HomeMy WebLinkAboutORDINANCE 07-970•0ORDINANCENO.7-97ANORDINANCEVACATINGAPUBLICSTREETKNOWNASl3FAIRWAYDRIVEWHEREAS,theownersofthepropertyabuttingl3FairwayDrivehaverequestedthattheTownvacatethisstreetastheownershaveresubdividedtheabuttingpropertiesandprovidedpublicstreetaccesswhichremovedtheneedforpublicstreetaccesson13thFairwayDrive;andWHEREAS,thereisnolongeranynecessitytohavepublicstreetaccessinthelocationof13thFairwayDrive;andWHEREAS,itisnecessarytoreservepublicutilityanddrainageeasementsinthevacatedstreet;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisinthebestinterestsoftheTowntopermanentlyabandonandvacatel3FairwayDrive,reservingpublicutilityanddrainageeasements.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.TheBoardofTrusteesoftheTownofEstesPark,Coloradoherebyvacates13thFairwayDrivefromitsintersectionwithBrodieAvenuetoitssouthernterminuswheresaidstreetislocatedontheAmendedPlatofThirteenthFairwaySubdivision,TownofEstesPark,Colorado.Section2.TheTownherebyreservesoverthevacatedportionof13thFairwayDriveapermanentutilityanddrainageeasement.Section3.TheTownsurrendersanyandallright,titleandinterestto13thFairwayDrive,subjecttothereservationsetforthinSection2above.Section4.TheadoptionofthisOrdinanceisherebydeclaredanemergencyinordertoimmediatelyapprovethepublicstreetvacationassociatedwiththeAmendedPlatofThirteenthFairwaySubdivision,andWHEREAS,itistheopinionoftheBoardofTrusteesthatanemergencyexistsandtheOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor. 0C) C0PASSEDANDADOPTEDBYTHEBOARDOFTRUTEESOFTHETOWNOFESTESPARK,COLORADO,THIS_______DAYOF,<(‘4Lt,1997.TOWNOFESTESPARK,COLORADOfayorATTEST:jLC1ct1C6a’TownClerkIherebycertifythattheaboveordinancewasintroducedandreadat.ameetingoftheBoardofTrusteesonther-dayof___________________1997,andpublishedinanewspaperofgeneralputhicatiorjintheTownofEstesPark,Colorado,onthe//trdayof4/,&.c-C-1997.C[TownClerk 0C
