00ORDINANCENO.15-93ANORDINANCEAPPROVINGTHEANNEXATIONOFCERTAINTERRITORYTOTHETOWNOFESTESPARK,COLORADO,TOBEKNOWNANDDESIGNATEDASLAKEESTESADDITIONBEITORDAINEDBYTHEBOARDOFTRUSTEESOFESTESPARK,COLORADO:Section1.ThataPetitionforAnnexation,togetherwithfour(4)copiesoftheplatofsaidareaasrequiredbylaw,wasfiledwiththeBoardofTrusteesonthe27thdayofJuly,1993,bythelandownersofonehundredpercent(100%)oftheareaandowningonehundredpercent(100%)ofthearea,excludingpublicstreetsandalleys,oftheareahereinafterdescribed.TheBoard,byResolutionatitsregularmeetingonthe27thdayofJuly,1993,acceptedsaidPetitionandfoundanddeterminedthattheprovisionsofSection31—22—107(1)(g),C.R.S.,weremet;andtheBoardfurtherdeterminedthatapublichearingshouldbeheldonSeptember15,1993,at7:30P.M.intheMunicipalBuildingforthepurposesofdeterminingthattheproposedannexationcomplieswiththeapplicableprovisionsofSection31—12—104and31—12—105,C.R.S.,andisconsideredeligibleforannexation.Section2.ThattheNoticeofsaidhearingwasgivenandpublishedasprovidedinSection31—12—108(2),C.R.S.Section3.ThatthehearingwasheldpursuanttotheprovisionsofSection31—12—109,C.R.S.,onthe19thdayofSeptember,1993.Section4.Thatfollowingsaidhearing,theBoardofTrusteesadoptedaResolutiondeterminingthattheproposedannexationmettherequirementsoftheapplicablepartsofSection31—12—104and31—12—105,C.R.S.;thatanelectionwasnotrequiredunderSection31—12-107(2),C.R.S.;andthatnoadditionaltermsorconditionsaretobeimposeduponsaidannexation.Section5.ThattheannexationofthefollowingdescribedareadesignatedasLAKEESTESADDITIONtotheTownofEstesPark,isherebyapproved:PropertylocatedintheNWkofSection29,Township5North,Range72Westofthe6thP.M.,LarimerCounty,Colorado,beingmoreparticularlydescribedasfollows:BeginningattheNorthwestcornerofSectionTwenty-nine(29),TownshipFive(5)North,RangeSeventy—two(72)WestoftheSixthPrincipalMeridian;thenceSouth1°19’West 00 00alongtheSectionline577.5feet;thenceNorth600051East246feet;thenceSouth61°07’East112.3feet;thenceNorth41°02’East90feet;thenceNorth45°01’West119.3feet;thenceNorth23°17’West120.4feet;thenceNorth88°23’West20feet;thenceNorth1°19East241.5feetmoreorless,totheNorthlineofsaidSectionTwenty—nine(29);thenceWesterlyalongtheNorthlineofsaidSection209.6feet,moreorless,tothepointofbeginning.AlsodescribedasthatportionoftheNW,Section29,T5N,R72W,LarimerCounty,ColoradodescribedastheNorthwesterly2.96acresofsaidNW.knownasNo.TBD,EstesPark,CO.80517.Section6:TheTownofEstesPark,Colorado,herebyconsents,pursuanttoSection37—45—126(3.6)C.R.S.totheinclusionoflandsdescribedaboveintotheNorthernColoradoWaterConservancyDistrictandtheMunicipalSubdistrict,NorthernColoradoWaterConservancyDistrict.Section7.ThisOrdinanceshalltakeeffectandbeenforcedthirty(30)daysafteritsadoptionandpublication.TOWNOFESTESPARK%jJM’âyorATTEST:TownClerkIherebycertifythattheaboveOrdinancewasintroducedand,sg,readatAa4egularmeetingoftheBoardofTrusteesonthe1-3-th-dayofj1993andpublishedinanewspaperofgeneralcircuAationintheTownofEstesPark,Coloradoonthee2.dayof4LpJJ.osAtkJ,1993,allasrequiredbythestatutesoftheStateofColorado.TownClerk—2— 0
