18-950oRESOLUTION#18-95WHEREAS,certainpropertyownersinasubdivisionoftheTownofEstesPark,Colorado(the‘Town”)knownasParkEntranceEstateshavepetitionedtheTown’sBoardofTrustees(theBoard’)fortheacquisitionandconstructionofcertainlocalwaterdistributionsystemandroadwayimprovements;andWHEREAS,thestaffitoryproceduresforcreatingspecialimprovementdistrictswithinmunicipalitiesaresetforthinTitle31,Article25,PartS,C.R.S.;andWHEREAS,pursuanttoSection31-25-502,ColoradoRevisedStatutes(“C.R.S”.),itislawifilfortheTowntoconstructlocalimprovementsofthetyperequestedandassessthecoststhereofuponthepropertyespeciallybenefittedbysuchimprovementswithintheboundariesofaspecialimprovementdistrict;andWHEREAS,thelocalwaterdistributionsystemimprovementsincludebutarenotlimitedtotheimprovementofthewaterdistributionsystemwithinBlock2oftheParkEntranceEstatesSubdivision,includingtheremovalofthecurrentwaterdistributionsystemandtheinstallationofanewwaterdistributionsystem;andWHEREAS,thelocalroadwayimprovementsproposedincludebutarenotlimitedtotheimprovementofallpublicstreetswithintheParkEntranceEstatessubdivisionexceptSuariseLanefromitsintersectionwithMeadowCircleandValleyViewDrivefromitsintersectionwithHeinzParkway,includingwidening,paving,andinstallationofappropriatedrainagefacilities;andWHEREAS,theTownhasreceivedpetitionsforsuchlocalwaterdistributionsystemandroadwayimprovementssubscribedbytheownersofpropertytobeassessedformorethanone-halfoftheentirecostsestimatedbytheBoardtobeassessedinaeachoftwoassessmentunits;andWHEREAS,theBoardhasdeterminedthatitisinthebestinterestoftheTownanditsinhabitantstocreateaspecialimprovementdistrictwithinthesubdivisionknownasParkEntranceEstatesandtoacquireandconstructlocalwaterdistributionsystemandroadwayimprovementswithinsuchspecialimprovementdistrictandassessthecostsofsuchimprovementstothepropertieswithinthespecialimprovementdistrictespeciallybenefittedbytheimprovements;andWHEREAS,pursuanttoSection31-25-503(3),C.R.S.,inordertobegintheprocessofcreatingaspecialimprovementdistrictforthispurpose,theBoardisrequiredtoadoptapreliminaryordersettingforthvariousparticularsoftheimprovementsandtheconstructionproject;and#96608 0CWHEREAS,italsoisnecessaryfortheBoardtocallapublichearingonthesemattersandtodirecttheTownClerktogivenoticeofsuchhearing;NOWTHEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:Section1.TheBoardherebydeclaresitsintenttocreateaspecialimprovementdistricttobeknownastheTownofEstesPark,ParkEntranceEstatesSpecialImprovementDistrictNo.95-1(the“District”),pursuanttothepetitionssubmittedtotheBoard,subscribedwiththesignaturesofownersofpropertywithintheDistrictexpectedtobeassessedformorethanone-halfofthecostsoftheimprovementstobemadeineachoftwoassessmentunitstherein.Section2.TheBoardherebyadoptsthepreliminaryplansandspecificationspresentedattheregularmeetingoftheBoardatwhichthisResolutionisadoptedandherebythitheradoptsandmakesapreliminaryorderasfollows:a)thematerialstobeusedinthewaterdistributionsystemimprovementsshallbeprimarilyductileifkrnpipeandsuchothermaterialsasarecustomaryandappropriatetothetypeofimprovementsbeingacquiredandconstructed;andb)thematerialstobeusedintheroadwayimprovementsshallbeprimarilyasphaltandsuchothermaterialsasarecustomaryandappropriatetothetypeofimprovementsbeingacquiredandconstructed;andc)theassessmentstobeimposeduponthepropertywithinthespecialimprovementdistrictshallbepayablein10annualinstallmentsoveraperiodof10years;andd)thelegaldescriptionofthepropertytobeincludedinthespecialimprovementdistrictis:ParkEntranceEstatesAdditiontotheTownofEstesPark,LarimerCounty,Colorado;ande)theTownengineershallmakeagoodfaithestimateofthetotalcostsoftheimprovementstobeacquiredandconstructedandshallprepareorcausetobepreparedamapofthespecialdistrictandascheduleoftheapproximateamountstobeassessedupontheseverallotsorparcelsofpropertywithinthespecialimprovementdistrict.Section3.TheBoardherebycallsapublichearingontheproposedcreationoftheTownofEstesPark,ParkEntranceEstatesSpecialImprovementDistrictNo.1andschedulessuchpublichearingforTuesday,August8,1995,at7:30p.m.Section4.TheBoardherebydirectstheTownClerktoprepareaNoticeofPublicHearingsubstantiallyintheformattachedheretoasExhibitAandmadeaparthereofbythisreference.TheTownClerkshallcausetheNoticetobepublishedintheEstesParkTrail-GazetteinaneditionpublishednotlaterthanFriday,July14,1995,andshallcausetheNoticetobemailedbyfirstclassmailtoeachpropertyownertobeassessedforthecostsoftheimprovementswithintheDistrict.TheNoticeshallbemailedonoraboutthedateonwhichtheNoticeispublished.Section5.TheBoardherebyfindsanddeterminesthatthepetitionsofpropertyownerswerepresentedinaccordancewithlawandthattheyweresignedbyownersofpropertytobeassessedformorethanone-halfofthetotalcostsoftheimprovementstobeassessedineachoftheassessmentunits.#96608
