04-920aORDINANCENO.4-92ANORDINANCECONCERNINGTHETOWNOFESTESPARK’SDISPOSITIONOFUNCLAIMEDPROPERTYWHEREAS,certainpropertyheldbyorunderthecontroloftheTownofEstesParkisownedbyanindividualorentityandmaybeunclaimedbytheowner;andWHEREAS,theTownofEstesParkdesirestoestablishanadministrativeprocedurefornotificationand,wherepossible,transferofunclaimedpropertytotheowner;andWHEREAS,theTownofEstesParkdesirestodisposeofunclaimedpropertyafternotificationhasbeenprovided;andWHEREAS,thislocalprocedureforadministrationanddispositionofunclaimedpropertyisauthorizedpursuanttoSection31—13—104(1)C.R.S.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOPESTESPARK,COLORADO:Section1.Purpose:ThepurposeofthisOrdinanceistoprovideforthelocaladministrationanddispositionofunclaimedpropertywhichisinthepossessionoforunderthecontroloftheTownofEstesPark.Section2.Definitions:Unlessotherwiserequiredbycontractoruse,wordsandtermsaretobedefinedforthepurposeofthisOrdinanceasfollows:A.UnclaimedProperty:Anytangibleorintangibleproperty,includinganyincomeorincrementderivedtherefrom,lessanylawfulcharges,thatisheldbyorunderthecontroloftheTownofEstesParkandwhichhasnotbeenclaimedbyitsownerforaperiodofmorethanone(1)yearaftersaidpropertyhasbecomepayableordistributable.Unclaimedpropertyincludes,butisnotlimitedtothefollowing:1.Depositsforelectricservice.2.Overpaymentonutilityservices.3.Uncashedpayrollchecks.4.Moneyorpropertyfrompoliceseizure. CC5.LostandfoundmoneyorpropertydepositedwiththeTown,includingweaponsleftwiththePoliceDepartment.6.UnclaimedappearancebondsinMunicipalCourt.B.Town:TheTownofEstesPark,Colorado.C.Owner:Thepersonorentity,includingacorporation,partnership,association,governmentalentity,otherthantheTown,orthedulyauthorizedlegalrepresentativeorsuccessorininterestofthesame,whichownsunclaimedpropertyheldbytheTown.D.FinanceOfficer:TheTown’sFinanceOfficerordesigneethereof.Section3.ProcedureforDispositionofProperty:A.Priortodispositionofanyunclaimedpropertyhavinganestimatedvalueof$50.00ormore,theFinanceOfficershallsendawrittennoticebycertifiedmail,returnreceiptrequested,tothelastknownaddress,ifany,ofanyownerofunclaimedproperty.ThelastknownaddressoftheownershallbethelastaddressoftheownerasshownbytherecordsoftheTowndepartmentoragencyholdingtheproperty.Thenoticeshallincludeadescriptionoftheproperty,theamountorestimatedvalueoftheproperty,and,whenavailable,thepurposeforwhichthepropertywasdepositedorotherwiseheld.Thenoticeshallstatewheretheownermaymakeinquiryoforclaimtheproperty.ThenoticeshallalsostatethatiftheownerfailstoprovidetheFinanceOfficerwithawrittenclaimforthereturnofthepropertywithinsixty(60)daysofthedateofthenotice,thepropertyshallbecomethesolepropertyoftheTownandanyclaimoftheownertosuchpropertyshallbedeemedforfeited.B.Priortodispositionofanyunclaimedpropertyhavinganestimatedvalueoflessthan$50.00orhavingnolastknownaddressoftheowner,theFinanceOfficershallcauseanoticetobepublishedinanewspaperofgeneralcirculationintheTown.Thenoticeshallincludeadescriptionoftheproperty,theowneroftheproperty,theamountorestimatedvalueofthepropertyand,whenavailable,thepurposeforwhichthepropertywasdepositedorotherwiseheld.Thenoticeshallstatewheretheownermaymakeinquiryorclaimtheproperty.ThenoticeshallalsostatethatiftheownerfailstoprovidetheFinanceOfficerwithawrittenclaimforthereturnofthepropertywithinsixty(60)daysofthedateofthepublicationofthenotice,thepropertyshallbecomethesolepropertyoftheTownandanyclaimoftheownertosuchpropertyshallbedeemedforfeited.—2— 00C.IftheFinanceOfficerreceivesnowrittenclaimwithintheabovesixty(60)dayclaimperiod,thepropertyshallbecomethesolepropertyoftheTownandanyclaimoftheownertosuchpropertyshallbedeemedforfeited.D.IftheFinanceOfficerreceivesawrittenclaimwithinthesixty(60)dayclaimperiod,theFinanceOfficershallevaluatetheclaimandgivewrittennoticetotheclaimantwithinninety(90)daysthereofthattheclaimhasbeenacceptedordeniedinwholeorinpart.TheFinanceOfficermayinvestigatethevalidityofaclaimandmayrequestfurthersupportingdocumentationfromtheclaimantpriortodisbursingorrefusingtodisbursetheproperty.E.Intheeventthatthereismorethanoneclaimantforthesameproperty,theFinanceOfficermay,intheFinanceOfficer’ssolediscretion,resolvesaidclaims,ormayresolvesuchclaimsbydepositingthedisputedpropertywiththeregistryoftheDistrictCourtinaninterpleaderaction.F.Intheeventthatallclaimsfiledaredenied,thepropertyshallbecomethesolepropertyoftheTownandanyclaimoftheownerofsuchpropertyshallbedeemedforfeited.G.AnylegalactionfiledchallengingadecisionoftheFinanceOfficershallbefiledpursuanttoRule106oftheColoradoRulesofCivilProcedurewithinthirty(30)daysofsuchdecisionorshallbeforeverbarred.Ifanylegalactionistimelyfiled,thepropertyshallbedisbursedbytheFinanceOfficerpursuanttotheorderoftheCourthavingjurisdictionoversuchclaim.Section4.PoliceandFirePensionBenefits.TheprovisionsofthisOrdinanceshallapplytoanyunclaimedpropertyheldbytheTownasabenefitundertheTown’sPoliceand/orFirePensionFund,unlesstheowner,withinthree(3)yearsafterithasbecomepayableordistributable,hascommunicatedconcerningtheunclaimedproperty,orotherwiseindicateaninterestasevidencedbyamemorandumorotherrecordonfilewiththeTown.TheprovisionsofSection3,hereof,shallbefollowedwithregardtoprocedurefordispositionofsaidunclaimedpropertyfromthePoliceand/orFirePensionFundoftheTown.Section5.saleorDispositionofProperty.A.AtanytimeafteranyunclaimedpropertybecomesthesolepropertyoftheTown,pursuanttotheprovisionsofSection3ofthisOrdinance,theFinanceOfficermay,inhissolediscretion,sellsaidpropertyatapublicorprivatesalewithoutnotice.ThepurchaserofsaidpropertyatanysaleconductedbytheFinanceOfficer,pursuanttothissection,takes—3— 00 00thepropertyfreeofallclaimsoftheownerorpreviousholderthereofandallpersonsclaimingthroughorunderthem.TheFinanceOfficershallexecutealldocumentsnecessarytocompletethetransferofownershiptothepurchaser.B.TheFinanceOfficermay,inhissolediscretion,atanytimefollowingthedateuponwhichanyunclaimedpropertyshallbecomethesolepropertyoftheTown,destroyordisposeofanyunclaimedpropertyatanytime.NoactionorproceedingmaybeobtainedagainsttheTownortheFinanceOfficer,onaccountofanyactiontakenbytheFinanceOfficer,pursuanttothissection.Section6.TheadoptionofthisOrdinanceisherebydeclaredanemergencyduetothefactthatitisnecessarytoadoptanUnclaimedPropertyOrdinancepriortoJuly1,1992and;WHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDADOPTEDBYTHETRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS0%hDAYOFJUNE,1992.TOWNOFESTESPARKBy:______MayorATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe2’—dayofJune,1992,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,ColoradoonthejzedayofJune,1992.32C’(i-,’TownClerk—4—
