HomeMy WebLinkAboutRESOLUTION 19-91CGRESOLUTIONNO.19-91WHEREAS,theTownofEstesParkoperatesamunicipalwatersystemthatsupplieswatertoconsumerswithinandwithoutthecorporatelimits;andWHEREAS,certainwateruserswithintheEstesParkareaaresuppliedbywaterthroughvariousprivatewatersystemsanddistricts;andWHEREAS,theTownhasbeenapproachedbyvariousprivatesupplierstoreceivewaterfromtheTown;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatinordertoadequatelyrespondtotheseinquiries,itisnecessarytoadoptapolicyforbothwatermainextensionstoprivatewatersystemsandpurchasesofprivatewatersystems.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.1.TheTownpolicyforwatermainextensionstoprivatewatersystemsandtheTownpolicyforpurchasesofprivatewatersystems,asismorefullysetforthonExhibit“A”attachedheretoandincorporatedhereinbythisreference,isherebyadopted.2.ThepoliciessetforthonExhibit“A”aremerelypoliciesoftheTownofEstesParkandareinnowayacontracturalobligationoftheTown.3.ThepoliciessetforthonExhibit“A”maybeterminated,amended,orinanyothermannerchanged,atanytimebyactionoftheBoardofTrustees.INTRODUCED,READANDPASSEDTHIS<Q%LtDAYOF‘-:12,;Xç&1991.TOWNOFESTESPARKBy:________________ATTEST:1TL0TownClerk 0-4r_-—C40:(0C;---r 00TOWNOFESTESPARKPRIVATEWATERSYSTEMSMAINEXTENSIONANDPURCHASEPOLICYTOWNPOLICYFORWATERMAINEXTENSIONSTOPRIVATEWATERSYSTEMS1.TheTownwillconsiderfinancingandconstructingawatermainextensiontoprivateWaterSystemsexistingasofJanuary1,1991underthefollowingconditions:A.Atthedateofthewaterlineextensionrequest,theTowndoesnotcurrentlyservetheWaterSystem.B.Apreliminarycostestimateandfeasibilitystudy,preparedbytheTown,indicatesthatthewaterlineextensioniseconomicallyfeasibleconsideringexistingandfutureTownbudgets,methodsoffinancing,numbersofpossiblecustomersandprobableusage.ThePublicWorksCommitteeshallreviewthecostestimateandfeasibilitystudyandiftheCommitteeauthorizesfurtherconsiderationofsaidextension,thefollowingconditionsareapplicable.1.TheWaterSystemwillagreetopayforaWaterLineMasterPlanfortheinternalwaterdistributionsystem.SaidMasterPlanshallbepreparedbyanengineeringfirm,pursuanttoacontractwiththeTown.2.TheWaterSystemagreestoexecuteanagreementwiththeTowninsuringthattheTownwillbe100%reimbursedforalladministrative,engineeringandconstructioncostsassociatedwiththeextension.Thereimbursementperiodwillbeamaximumoftenyearsandthereimbursementwillinclude0%interest.ThereimbursementplanshallbepreparedbytheWaterSystem,subjecttoTownapproval.3.Allpropertytobeserved,includingfutureserviceareasshallsignanapplicationforawatertapoutsidetheTownlimitswhichshallincludeanagreementtoannex,unlesssaidprovisioniswaivedbytheTown. —.:.j1•-.1——-I:S.’H.-:•r0-...7I‘•‘1in.0-Si:1I,*II•.—•5,;it..•-:;.•4,.:•..I’.•,;S’-•-,fl.,•.o-•..‘1.’-:1r.’-•‘-:••:‘(-.••..•••.•V•.‘‘Ii•.,••.•,..I.I---•.•C.‘•-lj-•,Hgun’-••Jj••2••H.‘., CaIOWNPOLICYFORPURCHASESOFPRIVATEWATERSYSTEMS1.TheTownwillconsiderthepurchaseoftheassetsofprivateWaterSystemsunderthefollowingconditions:A.Awatermain,adequatelysizedtoservetheexistingdemandplustheproposedsystem’sfuturedemand,islocatedwithinareasonableandfeasiblewaterlineextensiontotheWaterSysteminquestion.B.ThewatersystemhasbeenbuilttoTownstandardsand/orisinaconditionacceptabletotheTown.C.TheTownwilldeterminetheassets,liabilitiesandotherpertinentfactorsconcerningtheWaterSystem.SaidreviewoftheWaterSystemwillformthebasisforthebeginningofnegotiationsbetweentheWaterSystemandtheTownforpurchaseoftheassetsoftheWaterSystem.—2— 0C)-r4r.jLi11•.0——lC,_2A,-c-’1,tfl½
