01-91C)CORDINANCENO.1-91ANORDINANCEAMENDINGCHAPTER5.20,OFTHEMUNICIPALCODEOFTHETOWNOFESTESPARK,COLORADO,REGARDINGOCCUPATIONLICENSES.WHEREAS,theTownofEstesPark,Colorado,(theTown)isauthorizedtolicense,regulateandtaxanylawfuloccupation,businessorprofessionandfixtheamount,termsandmannerofissuingandrevokinglicensesissuedtherefore,pursuanttoSection31—15—501(1)(c)C.R.S.;andWHEREAS,theTownhasdeterminedthatthenatureofthefollowingoccupations,businessesandprofessions,includingaccommodationsandtherelationofsuchbusinessestotheMunicipalwelfare,aswellastherelationthereoftotheexpendituresrequiredbytheTownrequiresthateachseparateoccupation,businessorprofessionshallbesubjecttoalicensefeefortheprivilegeofcarryingonsaidbusiness,professionandoccupationwithintheTown;andWHEREAS,theTownhasdeterminedthattheclassificationofthefollowingoccupations,businessesandprofessions,includingaccommodationsisreasonablyproper,uniformandnon—discriminatoryandthattheamountofthelicensefeeimposedbythisChapterisreasonablyproperandnon—discriminatoryandnecessaryforajustandproperdistributionofMunicipalcostsandobligationswithintheTown.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.Chapter5.20oftheMunicipalCodeisamendedinitsentiretyasfollows:5.20.010Definitions.InthisChapter,thefollowingwordsandphrasesshallhavethefollowingmeanings:Person:Anyindividual,firm,partnership,jointventure,corporation,estateortrust,receiver,trustee,assignee,lesseeoranypersonactinginafiduciaryorrepresentativecapacity,whetherappointedbyaCourtorotherwise,oranygrouporcombinationoftheaboveactingasaunit,andincludesapluralaswellasasingularnumber.Owner:Thepersonowninganybusiness,professionoroccupation.Intheeventthattheownerisanon—residentorcannotbelocatedbytheTown,theoperator,managerorlesseeofanysuchbusiness,professionoroccupationshallbedeemedanownerforallpurposesofthisChapter. 00Accommodation:Theleasing,rental,orfurnishingofanyroom,mobilehomesite,recreationalvehiclesite,campsiteorotheraccommodationinanyhotel,motel,guesthouse,bedandbreakfast,apartment,dormitory,mobilehomepark,recreationalvehicleparkorcampground,oranysuchsimilarplacetoanypersonwho,foraconsideration,uses,possessesorhastherighttouseorpossesssuchroom,siteorotheraccommodationforatotalcontinuousdurationoflessthan30days.AccommodationUnit:Eachindividualroom,setofrooms,site,ordividedarearented,leasedoroccupiedonaunitbasisinanaccommodation.HomeOccupation:Abusiness,professionoroccupationconductedwithinorfromadwellingbyaresidentthereofasanaccessoryusetotheresidentialuseofthedwelling.Non—residentOccupation:Abusiness,professionoroccupationwhosebusinesspremiseislocatedoutsidethecorporatelimitsoftheTownbutisotherwisesubjecttothetermsofthisChapter.CommunitySpecialEvents:Anyeventatwhichabusiness,professionoroccupationisconductedwheregoods,wares,merchandise,serviceortheperformingorrenderingofservice,forchargeisconductedorsponsoredbyanon—profitassociationororganization.5.20.020OccupationLicenseFee.Thereisherebyimposedanoccupationlicensefeeontheprivilegeofcarryingonorengaginginanybusiness,professionoroccupationwithintheTown,whichbusiness,professionoroccupationconsistsofthesellingofgoods,wares,merchandiseorservice;theperformingorrenderingofservice,forcharge;theleasing,renting,orfurnishingofaccommodationunits;andthecarrying.onorengaginginanyhomeoccupation,non—residentoccupation,orcommunityspecialevent.5.20.030AmountofLicenseFee.Theoccupationlicensefeeissetforthasfollows:A.Accommodations;5unitsorless$150.00peryear6to20units260.00peryear21unitsormore375.00peryear—2— 0QB.Allotheroccupations,including,butnotlimitedtoHomeOccupation,Non—residentOccupationandCommunitySpecialEvents—$200.00peryear5.20.040OccupationLicense.Everypersonwhoistheownerofanybusiness,professionoroccupationwhichissubjecttotheoccupationlicensefeesetforthinthisChapter,shallobtainanoccupationlicensefromtheTownpriortotheengaginginanybusiness,professionoroccupationwithintheTown.5.20.050FormofTheLicense,Non-Transferability.Eachoccupationlicenseshallbenumberedandshallshowthename,andplaceofthebusinessofthelicenseeandshallbepostedinaconspicuousplaceonthebusinesspremiseforwhichitisissued.Nolicenseshallbetransferable.Section5.20.060PaymentofLicenseFee.A.Theownerofeachbusiness,professionoroccupation,subjecttotheprovisionsofthisChapter,shallpaytheoccupationlicensefeeforeachcalendaryearinwhichtheyengageinanybusiness,professionoroccupationwithintheTown.SaidfeeshallbedueandpayableonorbeforeJanuary20thofeachcalendaryear.AnylicensefeewhichisunpaidasofJanuary20thofeachyear,shallbearinterestattherateofeighteen(18%)perannumuntilpaid.B.Anybusiness,professionoroccupationwhichbeginsitsbusinessduringacalendaryearshallpaythelicensefeeforthatportionofthecalendaryear,baseduponthedateofopeningofthebusiness,professionoroccupation.Thelicensefeeshallbeproratedbasedupontheopeningdateofsaidbusiness.Saidlicensefeeshallbedueandpayableontheopeningdate,andanoccupationlicenseshallbeobtainedbytheownerofthebusiness,professionoroccupationpriortosaidopening.5.20.070Violation.ItshallbeaviolationofthisChapterforanownerofabusiness,professionoroccupationoranypersonsubjecttotheoccupationlicensefeeimposedhereintofailorrefusetomakepaymenttotheTownofsaidfeeorinanyothermannertoevadethecollectionandpaymentofthefeeoranypartthereofimposedbythisChapter.5.20.080RevocationofLicense.TheTown,aftergivingwrittennoticetotheownerofanybusiness,occupationorprofessionwhohaseitherfailedtopaythefeeorpartthereofdue,mayrevokethelicenseofsaidowner.Uponrevocationofthelicense,theowners’rightandprivilegetoconductthebusiness,professionoroccupationwithintheTownisterminated.—3— 0Ct5.20.090ReinstatementofLicense.IfanoccupationlicensehasbeenrevokedbytheTown,theownerofanybusiness,professionoroccupationwishingtoreinstatesaidlicensemayapplytotheTownforreinstatement,tenderingwithsaidapplicationthetotalfeedue,includingallinterestthereon.5.20.100Inspections.TheTownshallbeentitledatanytime,uponreasonablenoticetotheownerofanybusiness,profession,oroccupation,toinspectthepremisesoccupiedbythebusiness,professionoroccupationforthepurposeofascertainingcompliancewiththetermsandconditionsofthisChapter.Intheeventthatsuchinspectionrevealsthattheoccupationlicensefeechargedtosaidbusiness,professionoroccupationisinfacterroneous,anadjustmentshallbemadebytheTownofthelicensefee.5.20.110ChapterExceptions.TheprovisionsofthisChaptershallnotapplytoanybusiness,professionoroccupationlicensedunderanyotherTownordinanceandpayingalicensefeetoengageinsuchbusiness,professionoroccupation,otherthansalestaxlicenses,nortoanybusiness,professionoroccupationpayinganotheroccupationlicensefeeortaxtotheTown.Section2.Ifanysection,paragraph,clauseorprovisionofthisOrdinanceshallforanyreasonbeheldtobeinvalidorunenforceable,theinvalidityorunenforceabilityofsuchsection,paragraph,clauseorprovisionshallnotaffectanyoftheremainingprovisionsofthisOrdinance,theintentbeingthatthesameareseverable.Section3.TheeffectivedateofthisOrdinanceshallbeFebruary12,1991.AlllicensefeessetforthinthisOrdinanceshallbedueandpayableinfullforthecalendaryear1991.SaidfeesshallbedueandpayableonorbeforeMarch20,1991.Intheeventthatanybusiness,professionoroccupationhaspaidanylicensefeesfor1991,theamountofsaidpaymentshallbecreditedtothelicensefeesdueunderthetermsandprovisionsofthisOrdinance.Section4.TheadoptionofthisOrdinanceisherebydeclaredanemergencyduetothefactthatitisnecessarytoimmediatelyimposetheabovestatedOccupationLicenseFeeand;WHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.—4—
