CCRESOLUTIONNO.13-93WHEREAS,theTownofEstesPark,hereinafterreferredtoasthe“Town”andtheParkSchoolDistrictNo.R—3,hereinafterreferredtoasthe“District”,enteredintoanOperatingAgreementdatedasofMarch11,1992;andWHEREAS,pursuanttotheapplicableprovisionsofsaidOperatingAgreement,theTownwastoconstructachildcarefacility,hereinafterreferredtoinsaidOperatingAgreementas“TheChildrensCenter”;andWHEREAS,pursuanttotheapplicableprovisionsoftheOperatingAgreement,theTownhasconstructedTheChildrensCenter;andWHEREAS,pursuanttoParagraph7oftheOperatingAgreement,theTownmustmakecertainfindingsandrepresentationsconcerningtheconstructionandcompletionofTheChildrensCenter.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.1.TheBoardofTrusteesoftheTownofEstesParkherebydeterminesthatTheChildrensCenterhasbeencompletedandacceptedbytheTownandallcostsofconstructionhavebeenpaid.Datedthis/3%dayofApril,1993.TOWNOFESTESPARKBy:____MayorATTEST;TownClerk 00¶iI>--V
