CC)ORDINANCENO.7-90ANORDINANCEEXTENDINGAMORATORIUMONCERTAINUSESOFLANDWITHINTHECDANDCOZONINGDISTRICTS.WHEREAS,onMarch13,1990,theBoardofTrusteesoftheTownofEstesParkadoptedOrdinanceNo.4-90,whichimposedamoratoriumuntilJune27,1990onapplicationsforcommercialamusementsintheCDDowntownCommercialDistrictandtheCOOutlyingCommercialDistrictoftheTownofEstesPark;andWHEREAS,saidOrdinanceprovidedthatthemoratoriummaybeextendedforadditionalninety(90)dayperiodsbyactionoftheTownBoard;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthataninety(90)dayextensionisnecessaryfortheTownBoardtogivedueconsiderationtoaproposedchangeofTitle17oftheMunicipalCode,thesamerelatingtocommercialamusements,and;WHEREAS,theTownBoardhasdeterminedthattheextensionofthemoratoriumonreviewofcommercialamusementsintheaforementionedzoningdistrictsisnecessarytopromotethepublichealth,safetyandgeneralwelfare.NOWTHEREFOREBEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.ThemoratoriumimposedbyOrdinanceNo.4—90onMarch13,1990isherebyextendedforanadditionalninety(90)dayperiodthroughSeptember25,1990. •.7.-.--..1-j..--...]cCH.•-TI•i•4•••J-rr••00 CC)Section2.AlloftheothertermsandconditionsofOrdinanceNo.4—90willremaininforceandeffectduringthemoratoriumperiod.Section3.Ifanyarticle,section,paragraph,sentence,orclauseofthisOrdinanceisheldtobeunconstitutionalorinvalidforanyreason,suchdecisionshallnotaffectthevalidityorconstitutionalityoftheremainingportionsofthisOrdinance.TheTownBoardherebydeclaresthatitwouldhavepassedthisOrdinanceandeachpartandpartshereofirrespectiveofthefactthatanyonepartorpartsbedeclaredunconstitutionalorinvalid.Section4.TheadoptionofthisOrdinanceisherebydeclaredanemergencyduetothefactthatitisnecessarytoinunediatelyextendthismoratoriumtoallowtheproposedreviewofthecurrentzoningwithregardtocommercialamusementswithintheCDandCODistrictand;WHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,THIS26thDAYOFJUNE,1990.TOWNOFESTESPARKBy:_____MayorATTEST:iaTownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe0adayofJune,1990,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Colorado,onthe02adayofJune,1990.TownClerk—2— 0C)r.1—.—J3.——I—--•-3-.•C•(I.3-.y
