0ORDINANCENO24-95ANORDINANCEAUTHORIZINGTHEPURCHASEBYTHETOWNOFESTESPARKOFAWATERSTORAGETANKSITENON-EXCLUSIVEWATERLINECONNECTIONEASEMENTANDTEMPORARYCONSTRUCTIONEASEMENTSWHEREAS,theTownofEstesPark,aMunicipalCorporation,hereinafterreferredtoas(“theTown”)andtheYMCAOFTHEROCKIES,hereinafterreferredtoas(“YMCA”)haveanagreementforthepurchaseofaWaterStorageTankSite,Non-ExclusiveWaterLineConnectionEasementandTemporaryConstructionEasements;andWHEREAS,pursuanttothepowergrantedtotheTownbySection31-15-708C.R.S.,theBoardofTrusteesoftheTownofEstesPark,ColoradohaveagreedtothepurchaseofsaidWaterStorageTankSite,Non-ExclusiveWaterLineConnectionEasementandTemporaryConstructionEasementsonsuchtermsandconditionsassetforthintheAgreement.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.Section1.ThepropertyshallbeacquiredbytheTownpursuanttothetermsoftheAgreementassetforthonExhibit“A”.Section2.TheappropriateofficialsoftheTownofEstesParkareherebyauthorizedtoexecutealldocumentsnecessarytoclosethepurchaseoftheWaterStorageTankSite,Non-ExclusiveWaterLineConnectionEasementandTemporaryConstructionEasements.Section3.TheadoptionofthisOrdinanceisherebydeclaredtobeanemergencyduetotheneedtoclosethistransactionimmediately,and;WHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignaturebytheMayor.PASSEDMWADOPTEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOTHIS14thDAYOFNovember,1995.TOWNOFESTESPARKBY:_________________MayorATTEST:IkQQTownClerk(Deputy) 00 00IherebycertifythattheaboveOrdinancewasintroducedandreadatameetingoftheBoardofTrusteesonthe14thdayofNov.,1995,andpublishedinanewspaperofgeneralcirculationintheTownofEstesPark,Coloradoonthel7thdayofNov.1995.I&-k11_QTownClerk(Deputy)I,TinaKuehl,DeputyTownClerkoftheTownofEstesPark,Colorado,doherebycertifythattheattachedisatruecopyofOrdinance#24—95,authorizingthepurchasebytheTownofEstesParkofawaterstoragetanksitenon—exclusivewaterlineconnectioneasementandtemporaryconstructioneasements(YMCA),whichisonfileinmyofficeaspartoftheofficialrecordsoftheTownofEstesPark,Colorado,whichareinmycustody.-jKSTinaKuehlDeputyTownClerkDatedthis14thdayofNovember,1995.(SEAL) 00
