12-9500ORDINANCENO.12-95ANORDNANCECREATINGPARKENTRANCEESTATESSPECIALIMPROVEMENTDISTRICTNO.95-1,INTHETOWNOFESTESPARK,COLORADO;ORDERINGTHECONSTRUCTIONANDINSTALLATIONTHEREINOFCERTAINPUBLICIMPROVEMENTS;ADOPTINGDETAILSANDSPECIFICATIONSTHEREFOR;PROVIDINGFORANELECTIONREGARDINGTHEISSUANCEOFBONDSNPAYMENTFORSAIDPUBLICIMPROVEMENTS;ANDPROVIDINGFOROTHERDETAILSNCONNECTIONWITHTHEDISTRICT.WHEREAS,pursuanttoandinaccordancewithTitle31,Article25,PartS,C.R.S.,therehasbeensubmittedtotheTownBoard(the“Board”)oftheTownofEstesPark(the“Town”)petitionsfrompropertyownersforcertainpublicimprovementsandforthecreationofaspecialimprovementdistrict(the“Petitions”);andWHEREAS,theBoardpreviouslyhasmadeafindingthatthePetitionswerepresentedinaccordancewithlawandthattheyweresignedbyownersofpropertytobeassessedformorethanone-halfofthetotalcostsoftheimprovementstobeassessedineachoftheassessmentunits;andWHEREAS,theTownhasdeterminedandherebyfmdsthatapublichearingwasdulynoticedandheldaccordingtolawonAugust8,1995,at7:30p.m.,andsuchhearingresultedinnoobjections;andWHEREAS,theTownherebydeterminesthataspecialimprovementdistrictshouldbecreated,thatthepublicimprovementspetitionedforshouldbeconstructed,installed,andacquiredthereininthemannersetforthinthatcertainresolutionadoptedbytheBoardonJuly11,1995(the“Resolution”);andWHEREAS,theengineerfortheproposedspecialimprovementproject,whoistheTownEngineer,haspreparedandfiledpreliminaryplans,specifications,estimatesofcost,maps,andschedulesfortheproposedimprovementsandtheBoardhasenteredanorderapprovingsuchproposedimprovements;andWHEREAS,inaccordancewithSection31-25-503(3),C.R.S.,theTownengineerhassubmittedtotheBoardadetailedestimateofthetotalcostoftheimprovementsandadetailedestimateofcostforeachimprovementincludedwithintheDistrict,exclusiveofincidentalcosts,#103912—2— 00 C0whichestimatesarenotbindingupontheTownforanypurpose;fludetailsandspecificationsfortheproposedconstruction,whichsaiddetailsandspecificationsshallpermitandencouragecompetitionamongbidders;andamapshowingtherealpropertytobeassessedforthecostofconstruction;andWHEREAS,thisOrdinancehasbeenpreparedandisherebysubmittedtotheBoard,authorizingthecreationofaspecialimprovementdistrictandtheconstructionofthepublicimprovementsproposedtobeconstructedtherein;THETOWNOFESTESPARK,COLORADO,ORDAINS:Section1.CreationofDistrict.PursuanttoTitle31,Article25,Part5,C.R.S.,andthePetitionandtheResolution,aspecialimprovementdistrictfortheconstructionandinstallationofcertainlocalwaterdistributionsystemimprovementsandlocalroadwayimprovements(the“Project”),isherebycreatedandestablished,andshallbeknownanddesignatedas“ParkEntranceEstatesSpecialImprovementDistrictNo.95-1”(the“District”).Section2.BoundaryofDistrict.ThelandwithintheDistrictshallconsistoftherealpropertydescribedasfollows:LEGALDESCRIPTIONParkEntranceEstatesAdditiontotheTownofEstesPark,LarimerCounty,ColoradoSection3.DescriptionofProject.TheProjectandthematerialstobeusedwillconsistofthefollowing:DescrintionofProject(a)localwaterdistributionsystemimprovementsusingprimarilyductileironpipe,whichincludebutarenotlimitedtotheimprovementofthewaterdistributionsystemwithinBlock2oftheParkEntranceEstatesSubdivision,includingtheremovalof#103912—3— CC) CCthecurrentwaterdistributionsystemandtheinstallationofanewwaterdistributionsystem;and(b)localroadwayimprovementsusingprimarilyasphalt,whichincludebutarenotlimitedtotheimprovementofallpublicstreetswithintheParkEntranceEstatessubdivisionexceptSunriseLanefromitsintersectionwithMeadowCircleandValleyViewDrivefromitsintersectionwithHeinzParkway,includingwidening,paving,andinstallationofappropriatedrainagefacilities.TheimprovementsandestimatedassessmentsaredescribedinmoredetailinthepreliminaryengineeringreportonfileintheofficeoftheTownEngineer.Section4.ApprovalofEngineeringPlans.Theengineeringreports,togetherwiththepreliminarydetails,specifications,estimatesofcost,maps,andschedulespreparedandfiledwiththeBoard,areherebyapprovedandadopted.Section5.ProjectAuthorized.TheProject,asshownbytheplans,specifications,andmapspreparedbytheengineerandapprovedbytheBoard,andnowonfileintheofficeoftheTownEngineer,isherebyauthorizedandordered.Section6.CostofProject:MethodofAssessment.TheestimatedtotalcostoftheProjectisFiveHundredThousandDollars($500,000),plusanamountnotexceedingone-halfofonepercent(.50%)additionalforcostsofcollectionoftheassessmentsandTenThousandDollars($10,000)forincidentals,allofwhichwillbederivedfromassessmentsagainstrealpropertyincludedwithintheDistrict.ItisanticipatedthattheTownwillpayone-halfofthematerialcostsoftheasphalttobeusedinthelocalroadwayimprovements.TheTownwillnotpayanyotherpartofthecostoftheProjectexcepttotheextentthatanassessmentismadeagainstpropertyownedbytheTown.Themethodofassessmentofcostshallbeonanequal,per-lotbasis.Section7.PaymentofAssessments.Theassessmentswillbedueandpayablewithoutdemandwithinthirty(30)daysfromandafterthefinalpublicationoftheOrdinanceassessingthewholecostoftheProjectagainsttherealpropertyintheDistrict.Intheeventanyownerofrealpropertyshallfailtopaythewholeofsuchassessmentagainsthisorherpropertywithinsaidthirty(30)days,thenthewholecostoftheProjectsoassessedagainstsuchpropertyshallbepayablein#103912—4— CC 00notmorethanten(10)equalannualinstallmentsofprincipal.Thefirstofsuchinstallmentsofprincipalshallbedueandpayablesuccessivelyonthesamedayineachyearthereafter,untilallarepaidinifill.Therateofinteresttobepaidonunpaidanddeferredinstallmentsshallbeataratenotexceeding8.0%perannum,andwillbeestablishedbyanordinancetobeadoptedbytheBoard.Section8.SpecialAssessmentBonds:Election.ByvirtueofandpursuanttoSection31-25-505,C.R.S.,aspecialelectionshallbeheldwithintheboundariesoftheDistricttoauthorizetheissuanceofspecialassessmentbondsoftheTownforthepurposeofpayingthecostoftheProject,inanamountnottoexceedthecostandexpensesoftheProject,includingengineering,legal,andincidentalexpenses,asprovidedbylaw.ThebondsshallbeissuedbaseduponestimatesapprovedbytheBoard,andasauthorizedbythequalifiedelectorsvotingintheelectionandbyanordinancetobepassedbytheBoard.ThemaximumneteffectiveinterestrateofthebondsfortheDistrictshallnotexceed7.50%perannum.ThebondsandtheinterestthereonshallbepayablesolelyoutofspecialassessmentstobeleviedagainsttherealpropertyincludedwithintheDistrictandspeciallybenefitedbytheProject,orfromffinds,ifany,remainingintheconstructionfindafterthepaymentofallcostsandexpensesoftheconstructionoftheimprovements.Section9.ConstructionContracts.TheactionsoftheappropriateofficersoftheTowninobtainingbidstoconstructtheProjectinaccordancewiththerequirementsofthepetitionandtheengineeringreportareherebyratified.SuchbidshavebeensolicitedinthetimeandmannerrequiredbyTitle31,Article25,Part5,C.R.S.Section10.SpecialBenefits.TheBoardherebyfindsanddeterminesthattheProjectwillconferaspecialbenefituponthepropertywithintheDistrict.Section11.FindingsandDeclarationsastoPetitionsandPublicHearing.TheBoardherebyfindsanddeterminesthatthePetitionswerepresentedinaccordancewithlaw,thattheyweresignedbytheownersofpropertytobeassessedformorethanone-halfofthetotalcostoftheimprovementtobeassessedineachoftheassessmentunits,andthatafterduenoticetothepublicapublichearingwasheldandanyandallcomplaintsandobjectionsmadeinwritingtotheTownregardingthecreationoftheDistrictwereheardandresolvedbytheBoard.Section12.Rcpealer.Allacts,orders,ordinances,orresolutions,orpartsthereof,inconflictherewith,areherebyrepealedtotheextentofsuchconflict.#103912 00Section13.Severability.ShouldanyoneormoresectionsorprovisionsofthisOrdinancebejudiciallydeterminedinvalidorunenforceable,suchdeterminationshallnotaffect,impair,orinvalidatetheremainingprovisionshereof,theintentionbeingthatthevariousprovisionshereofareseverable.Section14.RecordingandAuthentication.ThisOrdinance,immediatelyonitspassage,shallberecordedintheTownBookofOrdinanceskeptforthatpurpose,shallbeauthenticatedbythesignaturesoftheMayorandTownClerk,andshallbepublishedinaccordancewithlaw.Section15.EffectiveDate.ThisOrdinanceshallbeeffective,inaccordancewithlaw,thirtydaysfollowingitsfinaladoptionbytheBoard.rNTRODUCED,READANDADOPTEDataregularmeetingoftheBoardonAugust8,1995,andorderedpublishedinaccordancewithlaw.(SEAL)MayorATTESTED:q:TownClerkFormendorsedby:-ite,Esq.,TownAttorney#103912—6—
