C0ORDINANCE4-97ANORDINANCEVACATINGANEASEMENTLOCATEDONLOT2,STANLEYKNOLLSUBDIVISIONOFTRACT2STANLEYADDITIONTOTHETOWNOFESTESPARK,COLORADOWHEREAS,theBoardofTrusteesoftheTownofEstesPark,Colorado,hasdeterminedthatitisinthebestinterestoftheTowntovacateaneasementoverandthroughthefollowingdescribedproperty.Lot2StanleyKnollSubdivisionofTract2StanleyAdditiontotheTownofEstesPark,ColoradoNOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.1.TheBoardofTrusteesoftheTownofEstesPark,Coloradoherebyvacatesthefollowingdescribedeasement:EasementcontainedinNoteonPlatofStanleyKnollSubdivisionofTract2,StanleyAdditiontotheTownofEstesPark,whichstates:AgeneraleasementacrossLot2shallbeallowedforconstructionandmaintenanceofpublicfacilitiesandpedestrianaccesstoLots1and3.Section2.TheTownherebysurrendersanyandallright,titleandinteresttosaideasement.Section3.TheadoptionofthisOrdinanceisherebydeclaredandemergencyduetothefactthatitisnecessarytovacatetheeasementinordertoclosethepurchaseoftheKnollpropertybytheEstesParkUrbanRenewalAuthorityonorbeforeFebruary19,1997;andWHEREAS,itistheopinionoftheBoardofTrusteesthananemergencyexistsandthisOrdinanceshalltakeeffectandbeenforcedimmediatelyafteritspassage,adoptionandsignatureoftheMayor.PASSEDANDADOPTEDBYTHEBOARDESTESPARK,COLORADOTHISf-DAYOFATTEST:TownClerkTRUSTEESOFTHETOWNOF1997. 00
