HomeMy WebLinkAboutORDINANCE 02-94C2ORDINANCENO.2-94ANORDINANCEAPPROVINGTHEANNEXATIONOFCERTAINTERRITORYTOTHETOWNOFESTESPARK,COLORADO,TOBEKNOWNANDDESIGNATEDASTHEKENOFERADDITIONBEITORDAINEDBYTHEBOARDOFTRUSTEESOFESTESPARK,COLORADO:Section1.ThataPetitionforAnnexation,togetherwithfour(4)copiesoftheplatofsaidareaasrequiredbylaw,wasfiledwiththeBoardofTrusteesonthe14dayofDecember,1993,bythelandownersofonehundredpercent(100%)oftheareaandowningonehundredpercent(100%)ofthearea,excludingpublicstreetsandalleys,oftheareahereinafterdescribed.TheBoard,byResolutionatitsregularmeetingonthe14thdayofDecember14,1993,acceptedsaidPetitionandfoundanddeterminedthattheprovisionsofSection31-12—107(1)(g)C.R.S.,weremet;andtheBoardfurtherdeterminedthatapublichearingshouldbeheldonJanuary25,1994,at7:30P.M.intheMunicipalBuildingforthepurposesofdeterminingthattheproposedannexationcomplieswiththeapplicableprovisionsofSection31—12—104and31—12—105,C.R.S..,andisconsideredeligibleforannexation.Section2.ThattheNoticeofsaidhearingwasgivenandpublishedasprovidedinSection31—12—108(2),C.R.S.Section3.ThatthehearingwasheldpursuanttotheprovisionsofSection31—12—109,C.R.S.,onthe25thdayofJanuary,1994.Section4.Thatfollowingsaidhearing,theBoardofTrusteesadoptedaResolutiondeterminingthattheproposedannexationmettherequirementsoftheapplicablepartsofSection31—12—104and31—12—105,C.R.S.;thatanelectionwasnotrequiredunderSection31—12—107(2),C.R.S.;andthatnoadditionaltermsorconditionsaretobeimposeduponsaidannexation.Section5.ThattheannexationofthefollowingdescribedareadesignatedastheKENOFERADDITIONto•theTownofEstesPark,isherebyapproved:PropertylocatedinSection25,Township5North,Range73Westofthe6thP.M.,LarimerCounty,Colorado,moreparticularlydescribedascommencingatapoint100feetWestoftheNortheastcorneroftheSoutheastoftheSouthwestofsaidSection25,saidpointbeingtruepointofbeginning;thenceWestalongtheNorthlineoftheSoutheastoftheSouthwestaofsaidSection25,a
