daysinadvanceofthisPublicHearing.D.Theapplicantoritsagentshallbenotifiedbymail.E.NoticeofsaidHearingshallbepostedonthepropertyandshallbepublishedintheEstesParkTrailGazetteatleastten(10)dayspriortothePublicHearing.F.TheTownBoardmaygranttheSpecialExceptionandordertheprocessingoftheapplicationthroughthenormalprocessofSpecialReviewunderTitle17oftheMunicipalCodeiftheTownBoardfindsallofthefollowing:(1).ThatthegrantingoftherequestisnecessarytopreventunduehardshipontheApplicant;and(2).Thatthegrantingoftherequestwillnotadverselyaffectthepublicinterestsofthepurposesofthismoratorium;and—2— 00—:1-4 Cl0(3).ThatprocessingoftherequestwouldbeproperandinaccordancewithalloftheordinancesandregulationsoftheTownofEstesParkwerethismoratoriumnotineffect.Section5.Ifanyarticle,section,paragraph,sentence,orclauseorphraseofthisOrdinanceisheldtobeunconstitutionalorinvalidforanyreason,suchdecisionshallnotaffectthevalidityofconstitutionalityoftheremainingportionsofthisOrdinance.TheTownBoardherebydeclaresthatitwouldhavepassedthisOrdinanceandeachpartandpartshereofirrespectiveofthefactthatanyonepartorpartsbedeclaredunconstitutionalorinvalid.Section6.TheadoptionofthisOrdinanceisherebydeterminedtobedeclaredanemergencyduetothefactthatitisnecessarytoimmediatelyimposethismoratoriumtoallowtheproposedreviewofthecurrentzoningwithregardtocommercialamusementswithintheCDandCoDistrictand;WHEREAS,intheopinionoftheBoardofTrustees,anemergencyexists,thisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,THIS13thDAYOFMARCH,1990.TOWNOFESTESPARKBy:______ATTEST:i1OWA)TOWNCLERKIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe/S’dayofMarch,1990,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthe/4dayofMarch,1990.ci_&aaJTownClerk—3— 00
