CCFORMOREINFORMATION:Ifyouneedmoreinformationorhaveanyquestionsaboutanyofthefollowingmaterials,pleasecontactyoursuperVisor.§382.601(b)(I)I.DrugandAlcoholPolicy.A.TheTOWNvaluesitsemployeesandrecognizestheimportanceofasafeandhe:lthyworkenvironment.Employeeswhouseillegaldrugsand/orabusealcoholtendtobelessproductive,lessreliable,morepronetoaccidents,andmorepronetogreaterabsenteeism,resultinginthepotentialforincreasedaccidents,costs,andriskstothemselves,theirfellowemployees,andthecommunity.B.TheTOWNdesirestoprovideasaferworkplacebyeliminatingthehazardstohealthandjobsafetycreatedbyalcoholanddrugabuse.C.Employeeswhoengageintheuseofillegaldrugsorcontrolledsubstances,and/orwhoabusealcohol,willbesubjecttodisciplinaryactionuptoandincludingtermination.D.TheTOWNwillcomplywiththetestingrequirementsoftheU.S.DepartmentofTransportationandotherapplicablefederalandstatelawsandregulations.II.Applicability.ThispolicyappliestoeachemployeewhoisrequiredtoholdaCommercialDriver’sLicense(CDL).YouneedaCDLifyoudriveaTOWNvehicle:A.Withagrosscombinationweightratingof26,001ormorepoundsinclusiveofatowedunitwithagrossvehicleweightofmorethan10,000pounds;B.Withagrossvehicleweightratingof26,001ormorepounds;C.Designedtotransport16ormorepassengers;or2 00 00D.Ofanysizethatisusedtotransporthazardousmaterialswhichrequirethevehicletobeplacardedunderthehazardousmaterialsregulations.§382.107III.CircumstancesforAlcoholAudDrugTests.Alcoholandlordrugtestingwillbedoneunderthefollowingcircumstances:A.Pre-Fmplovment.Beforeyouareemployedorstartworkinginasafety-sensitivethnction,youwillbetested(unlessyouarealreadybeingtestedunderanotherprogram)fordrugs.§382.301(a)B.AccidentInvolvingDeathofPerson.Ifyouareinanaccidentwhileperformingasafety-sensitivefunctionandtheaccidentinvolvesthedeathofaperson,youwillbetestedforbothalcoholanddrugs.§382.303(a)(I)C.AccidentInvolvingaTicket.Ifyouareinanaccidentwhileperformingasafety-sensitivethnction,andyoureceiveamovingviolationticketbecauseoftheaccident,youwillbetestedforbothalcoholanddrugs.§382.303(a)(2)D.25%.25percentofalldriverswillberandomlytestedforalcoholeachyear.§382.305(a)(I)B.50%.50percentofalldriverswillberandomlytestedfordrugseachyear.§382.305(a)(2)F.ReasonableSuspicion.Driversunder‘reasonablesuspicion”ofalcoholuseordrugabusewhileperformingasafety-sensitivefunctionwillbetested.§382.307(a)G.Return-To-Work.Ifyoureturntoworkonsafety-sensitivefunctionsafterhavingtestedpositiveforeitheralcoholordrugs,youwillbetestedagainforalcoholordrugsafterreturningtowork.§382.3093 00 00H.Follow-Up.Ifyouhaveengagedinprohibitedconduct,youwillbesubjecttounannouncedfollow-uptestsforalcoholand/ordrugsasdirectedbytheTOWN’ssubstanceabuseprofessional.Follow-upalcoholtestsmaytakeplacejustbefore,justafter,orwhileyouareperformingasafety-sensitiveftrnction.Follow-uptestingwillnotexceed60monthsfromyourreturntoduty.§382.311,§382.605(c)IV.WhatIsASafety-SensitiveFunction?Thefollowingaresafety-sensitivethnctionstowhichtheprohibitionsonalcoholorillegaldruguseofthesepoliciesapply.IfyoudoanyoftheseactivitieswithrespecttoaTOWNvehicletowhichaCDLapplies,youareconsideredtobeperformingasafety-sensitivefunction:A.Anytimeyouarewaitingtobedispatchedonavehicle.B.Anytimespentinspectingequipmentonorinspecting,servicing,orconditioningavehicle.C.Alldrivingtime.D.Anytimeyouareinavehicle,otherthanwhenyouarerestinginitssleeperberth,ifany.B.Alltimespentloadingorunloadingavehicle,supervising,orassistingintheloadingorunloading,attendingavehiclebeingloadedorunloaded,beingreadytodriveavehicle,orgivingorreceivingreceiptsforshipmentsloadedorunloaded.F.Wheninavehicleaccidentinvolvinginjury,death,orpropertydamageofanykind,allthetimeyouspendfollowingtherequiredprocedures.0.Alltimerepairing,obtainingassistancefor,orstayingbyadamagedvehicle.§382.107,§395.2H.Mytimeyouareoncallandmayhavetodriveavehicle.4 0C;V.WhatDrug/Alcohol-RelatedConductisProhibited?Thefollowingspecificconductisprohibited:A.Beingondutyandintheperformanceofasafety-sensitivefunctionwhilehavinganalcoholconcentrationof0.02ormore.*382201,§382.505B.Beingondutyordrivingavehiclewhileinpossessionofalcohol.§382.204C.Usingalcoholwhileperformingasafety-sensitivefunction.§382.2050.Performingasafety-sensitivefunctionwithin4hoursafterusingalcohol.§382.207SIfyouhavetotakeanalcoholtestafteranaccident,usingalcoholwithin8hoursaftertheaccidentoruntilyoutakeapost-accidentalcoholtest,whicheverhappensfirst.§382.209F.Refusingtotakeapost-accidentalcoholordrugtest,arandomalcoholordrugtest,areasonablesuspicionalcoholordrugtest,orafollow-upalcoholordrugtest.§382.211G.Beingondutyorremainingondutyrequiringtheperformanceofsafety-sensitivefunctionswhenusingacontrolledsubstance,exceptwhentheuseisprescribedbyalicensedphysicianandwhenthephysicianhasadvisedyouthattheuseofthecontrolledsubstancewillnotaffectyourabilitytoperformthefunctions.§382.213H.Beingonduty,reportingfordutyorperformingasafety-sensitivefunctionifyoutestedpositiveforillegaldrugs.Youwillnotbepermittedtoperformorcontinuetoperformsafety-sensitivefunctionsifyoutestedpositiveforillegaldrugs.§382.2155 00 00VI.TestingProcedures.A.Pre-ErnplovmentTesting.Beforeyouareemployedorbeforeyoufirstworkinasafety-sensitiveposilion,youwillbetestedfordrugs.Youwillnotbehiredorallowedondutyunlessthedrugtestisnegative.§382301(a)ExceptiontoPre-EmploymentDru2Test.Youdonotneedadrugtestifyouhaveparticipatedinadrugtestingprograminthelastthirtydaysandwhileinthatprogramyouweretestedfordrugsinthelast6months;orparticipatedinrandomdrugtestingfortheprevious12months;andnoprioremployerofwhomtheTOWNhasknowledgehasrecordsofaviolationofthedrugpoliciesoftheDOTwithinthelast6months.§382.301(c)Undertheseexceptions,thepriordrugtestingprograminwhichyouparticipatedwillbecontactedandaskedforthefollowinginformation,subjecttoawrittenreleasefromyou:nameandaddressoftheprogram;verificationofyourparticipationintheprogram;verificationthatyouqualifiedundertheprogram;dateofyourlastdrugtest;andtheresultsofthatlasttest.Theinformationstaysinyourfile.§382.301(d)(1)B.Post-AccidentTesting.AssoonaspossibleafteranaccidentinvolvingaTOWNvehicletowhichaCDLapplies,eachsurvivingdriver(iftheaccidentinvolvedthedeathofaperson),orwhoreceivedacitationforamovingtrafficviolationbecauseoftheaccident,willbetestedforbothalcoholanddrugs.AdriverrequiredtobetestedunderthesecircumstanceswillbetransportedtothetestingsitebytheTOWN.§382.303(a)1.TwoHours.Ifyoufailorreffisetotakeanalcoholtestwithin2hoursaftertheaccident,yoursupervisorwillprepareandkeepafilestatingwhythetestwasnottaken.Ifthealcoholtestisnotadministeredwithin8hoursaftertheaccident,yoursupervisorwillceaseattemptstorequirethetestandwillproceedtopreparethefile.§382.303(b)(I)6 00 002.Thirty-TwoHours.Ifyoufailorrefusetotakeadrugtestwithin32hoursaftertheaccident,yoursupervisorwillceaseattemptstorequirethetestandwillproceedtoprepareafilestatingwhythetestwasnotadministered.§382.303(b)(2)3.Availability.Youmustremainavailablefortestingafteranaccidentoryouwillbeconsideredashavingrefusedtobetested.Thisdoesnotmeanthatyoucannotleavethesceneoftheaccidenttoobtainassistanceorthatmedicalattentionwillbedelayedforinjureddrivers.*382.303(c)C.RandomTesting.Atleast25percentofalldriverswillbetestedforalcoholeveryyearandatleast50percentofalldriverswillbetestedfordrugseveryyear.§382.305(a)ThesepercentagesmaychangebasedonafederaldeterminationwhichispublishedannuallyintheFederalRegister.§382.305(b)-(d)1.SelectionMethod.Theselectionofdriversforrandomtestingismadebyascientificallyvalidmethod,suchasarandomnumbertableoracornputcr-basedrandomnumbergeneratorthatismatchedwithadriver’ssocialsecuritynumber.Underthatprocess,eachdriverhasanequalchanceofbeingtestedeachtimeaselectionismade.§382.305(e).(I)2.Notification.Randomtestswillbeunannouncedandthedatesfortheiradministrationwillbespreadreasonablythroughouttheyear.Yoursupervisorwilltellyouiforwhenyouareselectedforarandomalcoholordrugtest.§382.305(g)3.Procedure.Ifyouarenotifiedofarandomalcoholordrugtest,youmustproceedtothetestsiteimmediately.Ifyouareperformingasafety-sensitivefunctionwhennotifiedofatest,youwillneedtostop7 00 00andproceedtothetestsiteassoonaspossible.TheTOWNtestsiteislocatedat___________________________________________________382.3O5(h)4.Youcanonlybetestedwhileyouareperformingsafety-sensitiveifinctions,justbeforeperformingthosefunctions,orjustafterperformingthosefunctions.§382.305(i)D.ReasonableSuspicionTesting.WhatIsReasonableSuspicion.Youmaybetestedforalcoholordrugsifyoursupervisorhas‘reasonablesuspicion”thatyouareusingorabusingalcoholordrugswhileperformingasafety-sensitivefunction.He/shewillbasethedecisiononspecific,present,andparticularobservationsofyourappearance,behavior,speechorbodyodors,includingindicationsofthechronicandwithdrawaleffectsofillegaldrugs.§382307(a)2.Procedure.Yoursupervisororotherofficialmustobservespecificexamplesandmakeobservationsofappearance,behavior,speechorbodyodorswhichleadhim/hertobelievethatyouareusingorabusingalcoholordrugs.Supervisorsandotherofficialsaretrainedinthewaystodetecttheuseandabuseofalcoholandillegaldrugs.Thepersonwhomakestheobservationwillnotbethesamepersonwhoadministersthealcoholordrugtest.Ifyouarerequiredtobetestedunderthesecircumstances,theTOWNwillprovidetransportationtothetestingsite.382.307(b).(c)3.AlcoholTests.Youcanonlybetestedforalcoholiftheobservationsaremadeduring,justbeforeorjustafteryouworkedonasafety-sensitivefunction.Ifyoufailorrefusetobetestedwithin2hoursoftheobservations,yoursupervisorwillprepareafilestatingwhythealcoholtestwasnotpromptlyadministered.After8hours,yoursupervisorwillceaseattemptstorequirethetestandwillprepareafilestatingthereasonsfornotadministeringthetest.§382.307(d).(e)(I)Ifyoursupervisorhasreasonablesuspicionthatyouareundertheinfluenceoforimpairedbyalcohol,youwillnotbepermittedto8 00 CCworkonsafety-sensitivefunctionsuntilyouhavetakenanalcoholtestandtheresultsshowaconcentrationof0.02orless;or24hourshavepassedaftertheobservation.Noactionshallbetakenagainstyousolelyonthebasisofyourbehaviorandappearanceintheabsenceofanalcoholtest.§382.307(c)(2)4.DrugTests.Youcanonlybetestedfordrugsiftheobservationsaremadeduring,justbeforeorjustafteryouworkedonasafety-sensitivefunction.Ifyoufailorrefusetobetestedwithin2hoursoftheobservations,yoursupervisorwillprepareafilestatingwhythedrugtestwasnotpromptlyadministered.After8hours,yoursupervisorwillceaseattemptstorequirethetestandwillprepareafilestatingthereasonsfornotadministeringthetest.§382.307(d)-(c)(I)Ifyoursupervisorhasreasonablesuspicionthatyouareimpairedbydrugs,youwillnotbepermittedtoworkonsafety-sensitivefunctionsuntilyouhavetakenadrugtestandthetestshownegativeresults;or24hourshavepassedaftertheobservation.Noactionshallbetakenagainstyousolelyonthebasisofyourbehaviorandappearanceintheabsenceofadrugtest.Ifyoufailorrefusetotakeadrugtestwithin32hoursaftertheobservation,yoursupervisorwillceaseattemptstorequirethetestandwillproceedtoprepareafilestatingwhythetestwasnotadministered.E.Return-To-DutyTesting.Beforeyoureturntoworkafteraviolationofeitherthealcoholordrugpolicy,youwillbetestedforalcoholordrugsagain.Thetestresultsmustindicateanalcoholconcentrationof0.02and/orlessandbenegativefordrugsbeforeyoumayperformanysafety-sensitivefunctionsagain.382.3O9F.FollowUpTesting.Whenyoutestpositiveforeitheralcoholordrugs,youwillbeevaluatedbyasubstanceabuseprofessional.Ifthesubstanceabuseprofessionaldecides9 00 00thatyouneedassistanceindealingwithanalcoholordrugabuseproblem,youwillbesubjecttounannouncedfollow-upalcoholordrugtestsaccordingtothedirectivesofthesubstanceabuseprofessional.Follow-upalcoholtestsareonlyconductedjustbefore,justafter,orwhileyouworkonasafety-sensitivefunction.§382.311VII.Proceduresusedtotestforpresenceofalcoholandcontrolledsubstances.A.AlcoholTestingProcedures.1.WhatIsTested?Alcoholtestingisdonebytestingbreathbecausebreathisthemosteasilyobtainedbodilysubstanceandtheresultsareknownwithinminutesoftesting.Thetestresultsaredisplayedandprintedintermsofgramsofalcoholper210litersofbreath.ThetestingdeviceiscalledanEvidentiaryBreathTestingDevice(EBT).•TheEBTisascientificinstrumentwhichdeterminestheconcentrationofalcoholexpressedas‘percentperweight.’Itdoesthisbyanalyzingaspecificvolumeofexpiredbreath.Theweightofalcoholinthebreathsampleisdeterminedandthequantityofthealcoholconvertedtoitsequivalentvalueinblood.ABloodAlcoholConcentration(BAC)of0.10means1/10thofagramofalcoholper210litersofbreath.TheEBTwillprintthreecopiesofeachtestresultandthetestresultswillbenumbered.§40.532.QuallwAssurancePlan.EachEBTmusthaveaQualityAssurancePlan(QAP)developedbythemanufacturer.Theplanshowsthemethodsusedtoperformexternalcalibrationchecksusingonlyapprovedcalibrationdevices.ItalsodescribestheminimumintervalsforperformingthecalibrationchecksfortheEBTandspeci’thetolerancesforextcrnalcalibrationcheckswithinwhichtheEBTisinpropercalibration.Finally,theplanspecifiesinspection,maintenance,andcalibrationrequirementsandintervals.§40.553.InitialTest.Atestmayhavetwoseparateparts.Thefirsttestistheinitialtest.Iftheinitialtestshowsareadingoflessthan0.02,thetestisrecordedas‘negative.”Iftheinitialtestresultis0.02orgreater,aconfirmationtestwillbedone.Thealcoholtestingwillbe10 00 CCadministeredatasitethataffordsprivacy.Onlyonebreathtestwillbedoneatonetime.Thepersongivingthetestwillnotleavethetestingsiteduringyourtest.§40,57Onlyacertifiedbreathalcoholtechnician(BAT),trainedintheoperationoftheEBT,mayadministerthealcoholtest.Yoursupervisormaynotadministerthetestunderanycircumstances.§40.51TheEBTwillimmediatelyreadtheresultsofthetestandacopyoftheprintedresultswillbegiventoyou.Printedresultsarenotrequiredfortheinitialtest.§40.594.Identification.Beforethetestisadministered,theBATwillaskyoutoprovideidentification.Ifyouask,theBATmustgiveyouhis/hername.§40.615.BlankTest.ThefirstpartofthetestingprocessistomakesurethattheEBTisoperatingproperly.Inyourpresencethetechnicianrunsan“airblank”testtomakesuretheEBTisworkingcorrectlyandthereadingiszero.Next,asealedmouthpieceisopenedandplacedintotheEBT.Inordertogetasufficientquantityofdeeplungair,youwillbeaskedtoblowintothemouthpieceforatleast6seconds,oruntiltheEBTindicatesthatanadequateamountofbreathhasbeenobtained.§40.636.ConfirmationTest.Whentheinitialtestsresultsshowareadingof0.02orgreater,aconfirmationtestisnecessary.TheBATwhoadministerstheconfirmationtestwillbedifferentfromtheBATwhoadministeredthefirsttest.Beforetheconfirmationtest,a15minutewaitingperiodwillbeobserved.Thepurposeofthe15minutewaitingperiodistomakesurethatthepresenceofmouthalcoholfromrecentuseoffood,tobacco,orhygieneproducts,doesnotartificiallyraisethetestresults.Astheconfirmationtestisdoneon11 00 00thesameEBTasthefirsttest,thetestingproceduresvi1lbethesame.Whentheresultsofthetestareavailable,theBATwillshowthemtoyouandaskyoutoinitialtheformonwhichtheresultsareprinted.§40.65Whentheconfirmationresultisdifferentfromtheinitialtest,thelowerofthetworesultswillbeusedtodeterminetheconsequences.Abreathalcoholtestingformwillbepreparedwithacopyforyou.§40.657.InadequateBreathSarpig.Ifyourefusetotrytoprovideanadequatebreathsample,theBATwillimmediatelynotifytheTOWN.§40.67Ifyoutrytoprovideanadequatebreathsamplebutyouareunableto,theBATwillmakeanoteofitinthe“Remarkssectionoftheformandimmediatelyinformyoursupervisor.Youxviiibedirectedbyyoursupervisortoobtainanevaluationbyalicensedphysician.Thephysicianwillprovideanopiniononwhetherornotamedicalconditionhaspreventedyoufromprovidingthebreathsample.§40.698.RelciseofResults.Theresultsofyouralcoholtestortcstswillnotbereleasedtoothersunlessyouexpresslyauthorizethereleaseorunlessrequiredbylaworcourtorder.Forexample,theTOWNmayreleasetheresultsofyouralcoholtest(s)toyournextemployerifyoufurnishtheTOWNaletterauthorizingthereleaseoftheresults.TheTOWNwillnotreleasetestresultsunlessyouspecificallyrequestthereleaseINWRITING.TheTOWNmaymaketheauthorizationforreleaseofprevioustestrecordsarequirementforemployment.§40.81B.DrugTestingProcedures.WhichDruEs.Therequiredtestingprogramislimitedtofivetypesofdrugs:marijuana,cocaine,opiates,amphetamines,andphencyclidine.§40.2!2.TestinaConditions.Alldrugtestingmustbedonefromurinespecimenscollectedunderhighlycontrolledconditions.Specimen12 00 CQcollectionproceduresrequireadesignatedcollectionsite;securityforthecollectionsite;chainofcustodydocumentation;useofauthorizedpersonnel;privacyduringcollection;integrityandidentityofthespecimen;andtransportationtothelaboratory.§40.233.CertifiedLaboratories.Driverprotectionisbuiltintothetestingprocedures.Theonlylaboratoriesthatcanbeusedarethosethathavebeenproperlycertified.§40.394.Aftertheurinespecimenhasbeencollectedandforwardedtothelaboratory,twotestsmaybeperformed.Theinitialtestistheimmunoassaytest.Thisisascreeningtesttodeterminedrugusageforthefiveclassesofdrugs.Thesecondtestisaconfirmationtest.§40.295.InitialTest.Iftheresultsoftheinitialtestarenegative,thetestinglaboratorywilladvisetheTOWN’sMedicalReviewOfficer(Ivll{O)thatthedrugtestforthedriverwasnegative.Noadditionaltestsonthespecimenwillbedone.§40.296.ConfirmatoryTest.Iftheresultsoftheinitialtestarepositive,thatis,iftheresultsexceedthepermittedlevelsforanyofthefivedrugstested,asecond(confirmation)testisperformed.Inthemeantime,youwillberemovedfromperforminganysafety-sensitiveduties,eventhoughtheresultsoftheconfirmatorytestarenotyetavailable.Thesecond,orconfirmatory,testisdoneinanentirelydifferentmannerfromtheinitialone.Allspecimensidentifiedaspositiveontheinitialtestsmustbeconfirmedusinggaschromatography/massspectrometrytechniques.OnlyspecimensthatareconfirmedpositiveonthesecondorconfirmatorytestarereportedpositivetotheMROforreviewandanalysis.§40.297.SplitSpecimenCollection.Asplitspecimencollectionwillbedone.Thatis,theurineisdividedintotwospecimenbottles.ifthetestresultoftheprimaryspecimenispositive,youmayrequesttheIvll{Otosendthesecond(orsplit)specimentoadifferentcertifiedlabfortesting.Thetestofthesplitspecimenwillbeforthepresenceofdrugswithnocut-offlevels.Iftheresultofthetestofthesplit13 0Cspecimenisnegative,theMROwillcancelthetest.Ifyouwantthesplitspecimentested,youmustadvisetheMROwithin72hoursofbeingnotifiedofthepositivetestresultoftheprimaryspecimen.Ifyouprovideaninsufficientquantityofurine,thetestwillbecanceled.Youwillbeaskedtodrinkfluidsandtotakeanothertest2hoursafterthefirsttest.Allcostsforasplitspecimentestwillbepaidbytheemployee.§40.258.RecordsofResults.TheTOWNwillkeeparecordinthedriver’spersonnelfileshowingthetypeoftest(pre-employment,etc.);dateofcollection;locationofcollection;entityperformingthecollection;nameofthelab;nameofthelWO;andthetestresults.Theresultsofyourtestortestswillnotbereleasedtoothersunlessyouexpresslyauthorizethereleaseorunlessrequiredbylaworcourtorder.Forexample,theTOWNmayreleasetheresultsofyourtest(s)toyournextemployerifyouffirnishtheTOWNaletterauthorizingthereleaseoftheresults.TheTOWNwillnotreleasetestresultsunlessyouspecificallyrequestthereleaseTNWRITING.TheTOWNmaymaketheauthorizationforreleaseofpreviousrecordsarequirementforemployment.Youcanaccesstheresultsofyourdrugtest(s)ifyoumakearequestINWRITING.§40.37VIII.AlcoholAndDrugTestsAreAMandatoryRequirementofYourEmployment.Youremploymentrequiresyoutotakeapost-accidentalcoholordrugtest,arandomalcoholordrugtest,areasonablesuspicionalcoholordrugtest,orafollow-upalcoholordrugtest.Ifyourethsetotakeanyofthosetests,yoursupervisorwillconsiderthatyoutestedpositiveforalcoholand/ordrugs,andyouwillnotbepermittedtoperformorcontinuetoperformanysafety-sensitivefunctionexceptinaccordancewiththeprocedureswhichapplytoapositivetest.§382.211Refusingtobetestedmeansthatyoueither:A.Didnotprovideenoughbreathfortestingwithoutavalidmedicalexplanationafteryouweretoldtherequirementsforbreathtesting;14 CCB.Didnotprovideadequateurinefordrugtestingwithoutvalidmedicalexplanation;orC.Engagedinconductthatclearlyobstructedthetestingprocess.D.Refusedtotakeanalcoholordrugtest.§382.107IX.WhatHappensIfYouTestPositiveForAlcoholOrDrugs?A.ImmediateConsequences.Youwillnotbeallowedtoworkonasafety-sensitivethnction.Youwillalsobeplacedonadministrativeleavewithoutpay(youmayuseanyaccruedsickleaveorvacationleave)untilyouhavecompletedreturn-to-dutytesting.§382.501,§382.503B.Evaluation.Ifyouhaveengagedinprohibitedconduct,youwillbeadvisedbyyoursupervisoroftheresourcesavailabletoyouinevaluatingandaddressingyouralcoholordrugabuseproblem,includingthenames,addresses,andtelephonesnumbersofsubstanceabuseprofessionals,counselingandtreatmentprograms.Someinformationisprovidedinthesematerials.Youwillalsobeevaluatedbyasubstanceabuseprofessionalwhowilldeterminewhattypeofassistance,ifany,youneedinaddressingyourdependenceproblem.TheTOWNwillmaintainasubstanceabuseprofessional.§382.605(a)-(b)C.Reti.im-To-DutvTesting.Ifyouhaveviolatedtheseprovisions,youwill,beforereturningtodutyandworkonasafety-sensitiveflrnction,takeareturn-to-dutyalcoholtestwitharesultindicatinglessthan0.02,ifyourconductinvolvedalcohol,oranegativedrugtest,iftheconductinvolvedillegaldrugs.§382.605(c)(l)D.Follow-UpTesting.Inaddition,ifthesubstanceabuseprofessionaldecidesthatyouneedassistance,youmustbeevaluatedagainbeforereturningtoworktomakesurethatyouhaveproperlyfollowedanyrehabilitationprogram.Youwillalsoneedtotakeunannouncedalcoholanddrugtestsafteryoucomebackonduty.Thenumberandfrequencyofthetestswillbedecidedbythesubstanceabuseprofessional.Therewillbeatleast615 00testsinthefirst12monthsfollowingyourreturntowork.Bothalcoholanddrugtestsmayneedtobeadministeredifthesubstanceabuseprofessionalsodetermines.Follow-uptestingmayoccurupto60monthsfromthedateofyourreturntoduty.Thesubstanceabuseprofessionalmaydeterminetostopthefollow-uptestingatanytimeafterthefirst6testsifhe/shedecidesthatthetestsarenolongernecessary.§382,605(c)(2)B.Referrals.Thesubstanceabuseprofessionalwhorefersyoutotreatmentbecauseofasubstanceabuseproblemshallnotreferyoutohis/herownprivatepracticeortoapersonororganizationfromwhichhe/shereceivespaymentorinwhichhe/shehasafinancialinterest.F.FurtherDisciplineandRehabilitation.YouwillalsobesubjecttotheprovisionsofSectionXI,DisciplineandRehabilitation.382.605(e)X.WhatHappensIfYourAlcoholConcentrationIs0.02OrMore,ButLessThan0.04?Iftheresultsofyouralcoholtestshowanalcoholconcentrationof0.02ormore,butlessthan0.04,you‘viiinotbeallowedtoworkonasafety-sensitiveifinction,includingdrivingaTOWNvehicle,untilthestartofyournextregularlyscheduleddutytime,aslongasthereareatleast24hoursbetweentakingthetestandwhenyoustartworkagain.Youmayalsobesubjecttoadditionalactionsconsistentwithregulations.§382.505XI.DisciplineandRehabilitation.A.AlcoholViolations:1.FirstViolation:Afterthefirstviolationduetotheuseofalcohol,ifthetestresultsindicatethattheemployeehadabreath/alcoholconcentrationof0.04orgreater,suchemployeeshall,attheTOWN’sdiscretion,eitherbesubjecttodisciplineasset-forthinparagraphN.,DisciplinaryAction,oftheTOWN’sPersonnelPolicyManual,and/ortheemployeeshallberemovedfromandcannotperformhis/herjobuntil:(a)Theemployeeundergoesanevaluationbyasubstanceabuseprofessionaland,wherenecessary,undergoesrehabilitation;16 0Qi(b)Asubstanceabuseprofessionaldeterminesthattheemployeehassuccessfullycompliedwithanyrequiredrehabilitation;and(c)Theemployeeundergoesareturn-to-worktestwithabreath/alcoholresultoflessthan0.02.Iftheresultsindicatetheemployeehadabreath/alcoholconcentrationof0.02orgreater,butlessthan0.04,suchemployeewillnotbepermittedtoperformhis/herjobdutiesforaminimumof24hours.Theemployee’ssupervisorwillhavesomeonetaketheemployeehome.Inthatevent,theemployeemustuseanytypeofaccruedleave,orleavewithoutpay.Theemployeewillbesubjectto“follow-up”testingasdescribedherein.2.SecondViolation.Uponthesecondorfurtherviolation,employeewillbesubjecttodisciplineasset-forthinparagraphN.,DisciplinaryAction,oftheTOWN’sPersonnelPolicyManual.B.DrugViolations.1.FirstViolation.Afterthefirstviolationduetotheuseofdrugs,asdeterminedbytesting,thesubjectemployeeshall,attheTOWN’sdiscretion,eitherbesubjecttodisciplineasset-forthinparagraphN.,DisciplinaryAction,oftheTOWN’sPersonnelPolicyManual,and/ortheemployeeshallberemovedfromandcannotperformhis/herjobdutiesuntil:(a)Theemployeeundergoesevaluation,andwherenecessary,rehabilitation;(b)Asubstanceabuseprofessionaldeterminesthattheemployeehassuccessfullycompliedwithanyrequiredrehabilitation;and(c)Theemployeetakesareturn-to-worktestwithaverifiednegativetestresult.Theemployeewillbesubjecttoa“follow-up”testingasdescribedherein.17 002.SecondViolation.Uponthesecondorfurtherviolation,theinvolvedemployeewillbesubjecttodisciplineasset-forthinparagraphN.,DisciplinaryAction,oftheTOWN’sPersonnelPolicyManual.MIRequirementsRelatingtoAllBreathandDrugTestsA.ObligationsofEmployees:1.Onceanemployeehasbeennotifiedoftheneedforanalcoholandlordrugtesttobeadministeredupontheemployee,theemployeeshallberequiredtovoluntarilysubmittotheadministrationofabreath/alcoholtest,ordrugtest,orboth,immediatelyafterbeingsonotifiedunlesstheemployeeisphysicallyincapableofsubmittingtosuchtest(s),andsuchinabilityisbeyondtheemployee’sabilitytoremedy,orasupervisorauthorizes,inwriting,adelayinthetestingprocedure.Insucheventtheemployeeshallvoluntarilysubmittosuchtestingassoonastheemployeebecomesphysicallycapableofdoingso.2.Ifanemployee’ssupervisorhasreasonablesuspiciontobelievethattheemployeeisundertheinfluenceoforimpairedbyalcoholordrugs,theemployeewillnotbepermittedtoworkuntilaftertheemployeehastakenabreath/alcoholand/ordrugtestandtheresultsshowabreath/alcoholconcentrationof0.02orlessandlortestnegativefordrugsand/or24hourshavepassedafterthelastobservationofsuspectedimpairment.3.Intheeventanemployee:(1)failsthetestforalcoholand/ordrugs;(2)failstovoluntarilysubmittotheadministrationofsuchtestingwithinthetimelimitssetforthherein(absentphysicalinability);or(3)inanyfashionknowinglyobstructs,impedes,delays,orinterfereswithsuchtesting,suchconductshallgiverisetoanirrebuttablepresumptionthatthetestswouldhaveturnedoutpositiveforalcoholuseand/ordruguse.Inthatevent,theemployeewillbesubjecttodisciplinaryactionuptoandincludingterminationasoutlinedintheTOWN’sPersonnelPolicyManual.4.Ifabreath/alcoholand/ordrugtestcannotbeadministeredduetonofaultoftheemployeetobetested,nodisciplinaryactionshallbetakenagainsttheemployee.18
