Prepared 04/29/2020 *Revised 1       2 TOWN ATTORNEY’S OFFICE Memo To: Honorable Mayor Koenig Board of Trustees From: Town Attorney Kramer Date: May 1, 2020 RE: An Emergency Ordinance Requiring Face Coverings in Places of Public Accommodation and Outdoors in the Commercial Downtown Zoning District (Mark all that apply) PUBLIC HEARING ORDINANCE LAND USE CONTRACT/AGREEMENT RESOLUTION OTHER______________ QUASI-JUDICIAL YES NO Objective: Require face coverings in Town in places where they are not yet required by state or county orders, but where social distancing is difficult to maintain, so as to inhibit the spread of COVID-19. Present Situation: Visitation to the Town is increasing and will imminently increase greatly as state and county orders lift and the weather warms. But face coverings are not yet required in many high-congregation areas in Town. Proposal: Require facial coverings outdoors in the Commercial Downtown zoning district, as well as in places of public accommodation throughout town. Advantages: Reduce the spread of COVID-19. Disadvantages:  Enforcement efforts would be required. These are expected to focus on education and voluntary compliance. Staff would undertake an extensive communication and education campaign involving signage and correspondence with businesses. As with any ordinance, law enforcement would have discretion to address violations with either warnings or citations, depending on the situation.  The County has not yet issued an order responding to Safer at Home or involving masks. Because such an order may be forthcoming, this ordinance risks considerable 3 public confusion with regard to inconsistent requirements. Remedial public messaging would be required. Duplication of efforts could also result. Furthermore, the Town cannot unilaterally require face coverings on the Lake Estes Trail, because most of the trail lies within the County’s jurisdiction. Town staff would need to discuss with the County the potential for implementing similar restrictions in this area. Action Recommended: Whether to adopt the ordinance is a policy decision for the Board. As an emergency ordinance, it would take effect immediately upon approval and signature. It requires a three-fourths vote of the Board. Finance/Resource Impact: No direct impact. Level of Public Interest High Sample Motion: I move for the approval of Ordinance XX-20. Attachments: Ordinance XX-20 Official Zoning Map 4 ORDINANCE NO. 07-20 AN EMERGENCY ORDINANCE REQUIRING FACE COVERINGS IN PLACES OF PUBLIC ACCOMMODATION AND OUTDOORS IN THE COMMERCIAL DOWNTOWN ZONING DISTRICT WHEREAS, on March 19, 2020, a local emergency was declared for the Town of Estes Park due to COVID-19; and WHEREAS, under section 31-15-401(1)(b) of the Colorado Revised Statutes, the Town has the authority to do all acts and make all regulations which may be necessary or expedient for the promotion of health or the suppression of disease; and WHEREAS, the Larimer County Department of Health and Environment has now confirmed three cases of COVID-19 in Estes Park; and WHEREAS, the age, condition, and health of a significant portion of the population in Estes Park places it at risk of serious health complications, including death, from COVID-19. Although most individuals who contract COVID-19 do not become seriously ill, persons with mild symptoms and asymptomatic persons with COVID-19 may place other vulnerable members of the public at significant risk. A large surge in the number of persons with serious infections can compromise the ability of the healthcare system, particularly in the high-country areas such as the Town of Estes Park, to deliver necessary healthcare to the public; and WHEREAS, visitation brings more people to the community, increases the likelihood of the rapid spread of the disease, and increases the risk to life and health in the Town; and WHEREAS, visitation has begun to increase upon the issuance of State of Colorado Public Health Order 20-28 (“Safer at Home”), and will continue to increase greatly as businesses reopen and the weather becomes warmer; and WHEREAS, visitors will imminently congregate in the Commercial Downtown zoning district and places of public accommodation in such densities that social distancing cannot be consistently maintained and the potential for the spread of disease is great, by both symptomatic and asymptomatic carriers; and WHEREAS, in light of scientific studies on the spread of COVID-19, the Centers for Disease Control and Prevention (CDC) recommends wearing cloth face coverings in public settings where other social distancing measures are difficult to maintain; and WHEREAS, for those reasons, the State of Colorado has also found that wearing a non-medical face mask helps minimize the spread of the virus, and that everyone should wear a mask when out in public. 5 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK, COLORADO AS FOLLOWS: Section 1: Definition. Face Covering for the purposes of this ordinance shall mean a uniform piece of material that securely covers a person’s nose and mouth and remains affixed in place without the use of one’s hands. A face covering may be designed for either medical or non-medical purposes, and shall include homemade and cloth coverings. Cloth face coverings should fit snugly but comfortably against the side of the face, include multiple layers of fabric, allow for breathing without restriction, and be able to be laundered and machine dried without damage or change to shape. Section 2: Face Coverings Required. All persons shall wear face coverings at all times when: a. entering or inside any area of any place of business open to the public, including but not limited to any retail business and any area of any accommodations business other than the person’s designated guest accommodations unit itself; and b. outdoors within the boundaries of the Commercial Downtown zoning district, as delineated in the Town of Estes Park Development Code and Official Zoning Map. Section 3: Businesses Must Require Face Coverings. No person, including any manager or owner, shall operate any business of public accommodation unless all persons are wearing and are required to wear face coverings, including all vendors, customers, and employees. This requirement shall apply to all areas of the business where customers are permitted or where employees interact with customers. Section 4: Exceptions. Nothing herein shall require the wearing of face coverings in circumstances where it would conflict with any state or federal law, or by the following persons: a. Persons under the age of two years; b. Persons for whom a face covering would cause impairment due to an existing disability or health condition, provided, however, that vulnerable individuals are strongly encouraged to remain at home whenever possible; and 6 c. Persons operating outdoors, for critical business or critical government functions as described in the State of Colorado Public Health Order 20-28, and under all required licenses and permits, equipment requiring other personal protective equipment and that cannot be safely operated with a face covering. Section 5: Expiration. This ordinance is effective through June 10, 2020, unless extended or terminated as described in section 8. Section 6: Most Restrictive Standard Controls. To the extent any state, county, or federal orders or laws are more restrictive than what is set forth herein, such orders control. This ordinance is intended to supplement and not supplant all state, county, and federal orders and laws. Section 7: Penalties. Failure to comply with section 2 of this ordinance is subject to a penalty of $50 for the first offense, $250 for the second offense, and the general penalty under section 1.20.020 of the Estes Park Municipal Code for any subsequent offense. Failure to comply with section 3 of this ordinance is subject to the general penalty under section 1.20.020 of the Estes Park Municipal Code. Section 8: Delegation. The Town Administrator, by emergency order as described in section 2.28.030 of the Code, may extend, modify, or augment the provisions of this ordinance to provide for the immediate preservation of life, health, or safety. This includes the authority to reduce or terminate the requirements of this ordinance if such requirements are no longer necessary for the immediate preservation of life, health, or safety. Section 9: Emergency. The Board of Trustees hereby finds that this ordinance is necessary for the immediate preservation of public health and safety, due to the pandemic facing the Town and for the reasons listed in the introductory paragraphs of this ordinance, which are incorporated into this section 9 by reference. According to our state Safer at Home Ordinance, lodging, like travel in the state, should be for essential purposes. If you need specific information about this, I sent it yesterday--it's in Appendix F. I know for certain that there are people vacationing now in Estes Park and staying at VRBOs, Air Bnbs, and lodges around town. I know that your meeting on Friday is to focus on masks, but to me having people from different parts of CO and other states ties directly to the issue of trying to protect the residents of our town. Does Larimer County and Estes Park have a variance to allow them to open lodging for nonessential business? From what Governor Polis says, any towns/counties that want to do things before the state ordinance allows, need a variance. Please provide documentation of this variance. It has been said that Larimer County would carefully monitor the opening of lodging, but how is that monitoring being done specifically? Please provide documentation of this monitoring. About the mask enforcement, I am in total support of whatever measures you deem appropriate. But you should know that while you are discussing masks outside, customers in Safeway and other essential businesses in town are not wearing masks. How will you go about monitoring that people are following the Safer at Home Ordinance around mask wearing? Are there any opportunities for volunteers to help with this around town? It has been repeatedly proven and recommended that masks/face coverings (along with distancing) SIGNIFICANTLY reduce the spread of COVID-19. If I am wearing a mask (which I do), my mask protects you, not me. Sadly, there are a lot of people who selfishly find it inconvenient, uncomfortable, or perceive it to be against their constitutional rights to be required to wear one. The vast majority of these people, however, are law-abiding citizens. The only way we are going to see wide-spread mask/face covering usage is by it being required by the Town of Estes Park, and with subsequent enforcement of this ordinance. I implore you to implement this requirement!!! I would suggest requiring them for any indoor facilities (all stores, beauty salons, gathering places such as the community center or bowling alleys, etc.) other than restaurants (for obvious logistical reasons). I would not suggest requiring it outdoors, but it should be highly emphasized nonetheless. All things considered, Estes has been very fortunate so far during this pandemic. Please don't allow pandemic fatigue or complacency take over. If we stay on top of this through the recommended precautions, we can continue to weather this storm. If you can't mantain a 6ft social distance then face coverings should be encouraged but no way mandated. Any attempt to enforce this would be unconstitutional. When restaurants are opened how can you eat or drink with a mask on? Why make a rule if it can't be enforced? Standing in the middle of The Big Thompson fly fishing wearing a mask...how silly. This is just plain stupid. I've worked in healthcare for 40 years where I was recognized as essential personnel and while in the military for 20 years as a member of my Squadron's disaster response team. I am a trained medical support resource trained in chemical warfare and the Broken Arrow response (nuclear weapons recovery). I know a thing or two about a chemical or nuclear theater. This virus thing is comparatively a joke. Wearing anything other than N95 or a M40 gas mask with appropriate filters is a waste of time. Trying to enact a rule like this will be ineffective and is only a ruse to let the overactive proponents think they are protecting themselves and perhaps others. I've seen plenty of face coverings lately. The majority of which are not worn correctly and of no use generally other than letting the person wearing it feel bettter about themselves or their environment. This is an education issue. If pasted the town should be prepared to provide a properly fitted N95 to every citizen and visitor of Estes Park. Never mind opening the eating establishments. Please require the following:  Aspen, CO requires a mask inside any business and in public, both indoors and outdoors, anywhere you may come within 6 feet of someone.  Please enact an ordinance as stringent as Aspen's ordinance. People are complaining about people on the Riverwalk without masks. There are bicyclists, people walking four across, and people with loose dogs WITHOUT masks at the lake, Fish Creek Trail and Scott Ponds Trails. Some customers at Safeway do not wear masks. 11 Action Item 1 Public Comment received prior to 12pm  Please work with the Recreation District to include the trails and areas like golf courses, community garden, playground areas, campgrounds, etc. that are under their jurisdiction.  It is imperative that anywhere one may encounter anyone within 6 feet that everyone have masks.  This is serious business and should be taken seriously by anyone who lives here, works here, shops here, visits here, recreates here and stays in any vacation rentals or lodging establishments.  To show the serious of the situation, please put weight behind this ordinance by having an enforcement component that works. I understand there are people in town who think that wearing masks is somehow preventing them from becoming sick with Covid-19. There is NO scientific evidence that this is true. There is no reason to ask everyone who is walking around outside to cover their faces. I understand that when people are working all day in a store or when people enter a store or business or Town Hall, it may make either the workers or the visitor feel better to think that any accidental spit or snot would be captured by a mask. Again, there is NO scientific evidence that this is anything but a placebo. I do not want to see the resources of the Police Department diverted to trying to enforce this unnecessary ordinance. I would much prefer they use their time and resources to address actual problems such as cars speeding or failing to stop for elk and pedestrians trying to cross the street and any other actual criminal activities such as domestic abuse or burglaries. I would also hope that you could suggest to concerned citizens who are acting as "the squeaky wheel that gets the grease" that they do not need to "say something" by calling the police department if they see what they consider to be an infringement of their rights to "protect themselves." Rhonda Mickelson <rhonmickel@gmail.com> Thu, Apr 30, 2020 at 9:39 PM Earlier this week, I thought I had seen a posting indicating that Larimer County was going to require both employees and customers to wear masks during the phased reopening of businesses. As I wasn't sure and couldn't find anything posted, I emailed Larimer County and asked. I received this response (along with the notice to be used): 12 Action Item 1 Public Comment received prior to 12pm Hi Rhonda - Here in Larimer County, we will be requiring customers and employees to wear cloth face coverings during this next phase. We know this is difficult for businesses to enforce, and that not all people can safely or comfortably wear a mask. What businesses need to do is post signage that states that a face covering must be worn. Our local order will be issued in the next few days. Keep watching for updates from us at www.larimer.org/safer-at-home. We'll work with businesses to answer questions and help them implement new precautions. Our enforcement always begins with a call and a discussion about how best to keep employees and customers safe. Thanks for doing your part! My rationale is straight forward: given inevitable sidewalk pedestrian congestion (think, for example, of the cross walks where people wait for a traffic light to change) (think, for example, of the narrow widths of the sidewalks themselves), even if all businesses comply with the Safer At Home requirements, the very people protected while frequenting Estes Park businesses will walk outside to close contact with multiple individuals. Imagine trying to maintain at least 6' of separation as people enter and exit businesses, stop to look in windows, stop to wait for the traffic light to change. It just will not be possible. Without universal use of masks, all the safety efforts within the businesses will be for naught. In sum, to fail to require masks is to create a single point of failure that will bring down the entire system intended to protect workers and customers in our businesses. I would like you to consider this simple story. I live in an area of town that has a field at the entrance of my condo association. When I return home from work in the dark of night, my headlights illuminate what I consider a frightful sight. Field mice run to and fro, across the road, and all about. I see them in the light of my headlights and I loathe them. I hate the idea that they are freely roaming about right next to where I live. I want them all to go away because I detest rodents. I hate them because they are dirty and sneaky and just plain awful. The only way I can protect myself from the field mice is to make sure my home doesn’t have any holes, openings, or cracks. It is the not the responsibility of the condo association to eradicate the threat of all field mice. It is the not the responsibility of the condo association to come and seal all the openings in my house. If I want to mitigate the threat of mice coming in my house, it is my responsibility. The fact of the matter is there will always be “field mice” aka threats, risks, trouble, all around me. We can’t remove every risk in the world. But, what we can do is teach people personal responsibility, healthy habits, problem solving skills, and critical thinking. As Americans, the day we walk down the “slippery slope” of mandating, requiring, forcing, and ordaining things that are a matter of “personal responsibility,” we have lost the very essence of the United States of America. America is the greatest experiment of the balance between law and liberty in all of human history. Please do not force Americans to wear face coverings when it is their personal choice and personal responsibility. I have nothing against face coverings. But, I do have enormous concern when the government forces people to submit to something that is a matter of personal choice. Let’s remain true to our calling. These spectacular lands were decreed “for the benefit and enjoyment of all people.” This land was given to people and for the people, to be enjoyed by all the people, in freedom, liberty, and gratitude. You have been elected to uphold the Constitution and the Eighth Amendment prohibits excessive fines and and unusual punishments. Requiring face masks and fining for non-compliance would violate that right. Estes Park is a unique community and not like other mountain towns. This uniqueness is what makes Estes Park so appealing to so many Americans. We do not need to follow the paths of other places. 14 Action Item 1 Public Comment received prior to 12pm The research is showing that this virus shows very little transmission outside and in the sunlight. We have both the great outdoors and abundant sunlight here. This virus also shows that over 99% of the people survive and it is only detrimental to those with at-risk health issues. So let those at-risk individuals choose to stay at home and let the rest of us choose to get back to living. We cannot let the fear of the few rob the freedom of the many. Choosing to wear a face mask is the same as choosing to wash your hands. Almost 70% of men and over 30% of women do NOT wash their hands after using the rest room. I choose to wash my hands. I choose to eat healthy. I choose to exercise. I would like have the choice to wear a face mask or not. Fundamental to being an American is my right to choose. As a business owner, we are looking forward to opening this week. However, I wish to point out something that perhaps may have been overlooked. While we fully intend to abide by current health guidelines, what I will not do is have my daughter "enforce" masks or face coverings. We will recommend-but not do anything else regarding visitors. Many take umbridge to this and I certainly don't wish my daughter, or anyone else getting into an altercation - or something that could escalate - over something that should be a personal choice. Enforcement will be next to impossible. Please consider our "other" safety when considering this. I've been a healthcare provider. I will tell you, cloth masks are NOT necessary. Many thanks. I think we’re all seeing an increasing number of people not wearing masks – yesterday my count was 11 of 21. I write in support of an ordinance requiring the wearing of face masks in public places in Estes Park…you may well have reached the same conclusion – based on what we know, and what we don’t. The issue is not simply “face masks vs. no face mask” – more fundamentally, the question is – should we or should we not allow “covid-virus shedders” to put the health of citizens and visitors to our village, indeed our economy, at risk. 1. We know that up to 50% of people infected and shedding covid virus are asymptomatic – they don’t even know they are infected and contagious (multiple studies), that they are infective agents to others. Virus shedding occurs through the infected person’s mouth and nose. 2. We know that the main value of mouth and nose masks is not to protect the wearer – it is to lessen the chance that an asymptomatic “covid shedder” infects others. 3. We don’t know the real-time distribution – the who and where – of covid 19. Lacking an effective asymptomatic testing and tracing system in Colorado and Larimer county, current testing (symptomatic people and health care, etc. workers) only informs us of conditions about 14 days ago. This has littlel value for early containment, or predictive value for identifying future “hot zones” in time for preventative actions. 15 Action Item 1 Public Comment received prior to 12pm 4. Since no one who is feeling well cannot know if they are shedding virus, the precautionary principle dictates that all behave as if they are. Voluntary compliance, while desirable, would be inadequate unless approaching very near 100% (certainly unlikely). A single non-compliant source, with only 3 contacts/day, could be responsible for exposing thousands to the virus over 14 days (direct contacts plus contacts of contacts – geometric progression) Of course, some contend that a mandatory face mask ordinance infringes on individual freedom. I would counter with a take –off on an old adage…”Your freedom to not wear a mask ends where my potential infection begins.” Some may see the ordinance as inconveniencing our visitors to the detriment of business – however, could it be just as likely that a “safer in Estes” ordinance would be a positive influence? We cannot afford to become a hot zone. As an aside, might VEP be willing to acquire masks/thick bandannas – with appropriate messaging - for distribution? Wishing you health - Gary C. I feel it would be detrimental to the community if there was ever a point in time where this was not prioritized. Our government is built on the backs of the people, not politicians or policy-makers. The people’s voice is the voice that matters. The idea of implementing a policy that would force local business owners, their employees, and the tourists this town is built upon to wear masks is a slap in the face to our constitutional rights. The 9th amendment to the United States Constitution explains that the people have rights beyond the ones listed in the constitution. We have a right to work. Section 25 of the Colorado state constitution makes it clear that I do in fact have the right to work according to state law. People have the ability in this country to exercise their right to work, to be outside, to wear what they want, and endless other things. Since when do those constitutional rights become quelled by the fear of the few? There is no definitive evidence that masks are a positive solution to deter the spread of the virus. The ability to force this choice on others creates a mentality to defy those attempts. Alienating those the town is inviting by opening is counterproductive to the concept. The risk management of enforcement of an ordinance will impact the community in far more negative ways than accepting that each individual can care and choose to protect themselves and not need to control those around them. Set up a risk management protocol that everyone can easily implement that will not require enforcement of an ordinance that stretches the resources of the PD or citizens to become involved in altercations. This town has alienated thousands already with the poor choices already implemented in shutting itself off. Just like frontline workers protect themselves first, this is the only protocol that should be implemented for business owners. Educate them on how to use biosecurity, how to prevent cross contamination, how to implement a safe work environment and remove all traces of possible contamination before they go home. We are more than happy to see the town opening up within reason. As senior citizens, we must be careful of our health and we known so many who live here who must do the same. However, if the requirement that all people wear masks can do a lot to help us feel everyone is doing their part. The most important places to monitor and require enforcement in our opinion, are the grocery stores, the drug stores, the post office and the hospital and doctors offices. We can stay away from everywhere else and feel reasonably safe. But we must buy groceries, we must go to the drug store for medicines and medical supplies, sometimes we need to take care of health. Unfortunately, there are a number of people (many who come up from the valley and some even living in town) who don't care whether we get sick or not. One person on Jibber Jabber said "We all have to die sometime" and it's not his responsibility. That is the kind of person I am most concerned about. Can we put into place and enforce an ordinance to make sure that ALL follow the rules? This is what my husband and I would like to see happen. If we are going to allow millions of people to come to town this summer, we MUST put in place an ordinance to keep everyone safe and if people do not follow the ordinance, well, hey then they can leave. As a physician and business owner, I think I have a unique perspective. I don’t think that requiring people to wear masks outside is effective enough to warrant the potential harm. Fabric masks depending on the material only decrease exposure by 20%. That is assuming that they’re actually on the face and not dangling off the mose or under the nose as I’ve seen many masks in the grocery store. It is unclear how much coronavirus is actually passed outside. It is unclear if the virus lives out in the sunshine in the warmth. It is unclear how long it stays in the air and then how clinically pertinent that would be, especially outside. From an enforcement standpoint, I think that would be a huge endeavor. I think it would create ill will in some cases. I don’t think that is the face that we want to present to visitors or citizens. As a business owner, I would like to remove any unnecessary barriers for tourism this summer, or for that matter, 19 Action Item 1 Public Comment received prior to 12pm barriers for local residents coming out and frequenting our local businesses. Many of our Tech companies and government elites are now censoring our freedom of speech, which is basic to our liberty here in America ( not so in China and Russia). We are much more aware of who we have been in contact with lately and our risk in possibly transmitting the virus over to someone else than any government official. If we know that we could possibly be in some crowd, we can easily grab our mask out of the car and put it on. Being outdoors is far more safe than being cooped up in tight quarters with others. What gives our government the authority to destroy our rights to assemble and permission to speak, even when it does not support the governments' presently distorted viewpoints. No government official, WHO, CDC or other top medical doctor on the media has been 100% correct in their viewpoints throughout 2020. We have far more data now than we ever had, but still many of those willing to sacrifice our country and workplaces still insist we should all turn into turtles and retreat inside our shells with our David CordesMy name is David Cordes, my wife and I reside at 1000 Black Canyon Drive in Estes.    I would ask the Trustees to err on the side of caution and require the use of masks for all individuals while in anyestablishment in the Town.  I believe that it sends the proper message that the Town is serious about providing a safe environment for its workers, its visitors, and its residents.     I do not have strong opinions on the use of masks while outside.  Given the winds in Estes, the normal models for aerosol transmission of the virus do not necessarily apply here.     Finally, I believe that the owners of any business in town should be responsible for providing masks for all employees.  This cost should not be the responsibility of the employees.     Thank you for your time. 4/30/2020 9:06 AM Doyle BakerThe CDC, Colorado, and Larimer County recommend masks in public settings but all also make it clear that these are to avoid infecting other people in settings where distancing cannot be maintained. All specifically give as examples, stores and pharmacies ‐ which clearly implies indoors. The CDC and WHO both report that the risk of spread outdoors is near zero beyond 3‐6 feet because large saliva particles fall quickly to the ground and there is no evidence that atomized small particles are infectious, particularly when sunny.    Based on the above, I strongly urge that the town make it mandatory to wear masks in all enclosed public places (stores, churches, etc.). Masts should not be arbitrarily required outdoors since, most of the time, it is safer not to wear a mask outdoors. If there is to be any consideration of requiring masks outdoors, this should be only for downtown ‐ Elkorn and riverwalk (where it is not possible to safely distance). 4/30/2020 10:54 AM Janine DawleyWhile data continues to be analyzed regarding COVID‐19 the CDC has still not mandated a requirement for face masks to be worn when a person leaves their residence. It is recommended, and that'swhat the position in Estes Park should be.  There is not a need to wear a mask if you are taking a walk or hike, and doing so for people with health issues like asthma, may be detrimental. There are also people who should never wear masks according to the CDC. Mandating masks in public is likely to create anger in those who want to police other's behavior and may lead to ugly confrontations (based on the conversations I've observed on social media). That is not the climate we want to cultivate in Estes.   The state recommendation is that  those at risk  continue to isolate. If a person is, or feels, at risk there are many people in the community willing to deliver groceries/supplies to help them continue to have their needs met.      Please don't impose restrictions that even the state and CDC are not mandating. 4/30/2020 11:18 AM Julie Klett Dear Trustees,     I support an emergency ordinance requiring that face masks be worn in retail locations and public places. In spite of the Safer at Home protocols in place, we already see an uptick invisitors from out of town, as well as returning seasonal residents. We see many visitors in stores such as Safeway not wearing masks. We have many employees who will have no choice but to work with the general public, and it is our duty to protect them and ourselves. Such an ordinance would at least attempt to reduce risk to our businesses, their employees, and the rest of us. Such an ordinance will also make it easier for businesses to protect themselves from their customers. If we are going to "open", let's at least make it as safe as possible.   Respectfully,  Julie Klett  4/30/2020 4:10 PM Tom StreetI support an enforceable ordinance with penalties requiring people to wear a mask in all businesses and other public buildings.  A mask should also be required downtown on Elkhorn, Moraine,Riverside,  and the River Walk.  Each person should have a mask readily available at all times and be required to put on the mask  when other people are within 20 feet regardless of the Estes Park location.  Social distancing of at least six feet should be required at all times in conjunction with the wearing of masks.   Currently, there are many people who simply refuse to wear a mask so this should be enforced with penalties sufficient to enforce compliance.  The Town should coordinate with the Estes Valley Recreation and Parks  district to require masks on paths, trails, and other areas under their jurisdiction. Ruth KelleyI worked in healthcare for 41 years, was fit‐tested annually for an N95 mask for infection control.  I am well aware of the purpose of wearing a mask to prevent the spread of diseases.  I'm also quite aware of the limitations of wearing anything less than a surgical mask or N95 mask in preventing spread of the coronavirus. Initially we were told to cough or sneeze into a tissue, then discard it. Recently, people have been encouraged and sometimes required to wear a mask or face covering, including bandanas, when in public businesses.  These only prevent droplets from being expelled, while viral particles can still be expelled through these coverings. Furthermore, many people are reusing their masks, are not don/doffing them correctly which exposes them as well as others to this virus, making the risk of exposure greater than if they did not wear them at all.  I am all for doing things that make our environment safer.  However, if the purpose of this meeting is to consider whether people should be "ordered" to wear masks/face coverings when out in public, then please show us the evidence‐based science behind this requirement.  Additionally, will there be some type of requirement that people utilize them correctly?  Can you even have any confirmation of this?  Additionally, I have seen people cough/sneeze with facial coverings on, and not even attempting to cover their faces with their arms, just sneezing on the packaged meats for instance, in Safeway.  Some people justify the necessity because it keeps them from "touching" their faces. If that makes them feel better, then so be it.  Lastly, if people feel that these face coverings are necessary and protective for them, then they certainly have the freedom to wear them.  If they truly believe they are effective, then why do they feel the need to force their beliefs on everyone else, particularly when science proves otherwise?    From Live Science: "https://www.livescience.com/are‐face‐masks‐effective‐reducing‐coronavirus‐spread.html"   "One study, published April 6 in the journal "https://annals.org/aim/fullarticle/2764367/effectiveness‐surgical‐cotton‐masks‐blocking‐sars‐cov‐2‐controlled‐comparison" Annals of Internal Medicine</u></a>, found that they did not. That study, led by South Korean researchers, involved asking four patients with COVID‐19 to cough into a petri dish 7.8 inches (20 centimeters) away. The patients coughed without masks, while wearing a disposable surgical mask and again wearing a 100% cotton mask.  Neither mask meaningfully decreased the viral load coughed onto the petri dishes."...and One thing everyone does agree on is that, whatever containment provided by non‐fitted masks do provide, homemade fabric masks are the least effective."  <a href="https://www.theguardian.com/us‐news/2020/apr/28/us‐face‐masks‐n95‐surgical‐coronavirus‐health‐workers" https://www.theguardian.com/us‐news/2020/apr/28/us‐face‐masks‐n95‐surgical‐coronavirus‐health‐workers. A properly fitted N95 respirator will block 95% of tiny air particles – down to 0.3 micron in diameter, which are the hardest to catch – from reaching the wearer’s face. But surgical masks, designed to protect patients from a surgeon’s respiratory droplets, aren’t effective at blocking particles smaller than 100 microns, "https://webcache.googleusercontent.com/search?q=cache:VLXWeZBll7YJ:https://multimedia.3m.com/mws/media/957730O/respirators‐and‐surgical‐masks‐contrast‐technical‐bulletin.pdf according to the mask maker 3M. A Covid‐19 particle is  "https://www.ncbi.nlm.nih.gov/pmc/articles/PMC7045880/", according to South Korean researchers, and can pass through a surgical mask.  "https://www.cdc.gov/niosh/npptl/pdfs/UnderstandDifferenceInfographic‐508.pdf"  web page that says surgical masks do “NOT provide the wearer with a reliable level of protection from inhaling smaller airborne particles and is not considered respiratory protection”."    Please note that the above is for surgical masks not protecting people...they would never even consider wearing a bandana as protective. In one study, a mask that used 16 layers of handkerchief fabric was able to filter out 63 percent of 300‐nanometer‐sized particles. (The coronavirus is between 50 to 200 nanometers in diameter.) But that mask was harder to breathe with compared with thick, tight‐fitting N95 respirators, often used in hospitals, that can block minuscule particles. Wearing a cloth mask with that many layers would be uncomfortable and may “cause some to pass out,” the researchers wrote in the letter."  As noted above, a "mask of 16 layers" filtered out 63% of viruses that are about 5x larger than this coronovirus.   Are you prepared to further dictate what type of face masks/coverings are required? If people wear a bandana, do you really think that makes any difference, except as asecurity blanket for that individual?  Please, this is a time and chance to base any recommendations and certainly any ordinances on evidence based fa Teresa McCaslinDear Board of Trustees,       I am fully supportive of an ordinance for anyone in public, including outdoor spaces (Lake Estes, RMNP, Hermit Park etc) to wear a mask or face covering.      I ask that you consider the following when making your decision:     ‐ Estes' population largely falls within the at‐risk category due to the age of its residents.     ‐ With the town opening up to visitors again, germs from a variety of places will be in and around town for the first time since the pandemic hit. Thus far things have been significantly contained.      ‐ Estes' hospital is not equipped for a large influx of medical needs or hospitalizations.      ‐ As a year‐round resident in their 30s who does not "appear sick" but in fact has several chronic and autoimmune conditions, there is limited support for people in my situation. For example, Safeway is happy to have "senior hours" but fails to mention that this shopping time should be for those at‐risk, not just seniors. Face coverings would be one way to support those of us who are facing health challenges already.      ‐ Without widespread community testing AND contact tracing measures, there is absolutely NO way to know who may have be ill, whohas been exposed and who has recovered.      ‐ This is a NOVEL virus that doctors and scientists are still learning about.      ‐ UC Health published an article this week. They have a team that has created a model to analyze the various safety measures available for the general public with things opening up slowly again. This is what their team determined: By far the greatest benefits – ones that would save hundreds of lives in Colorado while lowering the peak case rates much earlier in time (otherwise, depending on the scenario, those peaks could come as late as December, the model showed) – involved the combination of maintaining social distancing for those 60 and older, wearing masks, and improving testing and contact tracing" ( <a href="https://www.uchealth.org/today/coronavirus‐return‐to‐normal‐models‐in‐colorado/ https://www.uchealth.org/today/coronavirus‐return‐to‐normal‐models‐in‐colorado/</a>)     ‐ Estes has been following the lead of Larimer County Health Department. They have said it is a requirement for employees and customers to wear cloth face coverings.       ‐ Again, Estes has been fortunate thus far, but Estes and Colorado as a whole are not out of the woods. I hate to see the town lose control of the pandemic, and things can turn very quickly.      ‐At the end of the day, wearing something on your face is a small sacrifice to make for the freedom to leave your home, return to work, etc. 4/30/2020 7:26 PM Susan Wolf Dear Mayor and Town Trustees:     The mask decision is a matter of life and death.   Please require the following:   Aspen, CO requires a mask inside any business and in public, both indoors andoutdoors, anywhere you may come within 6 feet of someone.     Please enact an ordinance as stringent as Aspen's ordinance.  People are complaining about people on the Riverwalk without masks.  There are bicyclists, people walking four across,  and people with loose dogs WITHOUT masks at the lake, Fish Creek Trail and Scott Ponds Trails.  Some customers at Safeway do not wear masks.   Please work with the Recreation District to include the trails and areas like golf courses, community garden, playground areas, campgrounds, etc. that are under their jurisdiction.   It is imperative that anywhere one may encounter anyone within 6 feet that everyone have masks.   This is serious business and should be taken seriously by anyone who lives here, works here, shops here, visits here, recreates here and stays in any vacation rentals or lodging establishments.    To show the serious of the situation, please put weight behind this ordinance by having an enforcement component that works.  An ordinance without penalties is useless.   Our ordinance should provide for penalties.  Aspen's ordinance is excellent as it states: "Failure to wear a mask could result in a $50 fine for the first offense and $250 fine for the second offense with any additional offenses resulting in a mandatory court appearance and may include a fine up to $2,650 and/or year in prison."    Thank you for consideration of my comments.  This is a life and death issue.  Please help keep us safe.    Susan Wolf Estes Park  4/30/2020 7:32 PM Denise BartBecause there is so much conflicting information out there regarding whether or not the wearing of masks reduces the spread of the virus and protects individuals from contracting or spreading the virus, I would truly hope that the board will come to a middle of the road compromise when it comes to this issue of when and where a mask should be required.  In confined locations, like inside stores, restaurants, businesses, and on crowded sidewalks, like Elkhorn during the summer tourist season, it makes common sense that for the time being a mask should be worn.  Out in the open, outside walking down the street in neighborhoods, at the park, on trails, masks should not be required.  There is evidence that sunshine kills the virus.  I would be pretty frustrated if in my neighborhood where I walk every day, I had to wear a mask.  It is rare that I ever see or pass anyone ‐ it just doesn’t make sense.  Also, as the number of cases in northern Colorado continues to decline, I would hope that whatever level of mask wearing becomes required, that the board would create a plan to review the need to wear masks every so many weeks to accordingly adjust the requirements. 4/30/2020 8:35 PM Ann FinleyThe last I heard Larimer county is still under Stay at Home orders. Social distancing and face mask required in public places is still a part of this order.Therefore it would not be out of hand for us to require this of visitors to Estes Park. Which brings us to the far broader topic as to why we would be encouraging visitors to come to Estes Park . The Stay at Home also specifically limits travel to only necessary travel and that individuals are encouraged to stay in your place of residence as much as possible and to avoid unnecessary social interactions. I am not clear how opening accommodations in Estes Park follows these guidelines. We are asking people to come to Estes Park while a travel restriction is still in place. RMNP is closed , the restaurants do only takeout and Safeway can barely keep the shelves stocked for residents. We are to feel better that it is only 50% rooms opening. But how is that monitored?The guidelines are clear why are we waffling.4/30/2020 8:38 PM Bob LeavittOur town is in a very vulnerable position. Our hospital has enough PPE, isolation rooms, ventilators, and tests for a small increase in COVID‐19 cases. With tourists returning in increasing numbers the risk of more COVID‐19 cases is increasing. Accordingly, all citizens and visitors must follow established guidelines for wearing face masks and social distancing. This means anywhere on sidewalks, in parking lots, and in stores when they open up. For the past 2 days I have walked through downtown wearing a face mask. I noticed that small groups of tourists have begun to arrive. None of them were wearing masks. I observed some going into a restaurant without masks and immediately coming out followed by the proprietor wearing a mask. They stood on the sidewalk for a while and then left. Most local citizens seem to understand and wear a mask in public. For tourists the message must be clear: If you come to Estes you must wear a mask and follow all the health department guidelines. Our collective health depends on their compliance. Donna PierceHere are the Colorado cities where face masks are required in essential businesses: Denver, Boulder, Wheat Ridge, Aspen, Glenwood Springs. With over 4‐million people coming through Estes Park each year, we must make face coverings mandatory to protect everyone. I already know of one shop owner who will  not  wear a face covering, nor will they ask customers to wear one. It would be horrible if our COVID19 numbers skyrocketed over this. Apologies and excuses will mean nothing after the fact. I understand the economy must be restarted, AND that can be done responsibly and sustainably, as Governor Polis directs. This coronavirus is unpredictable and deadly, and we cannot be 'guessing' at this very fragile and tenuous stage. I walked my dogs along the River Walk today, and hardly anyone was wearing a face covering. My theory is that people who come here are in 'vacation mode,' where nothing can happen to them, especially in our seemingly pristine mountain town. COVID19 does not discriminate. And locals may be in 'we are safe up here in our small town' mode. Just guessing. Town government must show leadership and set the tone and example for the health and safety of residents and visitors. If our town leaders come across as 'wishy‐washy' (as in the terribly confusing message last week where short‐term lodging was opened, but people were told to stay away), then people will act accordingly. People respond best to  clear guidelines .    Thank you all for your service. 4/30/2020 8:52 PM Sybil BarnesI do not think you need to create a special ordinance for this issue.  I agree that some people feel more comfortable when people wear masks but many people do not and there is NO scientific evidence that wearing any kind of face covering is at all effective in stopping or reducing or otherwise impacting the spread of the Covid‐19 virus.  When people enter stores where they may not be able to keep a six foot distance, or when people are working in stores all day, there may be some benefit to keeping possible eruptions of snot or spit contained within a face mask or other kind of covering.  Again, there is NO evidence that this is helpful or necessary when people are walking outside.    I see no way that you can enforce this unnecessary ordinance and I would much prefer that our local police department employees continue to focus on other actual problems such as speeding cars or people failing to stop for elk and/or pedestrians trying to cross the street.    I understand that some people are concerned for their own health but I would suggest those people may continue to stay at home and not expose themselves to any possibly real but mostly imagined dangers.    Thanks for your consideration.  Sybil Barnes, full time resident and property owner since 1973  4/30/2020 9:45 PM Linda LangerI strongly support an action to  require  facemasks in Estes Park at all times when visiting a public place or place where one could encounter another person (i.e. walking around the lake).  This shouldbe enforceable and ENFORCED.   Too many people have cavalier attitudes toward this I think you should consider enacting a more stringent prohibition of the recent Larimer County action to open short term rentals – This is sending a highly conflicting message and will actually encourage the "highly discouraged" activity of non‐essential travel. I asked for an explanation from Larimer County and was told: “We worked with the Town to establish strict criteria to begin allowing these businesses to resume some reservations in a very limited capacity” .  My words = 50% is not a very limited capacity  It is obvious from looking around us that many “out of towners” and “out of staters” are coming into Estes Park and are not observing mask wearing, limiting groups to 10, nor social distancing. This will only be exacerbated by the opening of short term rentals.  Other mountain towns have taken a more restrictive stance toward opening up. There needs to be a more clear and urgent message that non‐essential travel into Estes Park will not be encouraged nor tolerated. My husband and I respect the space of the Valley residents by shopping and recreating here.  Our space should be similarly respected, and if not voluntarily, then by Town mandate. Thank you, 5/1/2020 6:55 AM Jamie Palmesano Dear Mayor Koenig and Town Trustees,  Thank you for permitting the input of residents of Estes Park regarding the Special Town Meeting and consideration of an ordinance pertaining to face coverings.    I would like you to consider this simple story.  I live in an area of town that has a field at the entrance of my condo association.  When I return home from work in the dark of night, my headlightsilluminate what I consider a frightful sight.  Field mice run to and fro, across the road, and all about.  I see them in the light of my headlights and I loathe them.  I hate the idea that theyare freely roaming about right next to where I live.  I want them all to go away because I detest rodents.  I hate them because they are dirty and sneaky and just plain awful. The only way I can protect myself from the field mice is to make sure my home doesn’t have any holes, openings, or cracks.  It is the not the responsibility of the condoassociation to eradicate the threat of all field mice.  It is the not the responsibility of the condo association to come and seal all the openings in my house.  If I want to mitigate the threat of micecoming in my house, it is my responsibility.  The fact of the matter is there will always be “field mice” aka threats, risks, trouble, all around me.  We can’t remove every risk in the world.  But, what we can do is teach people personal responsibility, healthy habits, problem solving skills, and critical thinking.  As Americans, the day we walk down the “slippery slope” of mandating, requiring, forcing, and ordaining things that are a matterof “personal responsibility,” we have lost the very essence of the United States of America.  America is the greatest experiment of the balance between law and liberty in all of humanhistory.    Please do not force Americans to wear face coverings when it is their personal choice and personal responsibility.   I have nothing against face coverings.  But, I do have enormous concern when the government forces people to submit to something that is a matter of personal choice.  Let’s remain true to our calling.  These spectacular lands were decreed “for the benefit and enjoyment of all people.”  This land was given to people and for the people, to be enjoyed by allthe people, in freedom, liberty, and gratitude. Corinne Magdalene ThomasThe town community has been safe from Covid19 because of the safety precautions that have been taken by our people. However, many people, local and visitors have not been adhering to the safety precautions due mostly because of their selfishness. I would hope that the town counsel would pass an ordinance requiring masks and safe space. However, this ordinance should carry a financial fine because it only hurts when the fine hits in the pocket. Visitors will only tear up the ticket. Their license number should be taken to ensure the fine be paid. 5/1/2020 9:02 AM Carol MangiameliI am concerned over the extension of Face Coverings in the Town of Estes Park Co.  The American people have done an outstanding job of staying at home not going to work for weeks / months.  The curve has been flat and yet the town of Estes Park is now demanding constant face coverings everywhere!  The people that are at any risk or high risk are the ones now that need to be responsible.  They need to be careful but the average person should now be able to come out of hiding and open their businesses and get our country and town  back moving.  To appose a fine if a person is found without a mask is not American!   We need to get our town and country back to the American People. I do NOT support this Agenda Item!          5/1/2020 9:09 AM Evan Mallon We are residents of Estes park strongly in favor of mandatory face coverings in public.   As citizens of this wonderful town, we are EXTREMELY grateful that the town has done everything right in terms of COVID, despite theinconveniences and financial ramifications. The hospital was very early in shutting down non‐essential surgeries and clinic visits, the library and schools closed much earlier than people thought was necessary, and the park closed. We understand how much the financial security of so many people in town hinges on small businesses, but again, we are so very grateful that the mayor, trustees, and others, put people before profits and shut everything down when they did to keep us safe. Also, COVID‐19 hit at kind of the perfect time for the town. A lot of the snow bird residents of Estes had not yet returned and tourist season had not yet ramped up, so the population was still primarily at its winter residence level, which really helped keep the COVID numbers down due to the low influx of in and out traffic. But, we fear that with the change from “Shelter in place” to “Safer at home,” and the reopening of hotels at half‐usage will cause a surge in the number of Covid cases in Colorado as a whole and Estes in particular.    We look around the country and see a shortage of PPE at the hospitals, we see essential workers, nurses, and doctors dying and fear for our staff at Estes Park Health. We feel that if we must begin to reopen Estes, the very least we can do is make it mandatory to have everyone – residents, business owners, employees, as well as tourists – wear facial coverings when in public. We are younger, thankfully in the category deemed “low risk,” but we feel mandatory facial coverings is the bare minimum we can do to protect our overwhelminglylarge number of elderly and younger, high‐risk population, as well as the staff at EPH. As you know, our hospital is not large and the staff is not abundant. If a few key members of that staff get sick, the whole infrastructure could start crumbling. Masks, of course, are not a cure all to the problem. It is not a guarantee to stop the virus from spreading, but it is at least SOMETHING, and it is recommended by the CDC.   Again, we are strongly in favor of mandatory facial coverings. If possible, we are also strongly in favor of having masks available at the town hall, library or police station for those who do not have access to them. We are also in favor of law enforcement carrying a supply in their vehicles to offer them to people in town not wearing any and issuing warnings or fines to those who do not comply.   We are extremely grateful again to live in a town that solicits opinions on topics such as this from its residents and we hope you once again make the right decision to keep us safe and make masks mandatory for the foreseeable future.   With much gratitude and hope,  Mr. Evan Mallon &amp; Dr. Jennifer McLellan   Please note that these opinions are personal and do not necessarily represent those of Dr. Jennifer McLellan’s employer, Rural Physicians Group or Estes Park Health. 5/1/2020 9:11 AM Brayden BojanI appreciate your willingness to accept public input about the issue being discussed at the emergency ordinance later  this afternoon . I feel it would be detrimental to the community if there was ever a point in time where this was not prioritized. Our government is built on the backs of the people, not politicians or policy‐makers. The people’s voice is the voice that matters.   The idea of implementing a policy that would force local business owners, their employees, and the tourists this town is built upon to wear masks is a slap in the face to our constitutional rights. The 9th amendment to the United States Constitution explains that the people have rights beyond the ones listed in the constitution. We have a right to work. Section 25 of the Colorado state constitution makes it clear that I do in fact have the right to work according to state law. People have the ability in this country to exercise their right to work, to be outside, to wear what they want, and endless other things. Since when do those constitutional rights become quelled by the fear of the few?  Brayden Bojan Doug SacartoUse of face coverings in all public spaces should be ordered and enforced by Town ordinance until all state and county "stay at home" and "safe at home" restrictions have been lifted regarding separation distances, non‐essential businesses, non‐essential travel.    More generally concerning non‐essential travel to Estes Park and the Estes Valley and opening of accommodations for short‐termvisitations.    It is an unreasonable    risk to vulnerable populations in the Estes Valley (which constitute more than 40% of the residents) to open short‐term accommodations at this time in the Estes Valley.     It is inappropriate to     encourage non‐residents to travel to the Estes Valley by opening such  accommodations when that will necessarily involve violation of the continuing restriction on unnecessary travel outside of their own local community.   It is inappropriate to  promote travel to the Estes Valley while its restaurants and most other services must remain closed to protect public health.  Visitors     require sit‐down services, not take‐out.   It is inappropriate to promote travel to the Estes Valley while the national park remains closed.  Visitors will only congregate in town at the limited options for services and entertainment, causing unreasonable health risks for them and     for local residents.   Essential services,     including groceries and hospitalization, are strained to meet local demand.  Encouraging non‐resident visitors will threaten the     well‐being of local residents.  This should not be the policy of the Larimer County Commission.   At least seven mountain  counties in Colorado that are tourist destinations (like the Estes Valley)  are NOT reopening access and short‐term accommodations at this time.       Larimer County should similarly maintain closures in concert with those  other counties and NOT reopen prematurely.  Larimer County should not engender detrimental competitive pressures for other counties also to reopen     prematurely.  Non‐essential travel to Estes Valley and short‐term accommodations in Estes Valley need to remain closed until the facilities necessary to serve an influx of tourists—including on‐premise dining, bars, clubs, theaters, breweries,  distilleries, retail stores, and touring groups—are also safely opened and the national park, as the primary tourist destination, is open.  Thank you.     5/1/2020 9:12 AM Fred R. Mares While discussing the subject of an emergency ordinance regarding the wearing of face coverings in Estes Park, I would urge the Town Board to consider that “reopening” Estes Park may be premature.  It is not like reopening any other similar size town within the state because opening Estes does not mean it would be open to local residents doing business only.  It means it would be open to anyone in the country who does not practice stay‐at‐home/safer‐at‐home.  People coming to visit Estes would potentially expose themselves to others of the visiting population, the workers (our workforce and the new hires) in all the hospitality business, and to all the local residents.  This risk would not be a one‐time event but continual due to the constant flow of new visitors.   I cannot imagine that all of our businesses, hotels and short‐term/vacation rentals, and restaurants can quickly add the capacity to screen, monitor, and report cliental adequately to maintain any reasonable safety standard for all parties involved.   Whether or not we believe the we have seen the worst, and without arguing about any specific data set, we learn every day the COVID‐19 virus is here and is persisting.   I would argue that, even with restrictions, allowing lodging facilities to reopen is premature and a misstep of the previous administration that sends mixed messages to the visiting public.  It can be corrected.  I would further urge the Town Board to require all people to wear a face covering while inside any facility that is open to the public and outside in any circumstance that a six foot minimum distance cannot be maintained between individuals.   Our economy is vitally important, and we are fortunate to have a healthy tourist‐based source of revenue but with that good fortune comes the responsibility to keep all people who live here, work here and visit here out of danger.  The day will come when we are open for business, but it is not today.   Fred R. Mares Estes Park, CO  5/1/2020 9:27 AM Natasha AlvandiThank you all for your service to our community.     Quite simply, this is a tourist town. Creating emergency ordinances with fines makes us seem very alarmist and unfriendly. People will remember this in future and not come out to our community long after this is over. Is Denver requiring face masks downtown? We can’t be the only alarmist community around. It makes us look like we don’t want visitors, we are presuming that they are sick, and that we are scared of the very people who make our town function. Without tourists, our businesses will go broke. Our businesses are going broke right now. If tourists have the choice to visit a town that doesn’t fine you if you aren’t wearing a mask or Estes that polices you like you are in a science fiction movie, they’ll choose the other town. We can not afford to lose tourist dollars this season.      The Town should consider providing free masks in the visitor center, free hand sanitizer, free wipes, or even working with volunteers so the vulnerable population can have free grocery/supply delivery. Most shops are going to require masks. Tourists will know this and wear masks naturally. Also, the tourists are human beings too. They don’t need to be treated like criminals. They no doubt don’t want to get sick either.      Putting top‐down, unfriendly ordinances for “the good” of everyone will make people see Estes Park as an anomaly in Colorado.      Thanks for your consideration.      Natasha Alvandi 5/1/2020 9:42 AM Michael McEndafferGood afternoon. I am commenting regarding today's special meeting considering an emergency ordinance pertaining to face coverings. I have not found many details on what exactly is being considered but it was easy to assume that some sort of requirement for face coverings would be enacted as an ordinance. It is my firm belief that making any such ordinance or requirement would be a gross over‐step of government authority, purpose, and completely unnecessary. Private businesses can enact their own requirements, and require anybody entering to wear face masks, or ask them to leave the property. I think it may even already be required in businesses by the Dept. of Health. If the Town were to enact such an ordinance, please please understand that this government would be making the presence, or lack there of, of a piece of cloth a criminal offense. This would mean that it would have to be enforced, and people will begin calling in fellow American's simply because what they are or are not wearing. Please consider the 4th Amendment to the United States Constitution (there is no exception that says "unless things are really bad" by the way). This amendment prohibits the Government from making any unreasonable searches or seizures. A government agent or police officer stopping an American citizen in the street simply because they lack cloth around their face absolutely sounds like an unreasonable seizure. Thank you for reading this, and please consider this ordinance carefully and with the Constitution at the front of you minds! 5/1/2020 10:01 AM David Eric White I am writing in support of an ordinance to, at minimum, require face coverings in local businesses and other indoor public spaces. Other municipalities (Aspen, Boulder, Glenwood Springs) have already instituted ordinances like this. In addition to setting requirements for individuals, the ordinance should require businesses to admit only customers who are wearing face coverings, to provide face coverings to their employees, and to ensure that their employees are wearing their face coverings properly and consistently. Businesses that don't adhere to these requirements should face consequences under the ordinance. Public health officials tell us that face coverings, properly worn, help reduce the spread of COVID‐19 and save lives. If we're going to start opening up Estes Park‐‐especially to visitors, many of whom may be going against public health orders in visiting from outside the county‐‐this is the least we can do to help keep our vulnerable populations safe.  In conjunction with the ordinance, the town should ideally take some additional steps: First, it should provide a way for a member of the public who doesn't have a mask to get a donated one, if available. Perhaps a place where donors can drop off masks and those who need a mask can pick one up. Second, it should provide guidance to businesses on how to manage customers who show up without face coverings: how to explain why they can't admit them, how to provide resources for obtaining or improvising a mask, etc. Finally, the town should reassure businesses that they'll have the support of law enforcement when dealing with customers who are unwilling to comply with the ordinance. 5/1/2020 10:46 AM Boyette Williams There absolutely should be no fine imposed or harassment to people who chose not to wear PPE in outdoor public areas.  There is no scientific data showing that that face coverings mitigate viruses in open air settings such as walking on trails or sidewalks. The virus stats are starting to come in and they are showing that the disease has already spread far and wide and that the mortality rate is about the same as the flu.  Government overreach has already done more damage to the economy than can be recovered from anytime in the near future.  Imposing more restrictions will only cause public anger and resentment toward the government and more restrictions will not likely make any of us safer.   The best thing is to remove local restrictions and put out information that each individual can chose to practice or not.  Most people get the idea about social distancing and PPE.  If those who are concerned about possibly getting the disease will stay home or implement safety measures appropriate to their situation, it will be enough.  Those who are not concerned for themselves should be allowed to choose if they protect themselves and/or to voluntarily attempt to protect others. Business owners can make whatever rules they want for their employees and customers.  No one is forced to do business in these places if they do not think that it is safe. This country was founded upon life, liberty and the pursuit of happiness. These are not only unalienable rights, that are now being stolen by governmental fiat, they are things that will cause the populace to rebel in stronger and stronger ways if they continue to be infringed upon. Don't be foolish with your power.  It is time to back down from overreach now that we know the disease is not even close to as dangerous as was originally feared. 5/1/2020 10:59 AM This is how the FDA describes the effectiveness of surgical and face masks "While a surgical mask may be effective in blocking splashes and large-particle droplets, a face mask, by design, does not filter or block very small particles in the air that may be transmitted by coughs, sneezes, or certain medical procedures. "In a 2015 randomized controlled trial involving 1,607 healthcare workers, researchers compared the rate of influenza-like illness in healthcare workers wearing cloth masks or medical masks to those in a control group (which sometimes used masks). Wearing cloth masks resulted in significantly highe r rate s of infe ction, the authors found. They also noted that in their test, the cloth masks we re only 3 pe rce nt e ffe ctiv e at blocking particle s. Potential risks of masks There is evidence that virus particles hang out on the outside of masks— particularly among healthcare workers who likely have high exposure. Among 59 healthcare workers who had their protective gear, clothes, and skin sampled in a 2019 study, many were contaminated with virus. Overall, 31 percent of gloves, 21 percent of gowns, and 12 percent of face masks were positive for virus. Moreover, 11 percent had viral particles on their scrubs and 7 percent had them on their bare faces. A similar study, also in 2019, confirmed that respiratory viruses are often found on the outside surface of medical masks and can be a source of self-contamination. In yet another study from last year, researchers in Chicago observed healthcare workers taking off their person protective equipment (masks, gloves, gowns, etc)— the removal is called doffing. This is a time when healthcare workers can easily self-contaminate by taking gear off incorrectly. The researchers found that healthcare workers incorrectly removed their protective gear 90 percent of the time." After reading the proposed language I would strongly encourage the trustees to vote against this ordinance. I predict confusion and irritation as the primary results due to 1. A confusing area of jurisdiction, 2. Stated lack of enforcement, 3. No standard for what a face covering consists of or what constitutes adequate, 4. This is a trendy & visible, albeit ineffective display of "doing something" about COVID, and a stretch of using an emergency action to implement it. Consider other actions that would actually impact the spread of this perceived threat: hand washing stations, encouraging good decisions vs penalizing bad (enforcement will be nearly impossible). This creates liability for us, the taxpayers, as you are the custodians of our funds, and the continued use of our funds under the guise of an 'emergency' must be carefully weighed. Requiring certain behavior of all citizens for "their own good" and the controversial potential benefit of a non specific face covering is short sighted and will have costs that may outweigh the energy to try to force this behavior.
