HomeMy WebLinkAboutRESOLUTION 23-95C0RESOLUTION23-95WHEREAS,theTownAttorney,GregoryA.White,hasinformedtheBoardofTrusteesthatduetoaconflictofinterest,hecannotpursuecertainallegedmunicipalcodeviolationsinvolvingtheElkhornLodge;andWHEREAS,itisnecessarytoappointaSpecialProsecutorforthepurposeofrepresentingtheTownintheprosecutionofsaidallegedmunicipalcodeviolations.NOWTHEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEstesPark,Colorado:Section1.JohnP.FreyofFrey,Korb,HaggertyandMichaelsofFortCollins,ColoradoisherebyappointedSpecialProsecutorforthepurposeofpursuingandprosecutinganyandallmunicipalcodeviolationsrelatingtotheElkhornLodgeincluding,butnotlimitedto,causesofactionintheEstesParkMunicipalCourt,LarimerCountyCourt,andLarimerCountyDistrictCourt.Section2.JohnP.Frey,actingasSpecialProsecutor,shallhavealloftherightsandresponsibilitiesoftheTownAttorneyinrepresentingtheTownofEstesPark.PASSEDANDADOPTEDTHIS12thDAYOFSEPTEMBER,1995.TOWNOFESTESPARK,COLORADOMayorATTEST:TownClerk
