HomeMy WebLinkAboutRESOLUTION 22-950CRESOLUTIONNO.22-95BEITRESOLVEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:TheBoardofTrusteesoftheTownofEstesPark,Colorado,inaccordancewithSection31-12-1O7(g),C.R.S.,herebystatesitsintentiontoannextheareadescribedherein.TheBoardofTrusteesfindsanddeterminesthatthePetitionfiledwiththeTownrequestingannexationoftheareadescribedhereinisinsubstantialcompliancewithSection31-12-107(1)(g),C.R.S.TheBoardofTrusteesfurtherfindsanddeterminesthatthePetitionissignedbypersonscomprisingonehundred(100%)percentofthelandownersintheareaproposedtobeannexedandowningonehundred(100%)percentofthearea,excludingpublicstreets,andalleysandanylandownedbytheannexingmunicipality.Sucharea,ifannexed,willbeknownas“MIGNERYADDITIONtotheTownofEstesPark,Colorado.Suchareaisdescribedasfollows:AportionofSection1,T4N,R73Wofthe6thP.M.,LarimerCounty,Colorado,describedascommencingatthemostWesterlycornerofthetractoflandconveyedfromtheEstesParkDevelopmentCompanytoE.R.andRoseK.SmithrecordedinBook984atPage516,saidcornerbeingtheTRUEPOINTOFBEGINNINGThenceN38°55’Eadistanceof475.00feet;ThenceN51°05’Wadistanceof359.26feet;ThenceS40°31’Wadistanceof475.18feet;ThenceS51°05’Eadistanceof373.28feettotheTRUEPOINTOFBEGINNING.ITISFURTHERRESOLVED,thatinaccordancewithSection31-12-108,C.R.S.,apublichearingshallbeheldonOctober10,1995,at7:30P.M.,intheMunicipalBuilding,locatedat170MacGregor,EstesPark,Colorado,forthepurposeofdeterminingiftheproposedannexationcomplieswiththeapplicableprovisionsofSections31-12-104and31-12-105,C.R.S. 00 00ITISFURTHERRESOLVED,thattheTownClerkshallgivethenoticeofthehearingasprovidedinSection31-12-108(2),C.R.S.ITISFURTHERRESOLVED,thattheplatoftheMigneryAdditionbereferredtothePlanningCommissiontobeginthenecessaryprocedurestomakethepropertysubjecttothezoningordinancesoftheTown.C/DATEDTHIS4-%dayofLLK’eL.,1995.I!TOWNOFESTESPARKMayorATTEST:TownClerk 00
