CDRESOLUTION20-95WHEREAS,byOrdinanceNo.12-95,theBoardofTrusteesoftheTownofEstesParkhascreatedtheParkEntranceEstatesSpecialImprovementDistrictNo.95-1(the“District”);andWHEREAS,also,byOrdinanceNo.12-95,theBoardofTrusteesoftheTownofEstesParkhasauthorizedtheacquisitionandconstructionofcertainwaterdistributionsystemimprovementsandroadwayimprovementswithintheDistrict;andWHEREAS,inordertofinancetheacquisitionandconstructionoftheimprovements,itistheintentionoftheTowntoseekapprovaloftheissuanceofSpecialAssessmentBonds,pursuanttotheapplicableprovisionsofSection5,Article25,Title31,C.R.S.;andWHEREAS,thefirstdateavailabletotheTowntoholdsaidelectionisNovember7,1995;andWHEREAS,theBoardofTrusteesoftheTownhasdeterminedthatpursuanttotheprovisionsofSection31-25-534(3)C.R.S.,thatonlyregisteredelectorswhoareownersofpropertywithinorresidentsoftheDistrictshallbeeligibletovoteonthequestionoftheissuanceoftheSpecialAssessmentBonds;andWHEREAS,itisnecessarytoauthorizecertainotheractionsconcerningsaidelection.NOWTHEREFORE,BEITRESOLVEDbytheBoardofTrusteesoftheTownofEsteePark,Colorado:Section1.TheBoardofTrusteesherebyfindsanddeterminesthatanelectiontoauthorizetheissuanceofSpecialAssessmentBondsfortheacquisitionandconstructionofroadwayandwaterdistributionsystemimprovementswithintheParkEntranceEstatesSpecialImprovementDistrictNo.95-1shallbeheldonNovember7,1995.Section2.TheBoardofTrusteesherebyfindsanddeterminesthatthosepersonseligibletovoteonthequestionoftheissuanceofsaidSpecialAssessmentBondsshallonlyberegisteredelectorswhoareownersofpropertywithinorresidentsoftheParkEntranceEstatesSpecialImprovementDistrictNo.95-1. 0LIC Section3.TheBoardofTrusteesherebyauthorizestheappropriateemployeesandagentsoftheTowntoprepareallnecessaryResolutionsand/orOrdinancesincluding,butnotlimitedto,thewordingoftheballotquestion,forsubmissiontotheBoardatalaterdate.Section4.TheBoardofTrusteesalsoauthorizestheappropriateofficialsoftheTownofEstesParktoexecutetheagreementconcerningcoordinatedelectionservicesdatedthe20thdayofJuly,1995betweentheTownandLarimerCounty,Colorado,ClerkandRecorder.Section5.TheBoardofTrusteesalsofindsanddeterminesthattheboundaryoftheareatobeusedforthepurposeofArticle5,Title1,C.R.S.,shallbetheboundaryoftheParkEntranceEstatesSpecialImprovementDistrictNo.95-1.Theprecinctandpollingplacesforsaidelection,includingearlyelectionshallbeestablishedbytheLarimerCountyClerkandRecorderonorbeforethetimerequiredbyStateStatuteandinaccordancewiththeabovereferencedagreementconcerningcoordinatedelectionservices.PASSEDANDADOPTEDTHIS8thDAYOFAUGUST,1995.TOWNOFESTESPARK,COLORADOMayorATTEST:f%4,d7iMt-aUTownClerk a
