14-9000ORDINANCE14-90ANORDINANCEAMENDINGCHAPTER7OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADO,WITHREGARDTOPROVISIONSCONCERNINGANIMALS,INCLUDINGTHEIMPOUNDMENTTHEREOFBEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:section1.Section7.04.020oftheMunicipalCodeisamendedtoreadasfollows:7.04.020Animal.“Animal”meansanylivevertebratecreature,otherthanaplant,whetherdomesticatedorwild.section2.Section7.04.110oftheMunicipalCodeisamendedtoreadasfollows:7.04.110Neighborhood.“Neighborhood”meansanareawithin1,000feetofthepropertylineofthepropertywhereananimaliskeptormaintained.section3.Section7.04.120oftheMunicipalCodeisamendedbythedeletionofthissectioninitsentirety.section4.Section7.06.040oftheMunicipalCodeisamendedbythedeletionofthissectioninitsentirety.Section5.section7.08.010oftheMunicipalCodeisamendedtoreadasfollows:7.08.010Premiseskeptclean.Anypersonwhoownsorcontrolsanylot,barn,stable,shed,buildingorotherplacewhereanimalsarekept,shallkeepthebuildingandpremisesinacleanandsanitaryconditionandshallremoveallmanurefromthepremisesatleastonceeachweek.Section6.section7.08.030oftheMunicipalCodeisamendedtoreadasfollows:7.08.030Disturbanceofneighborhoodprohibited.A.Itisunlawfulforanypersontokeepormaintainanyanimalwithinthetownwhichhabituallyorcontinuouslydisturbsthepeaceandquietofanyindividualorneighborhoodbybarking,whining,howlingormakinganyothernoise.Itshallbepresumedthataresidentoroccupantofthepremisesuponwhichtheanimalislocatedisapersonkeepingormaintainingsuchanimal.B.Anyanimalwithinthetownwhichhabituallyorcontinuallydisturbsthepeaceandquietofanyindividualorneighborhoodbybarking,whining,howlingormakinganyothernoiseisapublic1 00 0nuisance.TheAnimalControlOfficerorapoliceofficerhasauthority,withoutliability,touseallreasonablemeanstoabatesuchpublicnuisance,includingtheauthoritytoenteruponprivatepropertytoimpoundsuchanimalwheretheownerorcustodianofsuchanimalisorappearstobeabsentfromthepremises;provided,however,thatthisauthoritydoesnotextendtoenteringtheowner’sorcustodian’sresidentdwelling.C.TheimpoundmentprovisionsofSection7.12.060and7.12.070ofthisCodeshallbeapplicableforallanimalsimpoundedpursuanttothissection.sectioni.section7.12.040oftheMunicipalCodeisamendedtoreadasfollows:7.12.040Dogsrunningatlargeprohibited.A.Everypersonowningorhavingcharge,care,custodyorcontrolofanydogshallkeepthedogexclusivelyuponhisownpremisesexceptthatthedogmaybeoffthepremisesifitisundertheeffectivecontrolofaperson.Thedogshallbeconstruedtobeundertheeffectivecontrolofapersonasfollows:1.Confinementwithinavehicle,fencing,orotheradequateenclosurewherethedoghasnoaccesstoapasserby;or2.Attachmenttoaleasenotoversixfeetinlengthandheldbyapersonofsufficientsizeandstrengthtorestrainthedog.B.NotwithstandingtheprovisionsofsubsectionAofthissection,adogshallbedeemedtobenotundereffectivecontrolofapersonasfollows:1.Everyfemaledoginpre—estrus,estrus,orpostestrus(inheatorinseason)shallbeconfinedinabuildingorsecureenclosureinsuchamannerthatthefemaledogcannotcomeintocontactwithamaledogexceptforplannedbreeding;or2.Thedoginflictsdamageorinjurytothepersonorpropertyofsomeoneotherthanitsowner,custodianorpossessor;or3.Adogistetheredonthepremisesofitsowner,custodianorpossessorsuchthatithasaccesstoapasserbyonapublicstreet,sidewalkorright-of-way.C.Nothinghereinshallrestricttheordinaryusesofseeing—eyedogs.Section8.Section7.12.060oftheMunicipalCodeisamendedtoreadasfollows:2 00 Ca7.12.060Impoundment--Noticeprocedure.Upontheimpoundmentofadog,thepolicedepartmentshallnotifytheownerorcustodianofthedogthatthedoghasbeenimpoundedandwillbereleaseduponproofthatthedogisproperlylicensed,uponpaymentofapoundservicefeeof$10.00,togetherwith$20.00forthefirstdayofimpoundmentand$10.00foreachdaythereafterforboardandkeep,andanyexpensesincurredforveterinarycareandtreatment;andthat,ifthedogisnotreleasedwithinfivedaysfromthedayofsaidnotice,itwillbedisposedofatthedirectionofthechiefofpolice.Thenoticeshallbedeliveredtosuchownerorcustodian,orifsuchownerorcustodianisnotavailable,bypostingsaidnoticeonthepremisesfromwhichthedogwasimpounded.Acopyofsaidnoticeshallalsobepostedinthelobbyofthepolicedepartmentsectionofthemunicipalbuilding.section.section7.12.100oftheMunicipalCodeisamendedtoreadasfollows:7.12.100Dutyregardingbitesfromanimals.A.Anypersonhavingknowledgethatananimalhasbittenahumanshallimmediatelyreporttheincidenttothepolicedepartment.B.Bitesfromrodents,rabbits,birdsandreptilesareexcludedfromthereportingrequirementsofthissection.C.Anyveterinarianwhoclinicallydiagnosesrabiesoranypersonwhosuspectsrabiesinadog,catorotheranimalshallimmediatelyreporttheincidenttothepolicedepartmentstatingexactlywheresuchanimalmaybefound.D.Adogorcatwhichhasbittenapersonshallbeimpoundedforaperiodoftendaysforrabiesobservationormaybetakenforobservationtoahospitaloraveterinarianforsaidten—dayperiod.suchconfinementshallbeattheexpenseoftheownerorcustodian.Theownerorcustodianofanydogorotheranimalthathasbeenreportedtohaveinflictedthebiteonanypersonshall,ondemand,producesaidanimalforimpoundmentasprescribedinthissection.E.Itisunlawfulforanypersontoremovefromanyplaceofconfinementanyanimalwhichhasbeenconfinedasauthorized,withouttheconsentofthepolicedepartment.F.Ifaknownorsuspectedrabidanimalbitesorattacksadomesticanimal,suchincidentshallalsobereportedasrequiredabove.sectionio.TheMunicipalCodeisamendedbytheadditionofChapter7.17toreadasfollows:7.17.010Permit.Anypersondesiringtodischargeanyweapon3 ()0 00aspartofaprogramforthecontrolorexterminationofanimalswhich,byreasonofburrowing,gnawing,carryingofdiseaseorotherwise,posesathreattohealthofpersonsorlivestockortoproperty,maymakeapplicationtotheboardoftrusteesforapermittodoso.7.17.020Application.Anapplicationforapermitunderthischaptershallcontainthefollowinginformationandexhibits:1.Nameandaddressofapplicant;2.Locationofanimalcontrolprogram;3.Natureandextentofanimal—controlproblem;4.Detailsofproposedanimal—controlprogram,includingexterminationmethod,timeperiod,hoursofoperation,safetyprecautionsanddisposalmethodstobeemployed;5.Names,addresses,agesandweaponsexperienceofallpersonswhowilldischargeweaponsduringtheanimal—controlprogram;6.certificateofinsurancefromaninsurancecompanyauthorizedtodobusinessinthestateofcolorado,showingthatthereisinsuranceinfullforceandeffectinsuringtheapplicant,allpersonswhowilldischargefirearmsinthecourseoftheanimal—controlprogram,andthetowninanamountnotlessthanfivehundredthousanddollarsintheaggregateperoccurrenceagainstanyandallliabilitywhichmaybeallegedorimposedonaccountofoperationoftheanimal—controlprogram.Saidcertificateshallcontainaclauserequiringthatthetownbegivenadvancewrittennoticeofcancellationofthepolicy.7.17.030Issuanceofpermit.Uponfindingthatananimal—controlprogramexistsandthattheanimal—controlprogramproposedbytheapplicantcontainsadequatesafeguardsforthepublichealthandsafety,andthattheapplicanthascompliedwithallprovisionsofthischapter,theboardoftrusteesmay,initsdiscretion,issueapermittotheapplicant,whichpermitshallsetforthanyspecialconditionsandrestrictionswhichtheboardoftrusteesdeemsnecessaryforthepublichealth,safetyandwelfare.7.17.040Otherlaws.Theissuanceofapermitshallnotoperatetoallowtheshootingofanyanimalsorthedischargeofanyweaponswhichisotherwiseprohibitedorcontrolledbycounty,stateorfederallaworregulations.7.17.050Revocationofpermit.Anypermitissuedpursuanttothischaptermayberevokedupontheviolationofanyofthespecialconditionsandrestrictionswhichareimposed,upontheviolationofanyoftheprovisionsofthischapter,upontheexpirationofanyinsurancecoveragerelieduponbytheapplicant4 0C) 00inhisapplication,upontheparticipationintheanimal-controlprogrambypersonsnotlawfullyauthorizedtoparticipateinthelawsofthestateofColorado,oruponconductbyanyofsuchpersonswhichconstitutesahazardtootherpersons,livestockandproperty.Thepermitmayberevoked,andoperationoftheanimal—controlprogrammaybehalted,pendingahearingontherevocationofthepermitbytheboardoftrustees,byanypoliceofficerofthetownwhohasreasonablegroundstobelievethattheanimal—controlprogramisbeingoperatedinamannerwhichconstitutesanimmediatethreattothehealth,safetyandwelfareofpersons,livestockandproperty.Foranyothercause,thepermitmayberevokedonlyafterhearingbytheboardoftrustees,atwhichtimetheapplicantshallbegiventheopportunitytoappearandtopresentevidenceafterbeinggivennoticeofsuchhearing.sectionii.Chapter9.98oftheMunicipalCodeshallbedeletedinitsentirety.section12.Thisordinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRU,TEESOFTHETOWNOFESTESPARK,COLORADO,THIS______DAYOF_______________,1990.TOWNOFESTESPARK,COLORADO/By:4L4tMayorATTEST:TownClerkIherebycertifythattheaboveordinancewasintroducedandreadameetirgoftheBoardofTrusteesonthe///dayof____1990,andpublishedinanewspaperofgenqalpublicatipnintheTownofEstesPark,Colorado,onthe/.LOCidayof__________________,1990.TownClerk5
