Home My WebLink AboutRESOLUTION 32-9400RESOLUTIONNO.32-94WHEREAS,theTownofEstesParkownstransmountainwaterrightsbutinaninsufficientquantitytomeetallofitsrawwaterrequirements.Therefore,nativewatermustbedivertedtomeetmunicipaldemands,however,theTown’snativewaterrightsarejuniorandsubjecttolongperiodsofbeingout-of—priority.Therefore,tomeetitsdemands,theTownmustdivertnativewaterout—of—priorityformunicipaluseandreplaceanydepletionssothatdownstreamwaterrightsarenotinjured;andWHEREAS,theTownofEstesParkownscertaindirectflownativewaterrightsonBlackCanyonCreekknownastheEstesParkTownCompanyPipelineandtheEstesParkWaterCompanyPipelineExtension.SaidwaterrightsmaybealsousedbychangingthepointsofdiversionofsaidwaterrightstotheTown’spointsofdiversionlocatedonFallRiverandGlacierCreek;andWHEREAS,theTownofEstesParkhashiredRockyMountainConsultants,Inc.toprepareaplanforaugmentation,whichplanhasbeenreceivedbytheTownofEstesPark;andWHEREAS,thisplandescribeswateruse,consumptionandreturnflowsfortheTownofEstesParkandproposesaplanofaugmentationforreplacingout—of—prioritydiversionsofnativewatertopreventinjury.TheproposedsourcesofreplacementwaterarefirstuseandreusecreditsofWindyGapProjectwaterownedbytheTown.AnoperatingandaccountingplanisdescribedwhichwouldallowtheTowntoreplaceout—of—prioritydiversionswithoutinjurytootherwaterrights;andWHEREAS,itisalsonecessarytofileforanadjudicationofappropriativerightsofsubstitutionandexchangetoeffectuatetheplanforaugmentation;andWHEREAS,TheBoardofTrusteesoftheTownofEstesPark,theTownstaffanditsconsultantshavereviewedtheWaterAugmentationPlanandhavedeterminedthatitisappropriatefortheTownofEstesPark;andWHEREAS,itisnecessarytofilewiththeDistrictCourt,WaterDivisionIoftheStateofColoradoanapplicationforchangeofwaterrights,approvalofplanforaugmentationandadjudicationforappropriativerightsofsubstitutionandexchange.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO.
