Home My WebLink AboutRESOLUTION 11-94C,RESOLUTIONNO.11-94WHEREAS,theTownofEstesParkalongwithLarimerCounty,ColoradoandtheEstesValleyRecreationandParkDistricthavepursuedtheacquisition,constructionandeventualmaintenanceofaHike—BikeTrailstartingneartheChamberofCommerceoffice,thenparallelingtheExecutiveGolfCoursetoLakeFrontStreet;andWHEREAS,theStateofColorado,DepartmentofTransportationistheadministrativeagencyresponsibleforadministeringfederalfundspursuanttotheIntermodalSurfaceTransportationEfficiencyActof1991;andWHEREAS,theaforementionedHike—BikeTrailiseligibletoreceiveFederalaidfunds,pursuanttoinitialdesigndataprovidedbytheTownfortheproject,andWHEREAS,thematchingratioforthisFederalAidprojectis80%Federalaidfundsto20%TownfundsforsuchcostsasareeligibleforFederalparticipation;andWHEREAS,theTownhasreceivedaproposedcontractbetweentheStateofColoradofortheuseandbenefitoftheDepartmentofTransportationandtheTowiiofEstesPark,acopyofwhichisattachedheretoasExhibit“A”andincorporatedhereinbyreference,whichstatestheterms,conditions,andresponsibilitiesofeachpartywithregardtotheproject;andWHEREAS,theBoardofTrusteesoftheTownofEstesParkhasdeterminedthatitisinthebestinterestoftheTowntoenterintotheaforementionedcontract.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThecontractbetweentheStateofColoradofortheuseandbenefitoftheDepartmentofTransportationandtheTownofEstesParkasmorefullysetforthonExhibit“A”,isherebyapproved.2.TheappropriateofficialsoftheTownofEstesParkareherebyauthorizedtoexecutesaidcontract.Adoptedthis24THdayofMAY,1994.TOWNOFESTESPARK,MayorATTEST:KTownClerkDLPty 00
