08-91aCL’tORDINANCENO.8-91ANORDINANCEAMENDINGCHAPTER17OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARKREGARDINGZONINGBEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.Section17.16.060SpecialC—Odistrictrequirementsshallbeamendedtoreadasfollows:A.Noprincipaluseshallbeallowedoutsideofabuilding,exceptthosepermittedusesapprovedthroughspecialreview.B.Alloutdoormaterialandstorageareasshallbeseparatedfromstreetandpropertylinesbyaplantingareaatleastfivefeetwide,containingdenseplanting,andoptionally,asight—imperviousfenceorwall.C.Outdoormaterialandstorageareasshallnotbepermittedonlotsabuttinganarterialstreet.Section2.Section17.20.010(B)(1)ParkingAreaLocationandDesignshallbeamendedtoreadasfollows:B.ParkingAreaLocationandDesign.1.Location.Requiredparkingshallbeeitheronthesamepremisesastheactivityitserves,oronaseparateparceliftheparcelislocatedwithinthreehundredfeetofthebuildingentrancetobeservedandisinazoningdistrictallowingtheactivityitserves.Allparkingareasshallbeseparatedfromarterialstreetlinesbyaplantingareaatleasttwenty-fivefeetwideandfromotherstreetlinesbyaplantingareaatleastfifteenfeetwide,andpropertylinesbyaplantingareaatleastfivefeetwide,containingdenseplantingand,optionally,afenceorwall.Separatingmaterialsshallbeatleasttwofeethighinitially,andshallbearrangedandmaintainedtoprotectvisibilityatanydriveways.Allparkingareasshallbesetbacktenfeetfromthehighwatermarkofallriverbanksandwalls.Section3.Section17.24.020(C)(I)&(J)Plantingrequirementsshallbeamendedasfollows:C.StreetPlantingArea.Streetplantingisrequiredforallpremisesabuttinganarterialstreet,butnotintheC—DDistrict.Propertyabuttinganarterialstreetshallprovideaplantingbufferofnotlessthantwenty—fivefeetindepthalong 00theentirestreetfrontage.Inaddition,propertyintheR-MandC—ODistrictsabuttinganon—arterialstreetshallprovideastreetplantingbufferofnotlessthanfifteenfeetindepthalongtheentirestreetfrontage.Bermingshallalsobeincorporatedintheplantingbuffer.Withinthestreetplantingbuffer,thereshallbenodevelopment,parkingordrives,exceptforaccesstotheportionofthesitenotinthebuffer,whichisapproximatelyperpendiculartotheright—of—way,undergroundutilityinstallation,pedestrianandbicyclepaths,allowablesigns,andnecessarylighting.I.Maintenance.Allplantmaterialsrequiredbythistitleshallbemaintainedinahealthfulcondition.Deadlimbsshallbepromptlyremoved,anddeadplantsshallbereplacedattheearliestappropriateseason.Alllandscapedareasshallbeirrigated.J.Installation.AllrequiredplantingshallbeinstalledpriortoissuanceofaCertificateofOccupancy,ortheinstallationguaranteedwithanapprovedimprovementguarantee.Section4.Section17.36.030(B)(D)&(F)SpecialReviewProceduresshallbeamendedtoreadasfollows:B.Submittal.AllapplicationsforausepermittedbyspecialreviewshallbesubmittedinwritingtotheTownplanneronanapplicationfurnishedbyhim.TheapplicantshallsubmitawrittenstatementofintentspecificallyaddressingthecriteriainSection17.36.030,F.,1through5.TheburdenshallbeontheapplicanttodemonstratetothePlanningCommissionandBoardofTrusteesthatthedevelopmentasproposedmeetsalloftheapplicablecriteriainSection17.26.030,F.,1through5.TheapplicationwillbereviewedbythePlanningCommissionatitsnextmeetingifsubmittedtwenty—oneormoredayspriortothen,andifsubmittalsaredeterminedbytheTownPlannertobecompletepriortothatmeeting.D.PlanningCommissionReview.ThePlanningCommissionshallreviewtheapplicationandshallreporttotheBoardofTrusteesregardingeachoftheconsiderationscitedinsubsectionFofthissection,subdivisions1through5,notlaterthanthirty—fivedaysfollowingthemeetingatwhichtheapplicationisfirstreviewed.ThePlanningCommissionmayrecommendapproval,approvalwithconditions,ordenialoftheapplication.F.BoardofTrustees’Action.TheBoardofTrusteesshalltakeactionontheapplicationfollowingitshearingconsideringthereportofthePlanningCommissionandthetestimonyreceivedatthehearing.TheBoardshallapprove,approvewithconditions,ordisapprovetheapplicationwithinsixtydaysfollowingtransmittalofthePlanningCommission’sreport.—2— UCApplicationsshallbeapprovedonlyupontheBoardofTrustees’determinationthattheproposal’sbenefitstotheTownwilloutweighanyadverseeffectsfortheTownorthevicinity,afterconsiderationofthefollowing:1.Suitabilityoftheproposedlocationforthisproposal,takingintoconsiderationthefollowingwherevergermane:a.Nearbylanduses,andwhethertheywouldbesupportedordamagedbyhavingtheproposedusenearby.b.Adequacyofroads,water,sewerageanddrainagefacilitiesservingthelocation.c.Environmentalcharacteristicsofthesiteandrelatedareas,andtheconsequencesofthedevelopmentasproposedforpublicsafetyandthenaturalenvironment.2.Thebuildingandsitedesign,andhowwellthey:a.Avoidvisual,noise,orotherintrusionintoadjacentpremisesordeparturefromtheestablishedcharacterofthevicinity.b.Avoidunnecessarydamagetothenaturalenvironmentthroughdesignadaptationtotheparticularitiesofthesite.3.Thesocial,economic,orcommunityneedswhichareservedbytheproposal;4.Consistencywithdistrictobjectivesasstatedinthistitle;5.Suitabilityofthespecificproposeddevelopmentrelativetotheareascontaininghistoricresourcestominimizedamagetothoseresourcesforfutureuse.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO,THIS9thDAYOFAPRIL,1991.TOWNOFESTESPARKBy:____MayorATTEST:TownClerk—3—
