HomeMy WebLinkAboutRESOLUTION 01-95CRESOLUTION1-95WHEREAS,Section26—6—402(2)(C)ofthe“ColoradoSunshineActof1972”asamended,requiresamunicipalitytodesignateapublicplacetopostnoticesofitsmeetings.NOW,THEREFORE,BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK:1.ThatthelobbyareaimmediatelyadjacenttotheAdministrativeOfficesintheEstesParkMunicipalBuilding,locatedat170MacGregorAvenue,EstesPark,ColoradoisherebydesignatedasthePublicPlaceforPostingNoticesofMeetingsoftheBoardofTrustees.INTRODUCED,READANDPASSEDTHIS4‘dayofN(:211___________1995.TOWNOFESTESPARKMayorATTEST:77,zcTownClerk ooNOTICEOFPUBLICHEARINGREGARDINGTHECREATIONOFASPECIALIMPROVEMENTDISTRICTTOBEKNOWNASTOWNOFESTESPARKPARKENTRANCEESTATESSPECIALIMPROVEMENTDISTRICTNO.95-1TheTownofEstesPark,Colorado(the“Town”)hasdulycalledandherebygivesnoticeofapublichearingtobeheldonTuesday,August8,1995,at7:30p.m.attheTownHall,locatedat170MacGregorAvenue,inEstesPark,Colorado.TheTownBoardofTrustees(the“Board”)hasreceivedpetitionsrequestingtheacquisitionandconstructionofcertainlocalwaterdistributionsystemandroadwayimprovementswithinasubdivisionoftheTownknownasParkEntranceEstates.ThepetitionershaverequestedthataspecialimprovementdistrictbeformedwithinwhichsuchimprovementswouldbeacquiredandconstructedbytheTownandthatthecostsofsuchimprovementsbeassesseduponthepropertywithinthedistrictreceivingspecialbenefitfromtheimprovements.Thepetitionsaresubscribedwiththesignaturesofownersofsorethanone-halfofthepropertytobeassessedineachoftwoassessmentunitswithinsuchproposedspecialimprovementdistrict.Interestedpersonsshouldnotethefollowinginformation:1.Thelocalimprovementsrequestedincludebutarenotlimitedto:a)localwaterdistributionsystemimprovementsincludingtheimprovementofthewaterdistributionsystemwithinBlock2oftheParkEntranceEstatessubdivision,includingtheremovalofthecurrentsystemandtheinstallationofanewwaterdistributionsystemandb)theimprovementofallpublicstreetswithintheParkEntranceEstatessubdivisionexceptSunriseLanefromitsintersectionwithMeadowCircleandValleyViewDrivefromitsintersectionwithHeinzParkway,includingwidening,paving,andinstallationofappropriatedrainagefacilities.2.Theproposedassessmentswouldbepayableovertenyearsintenannualinstallments.3.Theprobablecosttobeassessedperlotfortheroadwayimprovementsis$10,600andtheprobablecosttobeassessedperlotforthewaterdistributionsystemimprovementsisanadditional$8,200.InthejudgmentoftheBoardtheuseofaper-lotassessmentbasisreflectsthebenefitswhichaccruetothepropertytobeassessed,asshownbyengineeringestimates.4.AnordinancecreatingthespecialimprovementdistrictandauthorizingthelocalwaterdistributionsystemandroadwayimprovementsthereinwillbeconsideredbytheBoardatitsregularmeetingonTuesday,August8,1995,followingthepublichearingwhichisthesubjectofthisnotice.Suchdateisnotlessthantwenty(20)daysafterthepublicationofthisnotice.5.AmapoftheproposeddistrictandascheduleshowingtheapproximateamountstobeassessedupontheseverallotsandparcelswithintheproposedspecialimprovementdistrictareonfilenowintheofficeoftheTownClerklocatedintheTownHallandareavailabletobeseenandexaminedbyanyinterestedpersonfromnowthroughthedateofthehearing.AllcomplaintsandobjectionsmadeinwritingconcerningtheproposedimprovementsbytheownerorownersofanypropertytobeassessedwillbeheardanddeterminedbytheBoardbeforefinalactionistaken.Is!VickieO’ConnorTownClerkPublishin:EstesParkTrailGazettePublishonorbefore:July14.1995#96746 0oCERTIFICATEOFMAILINGIherebycerti&thatonthisi3dayofTcL‘i1995,atrueandcorrectcopyoftheattachedNoticeofPublicHearingwasdepositedintheUnitedStatesmail,postageprepaid,addressedtothefollowing:Ln-aKJ1J.CQQ‘1#90491
