Home My WebLink AboutORDINANCE 20-930C)ORDINANCENO.20-93ANORDINANCEADDINGCHAPTER9.20TOTHEMUNICIPALCODEOFTHETOWNOFESTESPARKWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisnecessarytoaddanewchapter9.20totheMunicipalCodeoftheTownofEstesPark.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.TheMunicipalCodeoftheTownofEstesParkisamendedbytheadditionofchapter9.20asfollows:9.20.010UnderagePossessionandconsumptionofEthylAlcohol.A.Itisunlawfulforanypersonundertwenty-one(21)yearsofageto:1.Obtainorattempttoobtainanyethylalcoholbymisrepresentationofageorbyanyothermethodinanyplacewhereethylalcoholissold;or2.Possessanyethylalcoholinanystore,inanypublicplace,includingpublicstreets,alleys,roadsorhighwaysoruponpropertyownedbytheStateofColoradooranysubdivisionthereof,orinsidevehicleswhileuponthepublicstreets,alleys,roadsorhighways;or3.PossessanyethylalcoholanywhereintheTownofEstesPark,Colorado,otherthanthoselocationsspecifiedinsubsectionA.2.ofthissection;or4.ConsumeethylalcoholanywhereintheTownofEstesPark,Colorado.9.20.020violationsandDefenses.A.violationofanyprovisionofsubsectionAofSection9.20.010shallbeastrictliabilityoffense.ItshallbeanaffirmativedefensetotheoffensesdescribedinsubsectionA.2.throughA.4.ofSection9.20.010,abovethattheethylalcoholwaspossessedorconsumedbyapersonundertwenty-oneyears(21)ofageunderthefollowingcircumstances:1.Whilesuchpersonwaslegallyuponprivatepropertywiththeknowledgeandtheconsentoftheownerorlegalpossessorofsuchprivatepropertyandtheethylalcoholwaspossessedorconsumedwiththeconsentofhisparentorlegalguardianwhowaspresentduringsuchpossessionorconsumption;or C.)C 0C:)2.Whentheexistenceofethylalcoholinaperson’sbodywasduesolelytotheingestionofaconfectionerywhichcontainedethylalcoholwithinthelimitsprescribedbySection25-5-410(1)Ci)(II),C.R.S.ortheingestionofanysubstancewhichwasmanufactured,designedorintendedprimarilyforapurposeotherthanoralhumaningestion,ortheingestionofanysubstancewhichwasmanufactured,designedorintendedsolelyformedicinalorhygienicpurposes,orsolelyfromtheingestionofabeveragewhichcontainedlessthanone-halfofonepercentofethylalcoholbyweight;3.ThepossessionorconsumptiontakesplaceforreligiouspurposesprotectedbytheFirstAmendmenttotheUnitedStatesConstitution.9.20.030Evidence.A.Primafacieevidenceoftheviolationof9.20.010ofthissectionshallconsistof:1.Evidencethatthedefendantwasundertheageoftwenty-oneC2l)yearsandpossessedorconsumedethylalcoholanywhereintheTownofEstesPark,Colorado;or2.Evidencethatthedefendantwasundertheageoftwenty-one(21)yearsandmanifestedanyofthecharacteristicscommonlyassociatedwithethylalcoholintoxicationorimpairmentwhilepresentanywhereintheTownofEstesPark,Colorado.B.Duringanytrialforaviolationofaprovisionofthischapter,anybottle,canoranyothercontainerwithlabelingindicatingthecontentsofsuchbottle,canorcontainershallbeadmissibleintoevidence,andtheinformationcontainedonanylabelonsuchbottle,canorothercontainershallbeadmissibleintoevidenceandshallnotconstitutehearsay.Thefactfindermayconsidertheinformationuponsuchlabelindeterminingwhetherthecontentsofthebottle,canorothercontainerwerecomposedinwholeorinpartofethylalcohol.Alabelwhichidentifiesthecontentsofanybottle,canorothercontaineras“beer,”“ale,”“maltbeverage,”“fermentedmaltbeverage,”“maltliquor,”“wine,”“champagne,““whiskey,““gin,““rum,““armangnac,““vodka,“tequila,““schnapps,”“brandy,”“cognac,”“liqueur,”“cordial,”“alcohol,“or“liquor”shallconstituteprimafacieevidencethatthecontentsofthebottle,canorothercontainerwascomposedinwholeorinpartofethylalcohol.9.20.040Definitions.Asusedinthissection,unlessthecontextotherrequires:A.“Ethylalcohol”meansanysubstancewhichisorcontainsethylalcoholandincludesfermentedmaltbeverage,maltliquor,vinousliquorandspirituousliquorasdefinedintheColoradoBeerCodeandColoradoLiquorCode. CC) 00B.“Possessionofethylalcohol”meansthatapersonhasorholdsanyamountofethylalcoholanywhereonhisperson,orthatapersonownsorhascustodyofethylalcohol,orhasethylalcoholwithinhisimmediatepresenceandcontrol.C.“Privateproperty”meansanydwellinganditscurtilagewhichisbeingusedbyanaturalpersonornaturalpersonsforhabitationwhichisnotopentothepublic,andprivatelyownedrealpropertywhichisnotopentothepublic.PrivatepropertyshallnotincludeanyestablishmentwhichhasorisrequiredtohavealicensepursuanttoArticle46,47or48ofTitle12,C.R.S.,oranyestablishmentwhichsellsethylalcoholoruponwhichethylalcoholissoldoranyestablishmentwhichleases,rentsorprovidesaccommodationstomembersofthepublicgenerally.9.20.050Sentencing.A.Immediatelyuponapleaofguiltyornocontest(exceptwhensuchapleaisenteredinconjunctionwithadeferredsentence),oraverdictofguiltybythecourtorjury,toaviolationofsubsectionsA.1.orA.2.ofSection9.20.010,inadditiontoanyotherpenalty,theCourtshallrequiretheoffendertoimmediatelysurrenderhisdriver’s,minordriver’sorprovisionaldriver’slicense,totheCourt.TheCourtshallforwardtotheColoradoDepartmentofRevenueanoticeofconviction,togetherwiththeoffender’slicense,notlaterthanten(10)daysaftertheconvictionbecomesfinal.B.ItisunlawfulforanypersontofailtosurrenderhislicensetotheCourtwithinthree(3)daysofhispleaofguiltyornocontest,orverdictofguiltytoaviolationofsubsectionA.1.orA.2.orsection9.20.010.C.TheCourtmay,initsdiscretionandaspartofthesentencetobeimposed,requireapersonconvictedofviolatinganyportionofthissectiontocompletecourt-approvedpublicserviceinanamounttobesetbytheCourt.Section2.ThisOrdinanceshalltakeeffectandbeinforcethirtydaysafteritsadoptionandsubsequentpublication.PASSEDANDADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS07.31tJ.DAYOFNOVEMBER,1993.TOWNOFESTESPARKBy:______Mayor CC 00ATTEST:c-c•TownClerkIherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe31tdayofNovember,1993,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthe&-dayofNovember,1993.TownClerk C)a
