08-90aORDINANCENO.8-90ANORDINANCEAMENDINGTITLE17OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADO,THESAMEPERTAININGTOZONINGFORTHETOWNOFESTESPARKWHEREAS,theFederalEmergencyManagementAgencyhaspromulgatedchangestotheNationalFloodInsuranceProgramFloodPlainCriteria;andWHEREAS,theTownofEstesParkissubjecttosuchchanges.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.Section17.08.030(7)oftheMunicipalCodeoftheTownofEstesPark,Colorado,isamendedtoreadasfollows:“Areaofspecialfloodhazard”meansthatlandinthefloodplainwithinEstesParksubjecttoaonepercentorgreaterchanceoffloodinginanygivenyear.Section2.Section17.08.030(11)oftheMunicipalCodeoftheTownofEstesPark,Colorado,isamendedtoreadasfollows:“Baseflood”meansthefloodhavingaonepercentchanceofbeingequalledorexceededinagivenyear.Section3.Section17.28.015isamendedtoaddthefollowingdefinitions:C.“Existingmanufacturedhomeparkorsubdivision”meansamanufacturedhomeparkforwhichtheconstructionoffacilitiesforservicingthelotsonwhichthemanufacturedhomesaretobeaffixed(including,ataminimum,theinstallationofutilities,constructionofstreets,andeitherfinalsitegradingorthepouringofconcretepads)arecompletedbeforetheeffectivedateofthisordinance.D.“Expansiontoexistingmanufacturedhomeparkorsubdivision”meansthepreparationofadditionalsitesbytheconstructionoffacilitiesforservicingthelotsonwhichthemanufacturedhomesaretobeaffixed(includingthe 00 00installationofutilities,theconstructionofstreets,andeitherfinalsitegradingorthepouringofconcretepads)E.“Newmanufacturedhomeparkorsubdivision”meansamanufacturedhomeparkorsubdivisionforwhichtheconstructionoffacilitiesforservicingthelotsonwhichthemanufacturedhomesaretobeaffixed(includingataminimum,theinstallationofutilities,theconstructionofstreets,andeitherfinalsitegradingorthepouringofconcretepads)iscompletedonoraftertheeffectivedateoffloodplainmanagementregulationsadoptedbyEstesPark,Colorado.Section4.Section17.28.016shallbemadeanadditiontotheMunicipalCodeoftheTownofEstesPark,Colorado,andshallreadasfollows:17.28.016Basisforestablishingtheareasofspecialfloodhazard.TheareasofspecialfloodhazardidentifiedbytheFederalEmergencyManagementAgencyinascientificandengineeringreportentitled,“TheFloodInsuranceStudyfortheTownofEstesPark,Colorado,datedMay4,1987,withanaccompanyingFloodInsuranceRateMap(FIRM),isherebyadoptedbyreferenceanddeclaredtobeapartofthisordinance.”TheFloodInsuranceStudyandFIRMareonfileattheMunicipalBuilding,170MacGregorAvenue,EstesPark,Colorado.Section5.Section17.28.017shallbemadeanadditiontotheMunicipalCodeoftheTownofEstesPark,Colorado,andshallreadasfollows:17.28.017DutiesandResponsibilitiesoftheBuildingInspector.DutiesoftheBuildingInspectorshallinclude,butnotbelimitedto:1.Reviewalldevelopmentpermitstodeterminethatthepermitrequirementsofthisordinancehavebeensatisfied.2.ReviewalldevelopmentpermitstodeterminethatallnecessarypermitshavebeenobtainedfromFederal,State,orlocalgovernmentalagenciesfromwhichpriorapprovalisrequired.3.Reviewalldevelopmentpermitstodetermineiftheproposeddevelopmentislocatedinthefloodway.Iflocatedinthefloodway,assurethattheencroachmentprovisionsofChapter17.28aremet.Section6.Section17.28.150isamendedtoreadasfollows:—2— 00 0017.28.150Administration.Thischaptershallbeadministeredbythebuildinginspector.Itshallbethedutyofthebuildinginspectortoobtainandmaintainrecordsoflowestfloorelevationsandfloodproofinglevelsforallneworsubstantiallyimprovedstructures,andwhetherornotsuchstructurescontainbasements.Suchrecordsshallbeplacedonrepositoryforpublicinspectionduringnormalbusinesshoursat170MacGregorAvenue,EstesPark,Colorado.Itshallalsobethedutyofthebuildinginspectorto:1.NotifyadjacentcommunitiesandtheappropriateStateofficespriortothealterationorrelocationofariverorwatercourse.2.Requirethatmaintenanceisprovidedwithinthealteredorrelocatedportionofsaidwatercoursesothatthefloodcarryingcapacityisnotdiminished.CopiesofallsuchnotificationsshallbesubmittedtotheFederalEmergencyManagementAgency.Thebuildinginspectorshalluseallavailablefloodplaininformationanddataservicestoaidintheadministrationofthischapter.Section7.Section17.28.130isamendedbyaddingthefollowing:M.ConstructionMaterialsandMethods.1.Allnewconstructionandsubstantialimprovementsshallbeconstructedwithmaterialsandutilityequipmentresistanttoflooddamage.2.Allnewconstructionandsubstantialimprovementsshallbeconstructedusingmethodsandpracticesthatminimizeflooddamage.N.SubdivisionProposals.1.Allsubdivisionproposalsshallbeconsistentwiththeneedtominimizeflooddamage.2.Allsubdivisionproposalsshallhavepublicutilitiesandfacilitiessuchassewer,gas,electrical,andwatersystemslocatedandconstructedtominimizeflooddamage.3.Allsubdivisionproposalsshallhaveadequatedrainageprovidedtoreduceexposuretoflooddamage.4.Basefloodelevationdatashallbeprovidedforsubdivisionproposalsandotherproposeddevelopment—3— 00whichcontainatleast50lotsor5acres(whicheverisless)0.ManufacturedHomes.1.Manufacturedhomesshallbeanchoredinaccordancewiththischapter.2.Allmanufacturedhomesorthosetobesubstantiallyimproved,shallconformtothefollowingrequirements:a.Requirethatmanufacturedhomesthatareplacedorsubstantiallyimproved(i)inanexpansiontoanexistingmanufacturedhomeparkorsubdivision,or(ii)inanexistingmanufacturedhomeparkorsubdivisiononwhichamanufacturedhomehasincurred“substantialdamage”astheresultofaflood,beelevatedonapermanentfoundationsuchthatthelowestfloorofthemanufacturedhoneiselevatedtoorabovethebasefloodelevationandbesecurelyanchoredtoanadequatelyanchoredfoundationsystemtoresistflotation,collapse,andlateralmovement.b.Requirethatmanufacturedhomestobeplacedorsubstantiallyimprovedonsitesinexistingmanufacturedhoneparksorsubdivisionsthatarenotsubjecttotheprovisionsin(a)abovebeelevatedsothateither(i)thelowestfloorofthemanufacturedhomeisatorabovethebasefloodelevation,or(ii)themanufacturedhomechassisissupportedbyreinforcedpiersorotherfoundationelementsthatarenolessthan36inchesinheightabovegradeandbesecurelyanchoredtoanadequatelyanchoredfoundationsystemtoresistflotation,collapse,andlateralmovement.Section8.Section17.28.160isamendedbyaddingthefollowing:D.Novarianceshallbegrantedwithintheregulatoryfloodwayifthebasefloodlevelwillbeincreased.Section9.TheBoardofTrusteesoftheTownofEstesPark,Colorado,herewithfinds,determines,anddesignatesthatthisordinanceisnecessaryfortheimmediatepreservationofthepublicpeace,healthandsafety,inordertocomplywiththe—4—
